CONSIDER APPROVAL OF A REPORT REGARDING A CHANGE IN THE CR
21, WINDSONG ASSOCIATION SAFETY FENCE MATERIAL COMPOSITION
& CONTRIBUTION
Introduction
The purpose of this agenda item is for the City Council to consider a request for
a change in the safety fence material proposed at the Windsong Association
along CR 21.
Historv
As part of the CR 21/CR 82 project the County constructed a retaining wall along
CR 21 between the new roadway and the existing tennis court. The majority of
the wall is higher than 4 feet and requires a safety fence along the tennis court
access sidewalk on top of the wall. As is standard with all safety fences the
County will place a 4 or 6 foot black vinyl coated chain link fence.
In November of 2006 County and City Staff met with residents to discuss the
fence. Originally the County had not planned to place a fence as the wall was
not intended to be higher than four feet. Due to design changes the fence was
added during the project for safety purposes because of the higher retaining wall
and to accommodate access to the tennis courts. The reaction of Windsong
representatives was one of concern regarding the chain link safety fence. They
requested that the City consider upgrading the fence material similar to the Bay
Knolls Drive safety fence at Glynwater.
In the fall of 2005 the City Council authorized upgrade of the chain link safety
fence at Glynwater to a solid wood fence. The cost of the upgrade was $22,700.
The Glynwater Association donated 20 6-8 foot spruce trees to the City with an
estimated value of $6,000 as their contribution to the upgrade. This was
approximately 26% of the total upgrade cost. This change was incorporated into
the construction plans as part of the project.
In February of 2007 City Staff met with representatives of the Windsong
Association to discuss the proposed safety fence. At that meeting the
Association proposed that a wrought iron fence shown in the attached exhibit be
constructed. The total cost for the fence upgrade from chain link to this option is
$42,000. The County has verbally committed to contribute the $4,500 -$5,000
cost of the chain link fence.

Current Circumstances
Association representatives have requested that the City of Prior Lake pay 2/3 of
this upgrade cost or approximately $28,000. The Association would pay $14,000
for the upgrade.
There are several issues pertaining to this request:
1) The County is ready to place a permanent safety fence along CR 21 and
needs a decision from the City as soon as possible.
2) The net support given Glynwater by the City was $16,700 for a wood
fence.
3) This fence while providing a safety purpose is clearly decorative.
4) Because the County project does not have bid considerations for a fence
of this nature the City will need to enter into an agreement with the
association for construction of the fence.
5) The City has future projects on CR 12 and CR 42 that could potentially
involve fence upgrades and cost sharing. This could set a precedent for
those projects.
6) While the Street Oversize Fund can be justified for use in construction of
the safety fence required by the expansion of the roadway due to traffic
volumes the use of these funds for decorative upgrades is most likely not
appropriate.
The wall and fence is required by the roadway expansion due to increase traffic
volumes. The Street Oversize Fund is available for funding of this type of
improvement.
The alternatives are as follows:
1. Consistent with the Glynwater action the City could participate in the upgrade
cost of a wood fence for $9,600. The Association would be responsible for
the estimated balance of $32,400 if they continue to desire the decorative rod
iron fence. Should the wooden fence option be pursued the Association
would pay $3,400.
2. Allow the County to proceed with placement of the chain link fence at no
additional cost to the City.
3. Contribute $28,000 to the upgrade of the fence as requested by the
Windsong Association.
4. Deny this item for a specific reason and provide Staff with direction.
5. Table this item until some date in the future.

A RESOLUTION AUTHORIZING A CHANGE IN THE CR 21, WINDsONG ASSOCIATION SAFETY
FENCE MATERIAL COMPOSITION AND CONTRIBUTION

WHEREAS, The City of Prior Lake has previously worked with the Glynwater Association to
upgrade the safety fence from chain link to wood; and
WHEREAS, The Windsong Association has requested that the City contribute to the upgrade of the
CR 21 safety fence; and
WHEREAS, City Staff supports an upgrade contribution of $9,600 by the City of Prior Lake for a
change from chain link to wood; and
WHEREAS, The Windsong Association would be responsible for a contribution of $3,400 for this
upgrade.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City is authorized to contribute $9,600 to the upgrade of the Windsong Association safety
fence from the Street Oversize fund.
