CONSIDER APPROVAL OF BOB ROBBS REGISTERED LAND
SURVEY (RLS)
NOVEMBER 5, 1990
The Planning Department received a Registered
Land Survey on October 18, 1990 from Bob Robbs
of 3304 Todd Road. Mr. Robbs is in the
process of registering his property via the
torrens system. The requested action is for
the Citr council to approve and accept the RLS
as subml.tted by Mr. Robbs.
Subdivision Ordinance Section 6-8-1 sets forth
local requirements related to RLS's. The
Section requires that all RLS's be presented
to the City council for approval. An RLS shows
only the existin9 property lines, easements
and other exist1ng features found on the
property. The reason that the Council reviews
RLS's is that the legal description of the
property will change from the lengthy metes
and bounds descrl.ption to a specific RLS
number. The RLS number will be assigned by
the Scott County Registrar of Titles when the
attached sheets have been approved and signed
by the appropriate parties. In addition, the
Parcel Identification Number or Tax Number
will change to reflect the abbreviated
description. An RLS is not a subdivision or
plat but rather, is a pictorial representation
of an existing legal description.
The Scott County Registrar of Titles has the
authority to require an RLS. Registered Land
Surveys are often required by the Registrar of
Titles in order to provide a means of
simplifying some of the lengthy complicated
descriptions found in many certificates of
title, and to prevent the compounding of even
more complicated descriptions. Some metes and
bounds descriptions are next to impossible to
trace because of the angles, curves, and other
obscure dimensions found in their
descriptions. In such cases it is better to
substitute a picture for the written
description and simply use a tract number in

place of the wordy description. There are no
dedications allowed in an RLS.
Mr. Robbs owns pro~erty north of the plat of
Prior Wood. ApproX1mate1y two years ago it was
determined that a survey error existed between
the metes and bounds lots which were
originally divided and the lot lines property
owners have followed to construct their homes.
The problem originated fears ago when a survey
error established lot ll.nes different than the
original metes and bounds descriptions. The
error was uncovered during title research for
a home sale within this neighborhood. The
method by which to correct the legal
descriptions includes the torrens system. Mr.
Robbs has been working toward this end for
approximately two years. staff believes that
future RLS's will be conducted for properties
adjacent to Mr. Robbs.
Action requested is for the city council to
approve, as part of the Consent Agenda, the
RLS submitted by Mr. Robbs for the property
located at 3304 Todd Road in Prior Lake.
