CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING EXECUTION OF
EASEMENT AGREEMENTS FOR 1) CR21 TRAIL RELOCATION AND 2) 150TH
STREET EASEMENT ACCESS
Introduction
The purpose of this agenda item is for the City Council to authorize the Mayor and
City Manager to execute easement agreements for the CR 21 Project Trail
Reconstruction and Access to the 150th Street Lift Station Easement.
History
CR 21 Trail
As part of the Wilderness Ponds Development in 1996 a trail was constructed
connecting CR 21 with Blind Lake Trail. A trail easement was granted to the City
along the rear yards of the lots in Wilderness Ponds 2nd Addition. In order to
provide a safe connection to the new CR 21 the trail must be raised and relocated
to the west in some areas. The new trail requires temporary construction access
and a permanent easement.
The City Council has previously approved the construction plans for this project on
March 19, 2007.
1sdh Street Lift Station
The City owns and operates the 150th Street lift station. This lift station serves
approximately eight homes. The City is currently engaged in litigation to remove
impediments from the existing City easement needed to service this lift station.
In order to provide accessibility long term to the existing easement without moving
the lift station control panel an ingress/egress easement across the property
located at 5788 150th St. SE is required.
Current Circumstances
CR 21 Trail
City staff has met several times with the property owners and agreed on terms of
easement acquisition. Because the County has already purchased easements
and had the values appraised for this property the square foot values had already
been preset. Based on the County's Appraisal and easement purchase proposal
the following costs were established:

Staff has negotiated the following proposed compensation:

1SrJh Street Lift Station
Currently the City does not have access to a portion of the maintenance
easement. City Staff has met with the property owners several times to discuss
access across their property. For this reason staff recommends obtaining an
easement from the property owners at 5788 150th St. SE to ensure permanent
access to the lift station.
The approximate proposed easement area is 450 sf. Based on current projects in
the City this easement would have an estimated value of $1,500.00. Staff has
proposed to relocate an existing street light, provide 75 c.y. of fill and remove 7
box-elder trees from City right-of-way. The total value of the proposed City
services is estimated to be $1,000.00. The property owner concurs with this
proposal.
CR 21 Trail
If the City does not acquire the required easement reconstruction of the existing
trail will be expensive and may not be feasible. Additionally the delay in acquiring
an easement could result in delays to the overall project.
The proposed compensation rate has been set by County appraisals and ongoing
transactions which limited the City's ability to negotiate. Staff feels the proposed
settlement is equitable.

This easement is needed for maintenance regardless of the outcome of the
current litigation and the proposed agreement is very equitable for the City.
FINANCIAL CR 21 Trail
IMPACT: The $2,327 reimbursement and $1,600 for tree purchase and installation will be
drawn from the Capital Parks Fund.

The $500.00 for street light relocation shall be drawn from the Utility Fund. The
Parks Department will remove the existing trees as part of normal boulevard
trimming and the Streets Department will haul the required fill.

ALTERNATIVES: The alternatives are as follows:
1. Approve a resolution authorizing the Mayor and City Manager to execute the
easement agreements for the CR 21 Trail and 150th Street Lift Station.
2. Deny this item for a specific reason and provide Staff with direction.
3. Table this item until some date in the future.

CR 21 between Franklin Trail and Adelmann Street; and
WHEREAS, The reconstruction requires the trail located at 16740 Windsor Lane SE to be
reconstructed; and
WHEREAS, City Staff has negotiated with the owners of the property located at 16740 Windsor
Lane SE an easement agreement with the following values based on appraisals

NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. Staff is authorized to furnish and install 8 trees for a not to exceed cost of $1,600 and make
reimbursement in the amount of $2,327 to the owners of 16740 Windsor Lane SE for easement
considerations.
3. All funding shall be drawn from the Capital Parks Fund.

A RESOLUTION AUTHORIZING EXECUTION OF AN EASEMENT AGREEMENT FOR 150th STREET
LIFTS STATION
WHEREAS
Motion By: Second By:
The City currently operates a lift station on 150th Street located between 5780 and 5788
150th Street; and
WHEREAS,
The City would need to move the existing lift station panel to access the easement; and
WHEREAS,
The City currently accesses the lift station and easement utilizing the driveway at 5788
150th Street based on verbal approval from the owner; and
WHEREAS,
It is in the best interest of the City to obtain a permanent ingress/egress easement from
the owners of 5788 150th Street for access to the City's existing drainage and utility
easement; and
WHEREAS,
The estimated value of the 450 sf easement is $1,500. Staff has negotiated an
easement with the owners of the property located at 5788 150th Street with the
following terms;
1) City remove 7 existing box-elder trees from the right of way in front of
Dennehy residence. Estimated Value $ 200.00 (City labor & equipment)
2) City haul 75 c.y. of available fill for backslope along right-of-way at Dennehy
residence. Estimated value $300.00 (City labor and equipment)
3) City work with the MVEC to relocate existing street light at Dennehy driveway
20 feet to east. Estimated value $500.00 (actual MVEC cost)
4) The owners of the property located at 5788 150th Street grant the City a
permanent ingress/egress easement for access to the existing drainage and
utility easement.

WHEREAS, The total value of the proposed compensation is $1,000 which is less than the
estimated value of the easement.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. Staff is authorized to remove the 8 trees and haul 75 cy of fill to 5788 150th Street.
3. Funding not to exceed $500 shall be drawn from the Utility Fund for reimbursement to MVEC for
street light relocation.

4. The Mayor and City Manager are authorized to execute the easement with the owners of 5788 150th
