Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT April 16, 2007 10A Kelly Meyer, Assistant City Manager CONSIDER APPROVAL OF (1) A POLICY PROVIDING FOR OVERNIGHT RENTAL OF CITY-OWNED BOAT SLIPS, AND (2) AN ORDINANCE AMENDING SECTION 702 OF THE PRIOR LAKE CITY CODE TO ALLOW FOR OVERNIGHT BOAT SLIPS IN CERTAIN PARKS. Introduction: At its February 2, 2007 meeting, the City Council asked staff to provide options for how overnight boat slip rentals might be accommodated in order to increase the usage of City-owned boat slips installed at Watzl's Beach in Lakefront Park, and to be installed at Sand Point Beach. Historv: In 2005, the City installed 18 boat slips at Watzl's Beach in Lakefront Park. The rationale for adding this type of amenity was two-fold - (1) it would increase the usage of Watzl's Beach and Lakefront Park, and (2) it would provide lake users access to the downtown area. The addition of the amenity was responsive to two of the goals of the City's 2030 Vision and Strategic Plan - (1) to enhance the recreation opportunities in our community, and (2) to link two important City features - downtown and the lake. In 2007, the City has programmed the addition of 18 more slips at Sand Point Beach. The current policy and ordinance regulating the boat slip usage provides for the following usage of the slips: Slip #1 - reserved for law enforcement Slips #2 through #10 - advanced daily reservations for a fee. Unreserved slips become available on a first come/first served basis. Slips #11 through #18 - first come/first served No overnight storage is permitted. No parking is provided with reservations. No usage of the slips is permitted after the park closes. Current Circumstances: At a result of the direction given by the City Council at its February 2, 2007 meeting, staff began to identify the potential issues related to overnight rental of boat slips. On April 2, 2007, the City Council, Park Advisory Committee, Lake Advisory committee and City staff conducted a joint meeting to further discuss the impacts and provide staff with additional direction for developing a policy for overnight rental. Staff has taken that feedback and developed the attached policy. In order for the overnight boat slip rental policy to be effective, the ordinance regulating www.cityofpriorlake.com Phone 952.447.9800 / Fax 952.447.4245 parks also needs to be amended. Conclusion: Below is an outline of the policy provisions and the ordinance amendments required. ISSUES: Overniaht Boat Slip Rental Policv Summary: (1) Location:9 Slips (#10 - #18) at Watzl's Beach, Lakefront Park 9 Slips (#10 - #18) at Sand Point Beach, Lions Sand Pointe Park (2) Parking: 9 Vehicle (without trailer) parking spots at Lakefront Park will be included for the full period of any overnight slip reservation at Watzl's Beach. No parking beyond park hours (5am-1Opm) (3) Length of Reservation: Weekend Period (Friday noon through Mon 10am), or Weekday Period (Monday noon through Fri 10am). Limited to two weekend reservations per household per season, and two (2) weekday reservations per household per season. Blackout dates include 4th of July, Lakefront Days at Watzl's Beach only. Reservations must be made at least one week in advance. (4) Reservation Requirements: Signed liability waiver indemnifying City from any loss. Proof of residence (driver's license or utility bill) Current boat registration (5) Fee: Resident Weekday Rate (Mon noon-10am Fri rental) - $60 Non-Res. Weekday Rate (Mon noon -10am Fri rental) - $80 Resident Weekend Rate (Fri noon -Mon 10am rental) - $75 Non-Res. Weekend Rate (Fri noon -Mon lOam rental) - $105 (6) Unused Slips: Slips not marked reserved shall become available on a first come, first served basis. Ordinance Amendments The proposed ordinance is attached to this report and provides the full text of the ordinance. Below is a summary of the amendments. ~ Section 702.600 - Amended to read "Moor a boat in a City slip or on park shoreline before or after the hours the park is open, unless first obtaininG a boat slip rental permit from the City." ~ Section 702.401 - Activities permitted after closing, should be amended to include overniaht moorinG of boats in City-owned slip with reauired City permit. ~ Section 702.1002 - Permits required, should be amended to include "MoorinG a boat in a City-owned slip after park hours. " The City Council should determine if the policy and ordinance revisions are appropriate. If the City Council adopts the policy and ordinance amendments, overnight boat rental reservations could be advertised and implemented beginning in May 2007. FINANCIAL IMPACT: The City Council has previously approved the construction and installation of the boat slips for Sand Point Beach. The largest financial impact in implementing this program will be costs to purchase, install and maintain docks, and staff time for administration, on-going maintenance, and enforcement. The rental fees are calculated to cover these costs. As the program is implemented and becomes successful, it will be necessary to further evaluate the total costs for the program, and make fee, policy and ordinance adjustments as appropriate. ALTERNATIVES: This report has two action items -- 1. Motion and second adopting the policy for overnight boat slip rental as proposed; 2. Motion and second adopting the policy for overnight boat slip rental with amendments; 3. Motion and second adopting Ordinance 107-XX amending section 702 of the City Code to permit overnight boat slip rental in Lakefront and Sand Point parks; 4. Table this item and provide staff with additional direction. RECOMMENDED MOTION: Alternative (1) and Alternative (3). 4646 Dakota Street S.E. Prior Lake, MN 55372-1714 POLICY FOR OVERNIGHT BOAT SLIP RENTALS Locations and Slip Assignments Overnight boat slip rentals are available at Watzl's Beach in Lakefront Park; and at Sand Point Beach in Lions Sand Point Park. The following slip assignments apply to docks in both of the above locations: Slip #1 - Reserved for law enforcement Slips #2-#9- Available on a first come/first served basis. No reservation required. Slips may not be held when unoccupied. Vacated slips are considered surrendered to the next user. Slips #10-#18- Overnight rental slips. Advanced reservations required. Slips not reserved in advance become available on a first come/first served basis General Rules Hours of Operation: Water Activities: Access to all slips is available from Sam to 10pm daily. Overnight mooring in City-owned slips is allowed by permit with advance reservation. No activity other than mooring of a boat in an overnight slip is permitted outside of normal park hours. No fishing, water skiing, inner tube usage, diving or swimming from City-owned docks. No beaching watercraft between the docks and the swimming beach is permitted. NO BOAT LAUNCH OR VEHICLE WITH TRAilER PARKING AVAILABLE. Rental Period & Rates Rental Period shall consist of: "Weekend Rentals" (noon Friday - 10am Monday) "Weekday Rentals" (noon Monday - 10am Friday) For the purposes of overnight boat slip rental, the summer boating season shall be considered May 1st- October 31 st. Reservations for the upcoming boating season only will begin after April 15th of each year. A maximum of two (2) weekend reservations, and two (2) weekday reservations per household per season. Only one (1) slip may be rented per household for any rental period. BLACKOUT DATES AT WATZL'S BEACH ONLY SHALL INCLUDE 4TH OF JULY, FIRST WEEK IN AUGUST FOR LAKEFRONT DAYS. Rental Rates shall consist of: Weekend Rental (Fri -Sun): Weekday Rental (Mon-Thur): Residents = $75 Non-Resident = $105 Residents = $60 Non-Resident = $80 www.cityofpriorlake.com Phone 952.447.9800 / Fax 952.447.4245 Rental fees cover the costs for staff time for administration of the reservation process, capital costs for installation, maintenance, and repair of the docks, staff time for additional clean up at the beaches, and enforcement of park and policy rules) Parkino One (1) reserved vehicle (without trailer) parking space will be provided in the upper lot at Lakefront Park for all overnight slip rentals at Watzl's Beach. No parking is provided for overnight rentals at Sand Point Beach. Vehicles may not be parked overnight and must be removed from any park by 1Opm. Reservation Reauirements & Procedures All reservations will be issued by the City of Prior Lake Recreation Department, 4646 Dakota Street SE, Prior Lake, MN. Office hours are 8am - 4:30pm, Monday through Friday. Reservations must be completed at least one week in advance of the reservation date. No reservations are held without completed reservation form, rental fee, signed liability waiver, and proof of residence. Reserved slips will be posted as such by the City. Renter must present and post reservation confirmation at the slip on the first day of rental period. REFUNDS will be issued for cancellations made seven (7) or more days in advance of the first day of the rental period. NO REFUNDS will be given if cancelled less than seven (7) days in advance or due to inclement weather. Written confirmation of all reservations identifying the slip assignment will be provided to renter in advance of the rental period. Renter is required to post confirmation at the slip. Violations Any violation of the City Code Section 702 dealing with the usage and rental of City-owned boat slips or conduct within City parks, is considered a violation of City Code and subject to a fine of up to $1,000, cancellation of an existing reservation, prohibition from future rental, or any combination thereof at the City's sole discretion. 4646 Dakota Street S.E. MN 55372 CITY OF PRIOR LAKE ORDINANCE NO. 107-XX AN ORDINANCE AMENDING SECTION 702 OF PRIOR LAKE CITY CODE TO ALLOW FOR OVERNIGHT BOAT SLIP RENTAL IN LAKEFRONT AND SAND POINT PARKS The City Council of the City of Prior Lake hereby ordains: SECTION 702 of the Prior Lake City Code is hereby amended as follows: 702.401 Activities Permitted After Closina. The following activities may continue in parks before or after the parks normal closing hours: ~ City-sponsored and supervised activities which, because of the nature of the activity, cannot be held during the time when the parks are open. ~ Activities conducted pursuant to a Parks and Recreation Department permit issued under subsection 702.1000. ~ From November 15th to March 15th, during the hours of 10:00 p.m. and 5:00 a.m., individuals may drive on designated and posted roadways within a park facility for the sole purpose of gaining access to a lake for snowmobiling or ice fishing. ~ City employees, equipment or agents conducting maintenance, construction or repair work on the property or buildings. ~ Overnight mooring of boats in City-owned sliDS with reauired Citv Dermit. 702.600 (5) Boatina. It shall be unlawful for any park visitor to: ~ Launch or land any boat, yacht, canoe, raft or other watercraft upon any water, lagoon, lake, pond or wetland within a park except at locations and times designated for that purpose unless sponsored by the City. ~ Operate any watercraft in a designated swimming area or other prohibited area. ~ Operate any watercraft in a park in violation of Minnesota Statutes, Chapter 361 'Waters and Watercraft Safety." ~ Moor a boat in a City slip or on park shoreline before or after the hours the park is open. unless first obtaining a boat SliD rental Dermit from the Citv. ~ Moor a boat at any time in a slip reserved exclusively for lake enforcement personnel. ~ Moor a boat without first obtaining a permit therefore from the City if designated !! a "reserved" feAtal--slip. ~ Fish, water ski, innertube, swim or dive from, or within 50 feet of a City-owned dock. www.cityofpriorlake.com Phone 952.447.4230 / Fax 952.447.4245 ~ Beach any watercraft OOat-at Lakefront Park between the dock and swimming area at any time. ~ Obstruct or interfere with another who is using the City-owned dock in accordance with this ordinance and City policies. ~ Obstruct or fail to follow the direction of a City employee or agent in the administration of City-owned boat slips in accordance with this section and City policies. A permit shall be obtained from the City before participating in any of the following activities in a City park: ~ Carnivals, Community Celebrations, public meetings, assemblies, entertainments, parades or demonstrations regardless of the number. ~ Gathering of 25 or more park visitors, including picnics or political gatherings. ~ Contests and Exhibitions, including among other things those requesting exclusive use or charging admission, regardless of the number. ~ Bringing kegs or barrels of intoxicating liquors or nonintoxicating malt liquors or wine into a park. ~ Bringing intoxicating liquor other than beer into a park. ~ Usina or Beina in To be in or use a park during closed hours. (amd. Ord. 99-09- pub. Bn/99). ~ Moorina a boat in a City-owned sliD after Dark hours. This ordinance shall become effective upon passage and publication.
