Prject MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: May 7, 2007 8B LARRY POPPLER, ASSISTANT CITY ENGINEER PUBLIC HEARING TO CONSIDER APPROVAL OF A RESOLUTION ORDERING THE IDA CIRCLE AND TRUNK HIGHWAY 13 IMPROVEMENT PROJECT AND PREPARATION OF PLANS AND SPECIFICATIONS Introduction The purpose of this agenda item is to hold a Public Hearing for the Ida Circle and Trunk Highway 13 Improvement Project and authorize the preparation of plans and specifications. Since this project is being initiated by the Council process, statute requires a 4/5ths vote. Historv Ida Circle was annexed into the City of Prior Lake in 2004 as part of the Orderly Annexation Agreement. On September 30, 2005, a petition containing seven of nine households on Ida Circle was received by the City. The petition specifically requests the City for sanitary sewer and watermain for properties on Ida Circle. Properties on TH 13 were not part of the petition. The area proposed for improvement is located in the southwest corner of the City of Prior Lake south of the intersection of County Road 12 and Trunk Highway 13. A map of the project area is shown on Exhibit 1 of the Feasibility Report. The proposed project includes street reconstruction, storm sewer, concrete curb and gutter, and appurtenant work. Sanitary sewer and water service for the project area became available with the development of property east of Ida Circle. The development (known as Hickory Shores) provided sanitary sewer, watermain, and storm sewer stubs to Ida Circle as part of the PUD (Planned Unit Development) process. Also included with the work was the closure of the Ida Circle access from TH 13. At the January 3, 2006, City Council meeting, Council adopted Resolution No. 06-06 authorizing staff to prepare a Feasibility Report for the Ida Circle and Trunk Highway 13 Improvement Project. On April 2, 2007, the City Council accepted the Feasibility Report and scheduled the Public Hearing. Current Circumstances The purpose of the Public Hearing is to determine if the project should move forward to the next step in the process. The Public Hearing will cover the extension of sanitary sewer and watermain and the reconstruction of Ida Circle as well as extending sanitary sewer and watermain to the 4 parcels south of Ida Circle. Details of the project and the proposed financing were part of the Feasibility Report presented to the City Council on April 2, 2007. www.cityofpriorlake.com Phone 952.447.9800 / Fax 952.447.4245 ISSUES: An informational meeting was held on March 14, 2007, to gauge support for the project due to the assessment rate. The proposed improvements, project schedule and assessments were presented to the attending property owners. Eight properties were represented at the meeting. Of the eight, five were in favor of the project moving forward. If the City Council approves the resolution ordering the project, City Staff will promptly begin surveying and design of the project. Properties South of Ida Circle The three properties that were not in favor of the project moving forward at the informational meeting are properties that are located off of Trunk Highway 13. These properties were not part of the original petition. Property owners from this area may speak in opposition of their inclusion in the project at tonight's Public Hearing. Staff believes that the inclusion of these properties with the Ida Circle project is prudent and necessary. The close proximity of these four properties make their inclusion logical as they are part of the contiguous neighborhood. A larger project may benefit both Ida Circle and the Trunk Highway 13 properties by lowering unit costs for the improvements. The houses located on these four properties are of similar age to those on Ida Circle and are dealing with similar septic system issues. This is the best opportunity to extend the utilities to these parcels. The City Council should give guidance on the inclusion of these four properties based on the information presented by City Staff and input received at the Public Hearing. The assessment amounts are similar whether they are included as a part of the project or not however as indicated earlier, the unit pricing may be lower if these properties are included as a part of the project. Assessment Review Committee The Assessment Review Committee met on March 5, 2007, at which time the following issues were discussed and recommendations made: S~eetRecons~ucuon The Assessment Review Committee recommends assessing 100% for all costs associated with the roadway improvements. Even though Ida Circle has a paved surface, it was determined that the road work is now required due to the placement of sanitary sewer and watermain and therefore should be assessed to the benefiting properties. Assessment Method The Assessment Review Committee recommends the unit method of assessment for Ida Circle due to the fact that the lots in the project area are of similar size and/or value. The estimated assessment rate is proposed at $31,665/unit. The assessment rate does not include connection charges of approximately $4,605/unit. This charge will be due when each property connects onto the City's system. The costs outlined do not include the costs to bring the utilities from the property line to the home. The following table shows the estimated assessment and breakdown of the connection charges. The City does not have $500,000 available in bonding capacity this year. . Bidding the project this Fall for Spring construction will allow for the most competitive prices next Spring. Bidding the project this year for late Fall construction could result in less favorable bid prices due to the tight time frame to complete the work. · The four (4) properties not included in the original petition would have additional time to budget for the proposed project FINANCIAL IMPACT: The property owners are proposed to be assessed 100% for all cost associated with the proposed improvements. The City will use the Trunk Sewer and Water Fund to fund oversizing of the watermain on TH 13. Funding sources and amounts are as shown below: Assessments $411,645.00 Trunk Sewer & Water Fund $40,650.00 Total City Cost $452,295.00 The chart shows the breakdown for the City's portion of the project cost. The overall project cost is $452,295.00. The final costs for the assessment will not be known until bids are received for the work. Once the bids are received, the City Council should hold the Assessment Hearing prior to the award of the project. As part of the Orderly Annexation Agreement, septic system credits will be given for systems less than 20 years of age. The project assessment will be reduced for any properties with septic systems that meet the requirements outlined in the agreement. The amount of the credit is dependent on the age and compliancy of the system. Funds for this credit would come from the project levy. It is worth noting that the majority of the systems within the project area are over 20 years of age. ALTERNATIVES: The alternatives are as follows: 1. Conduct the Public Hearing and approve Resolution 07-XX ordering the Ida Circle and Trunk Highway 13 Improvement Project and preparation of plans and specifications. 2. Table the Resolution for a specific reason. 3. Deny the Resolution. RECOMMENDED Alternative #1 MOTION: ReViewe1J ORDERING IMPROVEMENTS AND PREPARATION OF PLANS AND SPECIFICATIONS FOR THE IDA CIRCLE AND TRUNK HIGHWAY 13 IMPROVEMENT PROJECT WHEREAS, WHEREAS, WHEREAS, WHEREAS, Motion By: Second By: The Prior Lake City Council has received a petition for these improvements and on its own initiative has determined that it desires to complete the Ida Circle and Trunk Highway 13 Project; and On April 2ND, 2007, the City Council adopted Resolution 07-058 accepting the Feasibility Report and calling for a Public Hearing to be held on the Ida Circle and Trunk Highway 13 Improvement Project which includes improvements to the sanitary sewer, water main, storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, and appurtenant work; and The required mailed notice and published notice of the hearing was given and the hearing was held on the ih of May, 2007 at which time all persons desiring to be heard were given an opportunity to be heard thereon; and Since the project is initiated by the City Council it must be approved by 4/5ths vote in accordance with Minnesota State Statutes 429.031 Subdivision 1 (f). NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Engineer is hereby authorized to prepare plans and specifications for the improvements delineated in City Council Resolution 07-058 adopted April 2nd, 2007, and by the required statutory 4/5ths vote does hereby order the project. 3. The City Engineer is hereby designated as the Engineer for these improvements. The Engineer shall prepare plans and specifications for making such improvements.
