RESOLUTION 05-023PC
A RESOLUTION APPROVING A SITE PLAN TO ALLOW FOR A DETACHED
STRUCTURE LOCATED ON A PORTION OF A LOT WHICH IS SEPARATED FROM
THE PRINCIPAL STRUCTUE BY A PRIVATE ROADWAY
BE IT RESOLVED BY the Board of Adjustment of the City of Prior Lake, Minnesota;
FINDINGS
1. Dennis Perrier has applied for site plan approval under the Zoning Ordinance in order
to permit the construction of a detached accessory structure on a portion of the lot
which is separated from the principal structure by a private roadway. The proposed
lot is located in the R-l and SD (Shoreland District) at 16502 Inguadona Beach
Circle, and legally described as follows:
Tracts A and B, Registered Land Survey No. 185, Scott County, Minnesota.
2. The Board of Adjustment has reviewed the application for a site plan as contained in
Case File #05-214PC and held hearings thereon on November 28,2005.
3. The applicants own two nonconforming lots of record, which are divided by a private
road or driveway. These lots have been combined and are considered a single parcel.
4. The location of the existing dwelling on Tract A precludes the construction of an
accessory structure on Tract B. The materials for the proposed accessory structure are
compatible in design and materials with the existing principal structure.
5. This proposal is consistent with the criteria listed in Section 1101.501 (3,d) of the
Zoning Ordinance.
6. The granting of the accessory structure is necessary for the preservation and
enjoyment of a substantial property right of the property owner.
7. The contents of Planning Case File #05-214PC are hereby entered into and made a
part of the public record and the record of decision for this case.

CONCLUSION
Based upon the Findings set forth above, the Board of Adjustment hereby approves the
following conditions for the proposed structure as shown in the Certificate of Survey:
1. A site plan to permit a detached accessory structure to allow a detached structure
located on a lot which is separated from the principal structure by a private roadway.
Adopted by the Board of Adjustment on November 28,2005.
