Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT APRIL 16, 2007 SA LARRY POPPLER, ASSISTANT CITY ENGINEER PUBLIC HEARING TO CONSIDER APPROVAL OF A RESOLUTION ORDERING THE COUNTY ROAD 12/ TRUNK HIGHWAY 13 IMPROVEMENT PROJECT AND PREPARATION OF PLANS AND SPECIFICATIONS Introduction The purpose of this agenda item is to hold a Public Hearing for the County Road 12 / Trunk Highway 13 Improvement Project and authorize the preparation of plans and specifications. Approval requires a 4/5ths vote. Historv At the September 18, 2006, City Council meeting, the Council adopted Resolution No. 06-172 authorizing staff to prepare a Feasibility Report for the County Road 12 and Trunk Highway 13 Improvement Project as approved by the Council in the 2007-2011 Capital Improvement Program (CIP). At the City Council meeting on February 20, 2007, the City Council adopted Resolution 07-026 accepting the Feasibility Report and establishing the Public Hearing. This segment of CR 12 proposed for improvement is located in the southwest corner of the City of Prior Lake from Trunk Highway 13 to Pheasant Meadow Lane. The intersection of CR 12 and TH 13 along with portions of TH 13 will also be reconstructed. A map of the project area is shown on Exhibit 1 of the Feasibility Report. This is Phase No. 2 of the County Road 12 project. Phases 3 and 4 are scheduled for construction in 2010. Phase NO.3 is from Pheasant Meadow Lane to County Road 81. Phase NO.4 is from Shoreline Lane to County Road 17. Phase No. 1 was constructed in 2006 with the Stemmer Ridge development project from County Road 81 to Shoreline Lane. The proposed project includes street reconstruction, addition of turn lanes and medians, storm sewer, concrete curb and gutter and appurtenant work. Sanitary sewer on County Road 12 is proposed to be replaced from Pheasant Meadow Lane to the sanitary manhole located at 3737 County Road 12. Existing watermain is proposed to remain in-place with additional watermain added at the intersection of CR 12 and TH 13. A new storm water pond is proposed for the northwest corner of CR 12 and TH 13. www.cityofpriorlake.com Phone 952.447.9800 / Fax 952.447.4245 Current Circumstances The purpose of the Public Hearing is to determine if the project should move forward to the next step in the process. The Public Hearing will cover the reconstruction of County Road 12 from Trunk Highway 13 to Pheasant Meadow Lane. Details of the project and the proposed financing were part of the Feasibility Report presented to the City Council on February 20, 2007. A public informational meeting was held on March 14, 2007. No persons attended this meeting. While this is the official approval for the preparation of plans and specifications for this project, the consultant for Scott County Highway Department has already completed the preparation of the plans and specifications. City Staff has worked closely with the consultant during the design so that the improvements meet City Standards. On County Roadway projects, once we approve the geometric layout, the County begins final design. In this case the City approved the geometric layout on February 6, 2006. The County began the preparation of the final design plans at that point. On normal County Road projects, the next time the City Council reviews a project is when they are accepting the final plans and authorizing the cooperative agreement. It may seem that the process is out of order on this project, but because we are assessing the City portion of this project, the City must follow an additional process in order to assess for the improvements. This additional process must follow the Minnesota Statute 429. Part of the 429 process includes the preparation of a Feasibility Report, conducting a Public Hearing, and passing a resolution ordering the improvements and authorizing the preparation of plans and specifications. The City is using estimates generated by the consultant for the project to compute the assessment. These estimates can not be obtained until after the County has completed a portion of the design. Normal County Roadway projects that are not funded in part by special assessments would not need to follow this procedure. ISSUES: The Assessment Review Committee met on February 5, 2007, at which time the following issues were discussed and recommendations made: Street and Storm Sewer Reconstruction Pursuant to the assessment policy, the street and storm sewer reconstruction should be assessed at up to 40% of the total project cost against the 9 benefiting properties, based upon the special benefit created for each such property. Assessment Method The Assessment Review Committee recommends the unit method of assessment for County Road 12 due to the fact that the lots in the project area are of similar size and/or value. The estimated assessment rate is proposed at $6,107/unit. Trail Construction Trail construction be funded through the Capital Park Fund. FINANCIAL IMPACT: The City's portion of the County Road 12 Improvement project cost is proposed to be financed with special assessments, street oversize fund, capital park fund, water quality fund, and trunk reserve funds. Funding sources and amounts are as shown below: Assessments $54,967.00 Street Oversize Fund $370,640.00 Trunk Storm Water Fund $139,093.00 Water Quality Fund $50,000.00 Capital Park Fund $60,479.00 Trunk Sewer & Water Fund $97,591.00 Utility Fund $100,000.00 Total City Cost $872,770.00 The chart shows the breakdown for the City's portion of the project cost. The overall project cost is $872,770.00. ALTERNATIVES: The alternatives are as follows: 1. Conduct a Public Hearing and approve a resolution that orders the County Road 12 / Trunk Highway 13 project and authorize staff to prepare plans and specifications. 2. Table the Resolution for a specific reason. 3. Deny the Resolution. RECOMMENDED MOTION: Alternative #1 Frank Boyles, Reviewed by: 1J ORDERING IMPROVEMENTS AND PREPARATION OF PLANS AND SPECIFICATIONS FOR COUNTY ROAD 12 FROM TRUNK HIGHWAY 13 AND PHEASANT MEADOW LANE WHEREAS, WHEREAS, WHEREAS, WHEREAS, Motion By: Second By: The Prior Lake City Council on its own initiative has determined that it desires to complete the County Road 12 Project from Trunk Highway 13 to Pheasant Meadow Lane; and On February 20th, 2007, the City Council adopted Resolution 07-026 accepting the Feasibility Report and calling for a Public Hearing to be held on the County Road 12 project from Trunk Highway 13 to Pheasant Meadow Lane which includes improvements to the sanitary sewer, water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, and appurtenant work; and The required mailed notice and published notice of the hearing was given and the hearing was held on the 16th of April, 2007 at which time all persons desiring to be heard were given an opportunity to be heard thereon; and Since the project is initiated by the City Council it must be approved by 4/Sths vote in accordance with Minnesota State Statutes 429.031 Subdivision 1 (t). NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Engineer is hereby authorized to prepare plans and specifications for the improvements delineated in City Council Resolution 07-026 adopted February 20, 2007, and by the required statutory 4/Sths vote does hereby order the project. 3. The City Engineer is hereby designated as the Engineer for these improvements. The Engineer shall prepare plans and specifications for making such improvements.
