Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT MEETING DATE: AGENDA #: PREPARED BY: DISCUSSION: FEBRUARY 28, 2007 5F LARRY POPPLER, ASSISTANT CITY ENGINEER CONSIDER APPROVAL OF A RESOLUTION ACCEPTING PLANS AND SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR SIDEWALK CONSTRUCTION ON HAWK RIDGE ROAD (CITY PROJECT #06-15) Introduction The purpose of this agenda item is to accept the plans and specifications for City Project #06-15 and authorize advertisement for bids. AGENDA ITEM: Historv On March 20, 2006, Council adopted Resolution 06-039 approving the preliminary plat of "NORTHWOOD MEADOWS" subject to added conditions. One of the conditions was that staff and developer review the feasibility of extending sidewalk along Hawk Ridge Road to Northwood Road with the developer paying the costs. Based on that condition, an Engineer's Estimate of $21,120.00 was established on July 19, 2006 and included in the Development Contract. On August 7, 2006 the City Council approved the Development Contract for the development of land known as "NORTHWOOD MEADOWS". The Development Contract required the developer to furnish the City with a sidewalk escrow of $26,400.00 for the future construction of sidewalk on Hawk Ridge Road. This escrow was based on 125% of the estimated cost. In November of 2007 staff surveyed Hawk Ridge Road. Separate preliminary plans were prepared to analyze the feasibility of construction of a sidewalk on the south side and the north side of the road. Current Circumstances A neighborhood informational meeting was held on January 17, 2007 to provide affected property owners an opportunity to view the plans and discuss the project with city staff. Contrary to the original determination, staff informed the property owners that they recommended constructing the sidewalk on the north side of Hawk Ridge Road due to steep driveway grades on the south side and the inability to meet design standards. Three of four property owners on the north side of the road were present to comment on this recommendation. Staff proceeded with plans and specifications for the project based on their recommendation and the property owner's comments. The plans and specifications are nearly complete and ready to receive bids. The current design shows a 6 foot sidewalk against the curb on the north side of Hawk Ridge Road. www.cityofpriorlake.com Reports\2007\03 1f'I9J~~i:P4If.II9~JP~~~~c ISSUES: At the neighborhood informational meeting held on January 17, 2007, the following issues were discussed and recommendations made: 1. Property owners along Hawk Ridge Road opposed the proposed sidewalk on from "NORTHWOOD MEADOWS" to Northwood Road. Staff Response: The decision to extend sidewalk from "NORTHWOOD MEADOWS" to Northwood Road was made at the March 20th 2006 City Council meeting. The City Council stated that the extension of the sidewalk to Northwood Road should be added to provide pedestrian access to the community park. 2. If sidewalk is constructed the residents opposed a sod boulevard and requested the sidewalk be constructed directly back of concrete curb. Staff Response: Staff felt that this was a reasonable request considering the limited right of way and designed the sidewalk directly in back of the concrete curb. As has been the case with past city projects where the sidewalk was constructed directly back of concrete curb, the width was increased from 5' to 6'. 3. If sidewalk is constructed the mailboxes will have to be moved from the north side to the south side of the road. Staff Response: The Prior Lake Postmaster was contacted and they authorized the moving of the mailboxes from the north to the south side of the road. A bid item was included in the schedule to salvage and reinstall each mailbox on the north side. 4. If sidewalk is constructed the residents questioned who would be responsible for snow removal. Staff Response: The City Park Maintenance Division of Public Works will be responsible for snow removal on the sidewalk pursuant to the City's snow removal policy. 5. If sidewalk is constructed the residents questioned the restoration process. Staff Response: City staff will work with each property owner to restore driveways and yards. 6. Property owners questioned whether their underground sprinkler systems would be repaired as part of the project. Staff Response: All four residents on the north side have underground sprinkler systems. Since the property owners have resided at these properties for a number of years and the sidewalk was not part of the original project, staff recommends including a linear foot bid item in the schedule to repair any sprinkler components that are damaged as a result of the project. Reports\2007\D3 i Ridge specs agenda report.doe CONCLUSION The staff recommends the City Council approve the project plans and specifications and authorize advertisement for bids for City Project #06-15. When the City advertises for bids, there is always a provision in the bid documents specifying the City Council reserves the right to reject all bids. The City Council has in the past, rejected bids on projects where the bids exceeded the estimate or were otherwise unfavorable for the City. FINANCIAL IMPACT: The Developer has escrowed $26,400.00 for this sidewalk project. These funds will be utilized to construct the sidewalk. This figure was calculated as 125% of the original estimate. The original estimate included basic sidewalk construction assuming general sidewalk placement. It is anticipated that because of the grades and design, additional driveway repair, hydrant relocation, catch basin relocation, mailbox relocation, sprinkler system repair, and additional concrete work, the bids may exceed the escrowed amount. At the time of approving the bids, the City Council may need to consider dedicating additional funds toward this project. ALTERNATIVES: The alternatives are as follows: 1. Approve Resolution 07 -XX approving plans and specifications for City Project #06-15 and authorizing advertisement for bids. 2. Table the Resolution for a specific reason. 3. Deny the Resolution. One of the conditions was that staff and Developer review the feasibility of extending a sidewalk along Hawk Ridge Road, and; WHEREAS, The Developer has escrowed $26,400.00 for the sidewalk improvements on Hawk Ridge Road with the August 7, 2006 approval of the Development Contract and final plat for "NORTHWOOD MEADOWS" and; WHEREAS, This sidewalk connection will link Northwood Road sidewalk to the community park dedicated with the "NORTHWOOD MEADOWS" final plat. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Council hereby accepts the plans and specifications for the Hawk Ridge Road sidewalk construction project. 3. The City Council hereby authorizes City Staff to advertise for bids for the sidewalk construction on Hawk Ridge Road. PASSED AND ADOPTED THIS 19TH DAY OF MARCH 2007.
