HomeMy WebLinkAbout8A - Pavlish Property MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: ISSUES: FINANCIAL IMPACT: CITY COUNCIL AGENDA REPORT MARCH 19, 2007 8A STEVE ALBRECHT, DIRECTOR OF PUBLIC WORKS PUBLIC HEARING FOR PAVLISH PROPERTY PARK LAND AQUISTION DEPARTMENT OF NATURAL RESOURCE GRANTS Introduction The purpose of this public hearing is to allow citizen input regarding the DNR Grant Applications for the Pavlish Property acquisition. Historv The Trust for Public Land has obtained a purchase agreement for the Pavlish Property located on Pike Lake. The attached map shows the Pavlish Property along with nearby City and adjacent parcels. The property is split into two separate parcels that total 30 acres of which 16 acres is upland non-wetland or lake. City Staff believes that the acquisition of this land combined with future dedication from adjacent properties as they develop could result in a park that encompasses all of Pike Lake. This park would be 75-100 acres with as much as 40-50 acres of non-wetland or lake. This park would perform the function of both a community park and neighborhood park for this area. Purchase Agreement for the Pavlish Property obtained by the Trust is for $1,875,000. On December 5, 2006 the City Council authorized City Staff to work with the Trust to obtain grants to acquire the property for City park land. The City Council also supported a funding commitment of up to $500,000 by the City of Prior Lake for the purchase. Current Circumstances The Trust has completed grant applications for the DNR's Metro Greenways, Natural and Scenic Area, and Remediation Fund grants. As part of those applications the City Council must hold a public hearing to take input. The Trust's purchase agreement expires in the fall of 2007. The Trust will need to obtain commitments for $1.375 million in funding by September of 2007. The grant funds for the acquisition could limit active uses on the property. Because the City will have the opportunity to acquire adjacent land through future park land dedication staff feels any active use restrictions on these parcels can be accommodated on adjacent parcels. The City of Prior Lake would provide $500,000 for purchase of the property. The City's contribution would be funded from the Capital Park ($375,000) and Contingency Funds ($125,000). RECOMMENDED Staff recommends alternative number 1 MOTION: oyles, City Manager A RESOLUTION SUPPORTING DEPARTMENT OF NATURAL RESOURCE GRANT APPLICATIONS FOR ACQUISITION OF THE PAVLlSH PROPERTY FOR PIKE LAKE PARK Motion By: Second By: WHEREAS, The City of Prior Lake held a public hearing on March 19, 2007, to discuss the Pike Lake Park grant application and that the project scope, schedule, costs and financing were discussed and public comment was taken; and WHEREAS, The City of Prior Lake will act as the legal sponsor for the Pike Park project contained in the Remediation Fund, Natural and Scenic Area and Metro Greenways Grant Program Applications to be submitted by March 30,2007, and that the City Manager is hereby authorized to apply to the Department of Natural Resources for fund of this project on behalf of the City of Prior Lake; and WHEREAS, The City of Prior Lake has the legal authority to apply for financial assistance, and the financial capacity to meet the match requirement and endure adequate management and protection; and WHEREAS, The City of Prior Lake has not incurred any development costs described in item 5 of the application and has not entered into a written purchase agreement to acquired the property described in on item 4 as described in the application; and WHEREAS, That upon approval of this application by the state, the City of Prior Lake may enter into an agreement with the State of Minnesota for the above referenced project, and that the City of Prior Lake certifies that it will comply with all applicable laws and regulations as stated in the grant agreement including dedicating the park property for natural and/or park uses into perpetuity. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Manager is authorized to execute such agreements that are necessary to implement the project on behalf of the City of Prior Lake. PASSED AND ADOPTED THIS 19th DAY OF MARCH 2007.
