ANDERSON, DIRECTOR OF PUBLIC WORKS CONSIDER APPROVAL OF RESOLUTIONS 90-45 AND 90-46 ESTABLISHING PUBLIC HEARING DATE AND DECLARING COSTS TO BE ASSESSED FOR PROJECT 90-13 NORTH SHORE OAKS AUGUST 20, 1990 The purpose of this Agenda item is to declare the cost to be assessed, order the preparation of a proposed assessment roll, and to establish a date for the Assessment Hearing for Project 90-13, North Shore Oaks. CECA Utilities, Inc. was awarded the contract for the project on AU9ust 6, 1990. The bid received from CECA Ut1lities, Inc. was below the Engineer's Estimate which was utilized for the Public Hearing. The next step in the public improvement process is to conduct the Public Hearing for the proposed assessment. The project was initiated under the current assessment policy. The sanitary sewer and water lines through the park will serve areas adjacent to this project. In addition, the sanitary sewer was installed deeper in this project to serve future areas. A portion of the cost of the line through the park and the extra depth cost is to be paid throu9h the Trunk Reserve Fund. The amount to be pa1d from the Trunk Reserve Fund is $35,346.27. The proiect will be assessed prior to substant1al completion of the project. This is due to the late initiation of the project, and the need to have the Assessment Hearing in September to be able to certify the assessments to the County in October. A preliminary role indicates that the assessments will be 5% less than the amounts given at the Public Hearing for the proiect. Once the Public Hearing is scheduled, 1ndividual mailings to the property owners will be made notifying them of the Assessment Hearing date and the dollar amount of the individual assessments. The Assessment Hearing is proposed to be scheduled for September 17, 1990 at 8:30 P.M. Passage of Resolutions 90-45 and 90-46 will declare the cost to be assessed, order the preparation of a proposed assessment role and establish the date for the Assessment Hearing. The alternatives are as follows: 1. Approve Resolutions 90-45 and 90-46. 2. Table approval of Resolutions 90-45 and 90-46. 3. Deny approval of the resolutions. RECOMMENDATION: The recommendation is Resolutions 90-45 and 90-46. to approve FINANCIAL IMPACT: The project will be paid through Special Assessments and the Trunk Reserve Fund. ACTION REQUIRED: Make a motion, as ~art of the Consent Agenda, to approve Resolut1ons 90-45 and 90-46. HERITAGE 1891 COMMUNITY 1991 18J:5r)j( 2((91 RESOLUTION 90-45 RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT FOR Project 90-13 North Shore Oaks 2nd & 3rd Additions MOTION BY SECONDED BY WHEREAS, a contract has been let (costs have been determined) for the improvements of Project 90-13 and the contract (bid) price for such improvements is $334,866.95, and the expenses incurred or to be incurred in the making of such improvement amount to $83,726.74, so that the total cost of the improvement will be $418,593.69, NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. The portion of the cost of such improvement to be paid by the city is hereby declared to be $35(346.27 and the portion of the cost to be assessed against benef1ted property owners is declared to be $383,247.42. 2. Assessments shall be payable on an equal princi~al installment method extending over a period of 10 years for pav1ng and 20 years for sewer and water improvements. The first installment shall be the annual principal plus interest calculated from the public hearing date to the end of this year plus the twelve months of the next year and shall bear interest at the rate of 8 per cent per annum from the date of the adoption of the assessment resolution. 3. The City Manager, with the assistance of the Cit~ Engineer shall forthwith calculate the proper amount to be spec1ally assessed for such im~rovement against every assessable lot, piece or parcel of land w1thin the district affected, without regard to cash valuation, as provided b~ law, and he shall file a copy of such proposed assessment in h1s office for public inspection. 4. The City Manager shall upon the completion of such proposed assessment, notify the Council thereof. Passed and adopted this 20th day of YES Auqust , 1990. (612) 447-4230 / Fax (612) 447-4245 HER/TAGE /89/ COMMUNITY 1991 CU7J:CX).A/~ 2((91 RESOLUTION 90-46 RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT FOR Project 90-13 North Shore Oaks 2nd & 3rd Improvements MOTION BY SECONDED BY WHEREAS, by a resolution passed by the Council on Auqust 20 , 1990, the City Manager was directed to prepare a proposed assessment of the cost of improvements for Project 90-13. AND WHEREAS, the City Manager has notified the Council that such proposed assessment has been completed and filed in his office for public inspection, NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE, MINNESOTA: 1. A hearing shall be held on the 17th day of September, in the City Hall at 8:30 p.m. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The City Manager is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and he shall state in the notice the total cost of the improvement. He shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Finance Director, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. He may, at any time thereafter, pay to the City Finance Director the entire amount of the assessment remaining unpaid, excepting the installment portion appearing upon the current year's property tax statement.
