CONSIDER OUTDOOR CONCERT PERMIT APPEAL OF GLENN
LUBBERS
SEPTEMBER 17, 1990
The Hollywood Inn in conjunction with T. J.
Hooligan'S are requesting the City to grant an
Outdoor Concert permit for Saturday, September
29, 1990, 8:00 P.M. - 12:30 A.M., that would
allow them to block Toronto Street between the
two establishments. This concert would be
considered the second and final concert for
both establishments in 1990. The band
scheduled to play is a local band "Solid
Gold".
Over the past few years in conjunction with
the Motor Head Madness festivals the Hollywood
Inn and T. J. Hooligan'S held joint Outdoor
Concerts that closed the street between the
two establishments. As a result of this
street closure, the City received several
complaints about the inconvenience of the
street being closed and the noise generated by
the concert. The City Staff took the position
that the street would not be closed again due
to area residents feelings. This year the
street was closed for a special benefit
concert with one objection (Prior Place).
This year's lack of area wide objections has
caused Hollywood Inn and T. J. Hooligan'S to
request an Outdoor Concert permit this fall.
In the past the City Staff has objected to the
closing of Toronto Street due to business and
residential complaints. Public safety and
City liability have not been an issue as there
is an alternate traffic route and a clause in
their insurance covering the City. Hollywood
Inn and T. J. Hooligan's have produced a list
of people that have no objection to the
Concert. However, one signature is lacking,
that of Glenn Lubbers, owner of the Prior
Place, who opposes the street closing.
Enclosed is a letter from Glenn Lubbers
seeking to speak to the Council on this
matter.

I am writing you 1n regard to the application for an
event that proposes to close Toronto Avenue in the
Priordale Mall.

Let me state for the record that I am not opposed to the staging
of an outdoor event by the applicants provided public streets are
not closed.
I am opposed to the closing of a public street for a privately
sponsored event when the applicants clearly have ample space
available to them for the proposed use without the closing and
interruption of normal access to my business on a Saturday
evening. Saturdays are historically the largest day of the week
for me business wise. To close a public street that is the main
access for most of my customers to my business for the benefit of
a private event puts me in an unfair competition for business.
A number of questions come to mind:
1. Why should the city set a precedent of closing public streets
for the benefit of private business?
2. What grounds will the city have for denying private citizens
or other business from closing a city street for any type of
activity in the future?
3. Would the city allow me to close Tower Street between Duluth
and Toronto for a dance when ample space is available adjacent to
my building?
4. Would the signers of the petition have signed if the proposed
event would have closed off an access to their business?
5. How can the city consider allowing the sale and consumption
of alcohol on a public street when its own liquor ordnance states
for sale on premises only?
6. Why should the city expose itself to the possible liability of
an alcohol related accident or injury occurring on city property
during a private for profit event?
In my opinion city streets should only be considered for closing
for truly public events sponsored by nonprofit organizations or
the city itself.
I would like an opportunity to discuss the issue with
a decision is made on the application.
