PLANS AND APPROVAL OF RESOLUTIONS 90-32 AND
90-33

The purpose of this Agenda item is to approve
the plans and specifications for Project
#89-01A and authorize the advertisement of
bids.
The sidewalk plans were separated from the
T.H. 13 Fish Point Road intersection
improvement due to a need for a variance to
utilize MSA Funds to construct the sidewalk.
The Variance Committee approved the request on
June 28, 1990. As a condition of a~proval,
the City must pass a resolution hold1ng the
State of Minnesota harmless from claims
resulting from the construction of the
sidewalk. This requirement is a standard
condition for all variance requests. Fish
Point Road, by today's standards, meets the 28
miles per hour design instead of 30 miles per
hour. To provide a 30 mile per hour
design, Fish Point Road from Huron Street to
T.H. 13 would have to be reconstructed. This
section of roadway is in good structural
condition and the expenditure to reconstruct
Fish Point Road is not warranted to increase
the design speed from 28 to 30 miles per hour.
The deficiency can be addressed with pro~er
Fish Point Road signing. A copy of Resolut1on
90-33 is attached. The City Attorney has
reviewed and approved the Hold Harmless
Resolution.
The plans and specifications for the Fish
Point Road sidewalk improvements are available
at the Public Works office for review and
comment. The plans can be revised to reflect
comments received.
An appropriate bid opening date for Project
#89-01A would be 10:00 A.M., AU9ust 13, 1990.
The specified completion date 1S October 1,
1990.

The recommendation is to approve, as part of
the Consent Agenda, Resolutions 90-32 and
90-33 holding the state of Minnesota harmless,
approving plans and specifications, and
ordering a bid opening date.
The alternatives are as follows:
1. Approve Staff's resolution.
2. Remove this item from the Consent Agenda
for discussion.
3. Table this item for a specific reason.
The project will be funded through MSA Funds.

RESOLUTION HOLDING HARMLESS THE STATE OF MINNESOTA FROM ACTION
THAT MAY ARISE FROM THE CONSTRUCTION OF SIDEWALK ALONG MSAS
201-105-04 (FISH POINT ROAD) FROM HURON STREET TO GLORY CIRCLE AT
LESS THAN MUNICIPAL STATE AID STANDARDS.

WHEREAS, the City Engineer of the city of Prior Lake (City) has
requested a variance from Minnesota Rule 8820.99l2 for
the construction of sidewalk along Fish Point Road from
Huron Street to Glory Circle in accordance with
Resolution 90-25 adopted by the Prior Lake City Council
on June 4, 1990; and
WHEREAS, the Commissioner of Transportation did grant said
variance with the condition that the City adopt a
Resolution indemnifying and holding harmless the State
of Minnesota from any liability or action which might
arise as a result of the grant of said variance:
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
PRIOR LAKE, MINNESOTA, that:
The City does hereby indemnify, save, and hold harmless the
State of Minnesota and all its agents and employees of and
from any and all claims, demands, actions, or causes of
action of any nature or character arising out of or by reason
of, in any manner, the construction of sidewalk along MSAS
105 (Fish Point Road) from Huron Street to Glory Circle in
any manner other than as in accordance with Minnesota Rules
8820.99l2 and further agrees to defend at its sole cost and
expense any action or proceeding commenced for the purpose of
asserting any claim of whatsoever character arising as a
result of the grant of said variance.

RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING
ADVERTISEMENT FOR BIDS ON FISH POINT ROAD/SIDEWALK (PROJECT
89-0lA)

WHEREAS, the Cit~ Council directed Toltz, King, Duvall, Anderson,
& Assoc1ates, Inc. on April 13, 1989 to prepare plans
and specifications for the improvement of the Fish
Point RoadjT.H. 13 intersection improvements by the
installation of bituminous surfacing, concrete curb and
gutter, storm sewer, sidewalk, and appurtenant work; and
has presented such plans and specifications to the
Council for approval.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
PRIOR LAKE, MINNESOTA, that

they will be publicly opened in the Council Chambers of
the City Hall by the City Engineer.
No bids will be considered unless sealed and filed with
the City Manager and accompanied br a cash deposit,
cashier's check, bid bond, or certif1ed check payable to
the City of Prior Lake for 5 per cent of the amount of
such bid.
3. The City reserves the right to reject any and all bids
for any reason as determined solely by the City.
