CONTINUE PUBLIC HEARING VACATION OF SOUTH ANNA
LANE, (TOWER STREET) RESOLUTION 90-27
JULY 16, 1990
This item is a continuation of a public
hearing which was initiated June 4, 1990. The
purpose of this public hearing is to consider
the vacation of part of South Anna Lane, now
known as Tower Street.
The vacation of part of Tower Street is a
necessary ste~ in the development process
proposed by En1vid, to locate a grocerr market
south of priordale Mall. A public hear1ng is
scheduled prior to this vacation public
hearing, to consider the subdivision of Enivid
First Addition. The subdivision is a replat
of parts of Brooksville Center lst and 2nd
Additions. The plat will dedicate Tower
Street in a different alignment that has been
designed to accommodate a "ring road" south of
the Priordale Mall district.
Staff has reviewed the vacation application
and contacted private utility companies to
determine the effect of the vacation on
uti1itr lines. Staff has received no
object10ns to the proposed vacation of South
Anna Lane. Scott Rice Telephone has indicated
that there is telephone cable adjacent to the
north line of Tower Street. In addition, the
Engineering De~artment has indicated that
there are munic1pal utility lines within the
vacation site. However, the necessary
easements will be dedicated in the plat of
Enivid First Addition to protect the utility
interests of the City and Scott Rice
Telephone.

RESOLUTION PROVIDING FOR THE VACATION OF SOUTH ANNA LANE
LOCATED WITHIN THE PLAT OF BROOKSVILLE CENTER 1ST ADDITION
MOTION BY SECONDED BY
WHEREAS, a petition for Road vacation has been duly presented to
the City of Prior Lake, signed by a majority of the
owners of the ~roperty abutting the following described
Road situated 1n the City of Prior Lake, Scott County,
Minnesota to wit:
DESCRIPTION:
That part of South Anna Lane, now known as Tower Street
as dedicated in the plat of BROOKSVILLE CENTER 1ST
ADDITION, according to the recorded plat thereof, that
lies easterly of the southwesterly extension of the
westerly line of Lot 2, Block l, BROOKSVILLE CENTER 2ND
ADDITION and which lies westerly of the northerly
extension of the west line of the East 300 feet of Lot
l, Block 3, BROOKSVILLE CENTER 1ST ADDITION.
WHEREAS, notice of the hearing on said petition has
published and posted in accordance with the
Minnesota Statutes; and

WHEREAS, a public hearing was held on said petition on Monday,
June 4, 1990 at 8:15 p.m. in the Prior Lake City Council
Chambers; and
WHEREAS, the City Council then proceeded to hear all persons
interested in said petition and persons interested
afforded the opportunity to present their views and
objections to the granting of said petition; and
WHEREAS, the City Council of Prior Lake has determined that the
vacation of said Road would be in the public interest.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
PRIOR LAKE, that pursuant to Minnesota Statutes 4l2.85l,
the above described Road situated in the City of Prior
Lake, Scott County, Minnesota is hereby vacated.

You are herebr notified that a Public Hearing will be held by the
City Council 1n the Prior lake City Council Chambers at 4629
Dakota Street S.E. on Monday, June 4, 1990 at 8:15 p.m.
