CONSIDER VACATION OF WATERFRONT ADJACENT TO
LOT 2, SUNSET SHORE
NOVEMBER 5, 1990
On October 16, 1990 the Planning Department
received an application from Gertrude Cameron
to consider the vacation of platted Waterfront
adjacent to Lot 2, Sunset Shore. Ms. Cameron
is represented by Attorney, Frank Muelken who
will be present at the Council Hearing for
this vacation petition.
The applicant is in the process of registering
property via the torrens system. The
waterfront was dedicated to the public in 1931
when Sunset Shore was originally platted. The
Waterfront is that land area that is located
between the westerly property line of Lot 2,
Sunset Shore and the waters edge of Spring
Lake. The City of Prior Lake has vacated
parts of the Waterfront in separate vacation
actions held in 1977, 1978 and 1984. See
attached map for Waterfront vacation
locations.
Staff has notified the DNR, private utility
companies and adjacent property owners of this
vacation request. The attached notice of
public hearing was published in the Prior Lake
American on October 22, and 29, 1990 as
required by M.S. 412.851. The Scott County
Recorder's Office does not anticipate any
problems with the filing of attached
Resolution 90-55 which calls for the vacation
of Waterfront adjacent to Lot 2, Sunset Shore.
There are no public or private utilities
within the proposed vacation site. Staff does
not anticipate that the Waterfront will be
needed for future public purposes.
As stated above, the applicant is in the
process of registerin~ propertr via the
torrens system. If it l.S the decl.sion of the
City council to vacate the Waterfront, the
applicant requests that the attached Agreement

be signed stating that the city has agreed to
the vacation as legal1f described. The
agreement, along with a sl.mi1ar agreement from
the owner of Lot 1, will be submitted to the
Scott County District Court by the applicant's
attorney. In addition to the agreement, staff
will provide the applicant with a certified
copy of attached Resolution 90-55 and the City
Council minutes which pertain to the vacation
public hearing. These forms are routinely
used in the process of registering property.

RESOLUTION PROVIDING FOR THE VACATION OF WATERFRONT
LOCATED WITHIN THE PLAT OF SUNSET SHORE
MOTION BY SECONDED BY
WHEREAS, a petition for Waterfront vacation has been duly
presented to the City of Prior Lake, signed by a
majority of the owners of the propertr abutting the
following described Waterfront situated 1n the City of
Prior Lake, Scott County, Minnesota to wit:
LEGAL DESCRIPTION:
That part of the Waterfront as shown on said plat
described as follows: Beginning at the southwest corner
of Lot 2, Sunset Shore, Scott County, Minnesota, thence
westerly along the westerly extension of the south line
of said Lot 2 to the shoreline of Spring Lake; thence
Northerly along said shoreline to its intersection with
the westerly extension of the northerly line of said Lot
2; thence easterly along said westerly extension to the
northwest corner of said Lot 2; thence south alon9 the
westerly line of said Lot 2 to the point of beginnl.ng.
WHEREAS, notice of the hearing on said petition has
published and posted in accordance with the
Minnesota Statutes; and
been duly
applicable
WHEREAS, a public hearing was held on said petition on Monday,
November 5, 1990 at 8:00 p.m. in the Prior Lake City
Council Chambers; and
WHEREAS, the City Council then proceeded to hear all persons
interested in said petition and persons interested
afforded the opportunity to present their views and
objections to the granting of said petition; and
WHEREAS, the City Council of Prior Lake has determined that the
vacation of said Waterfront would be in the public
interest.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
PRIOR LAKE, that pursuant to Minnesota Statutes 412.851,
the above described Waterfront situated in the city of
Prior Lake, Scott County, Minnesota is hereby vacated.

NOTICE OF PROPOSED WATERFRONT VACATION
You are hereby notified that a Public Hearing will be held by the
City Council in the Prior lake City Council Chambers at 4629
Dakota street S.E. on Monday, November 5, 1990 at 8:00 p.m.
The purpose of the hearing is to consider vacating the following
legally described Waterfront:
LEGAL DESCRIPTION:
That ~art of the Waterfront as shown on said plat
descr1bed as follows: Beginning at the southwest corner
of Lot 2, Sunset Shore, Scott County, Minnesota, thence
westerly along the westerly extension of the south line
of said Lot 2 to the shoreline of Spring Lake; thence
Northerly along said shoreline to its intersection with
the westerly extension of the northerly line of said Lot
2; thence easterly along said westerly extension to the
northwest corner of said Lot 2; thence south along the

Or more commonly described as the vacation of waterfront (beach
area) that was dedicated to the public in 1931 when Sunset Shore
was originally platted. The Waterfront is that area between the
westerly property line of Lot 2, Sunset Shore and the water's
edge of Spring Lake.
If you desire to be heard in reference to this vacation, you
should attend this hearin9' Oral and written comments will be
considered by the City Councl.1. Written objections or concerns
should be submitted to the Prior Lake Planning Department by no
later than 4:30 p.m. on Friday October 26, 1990. If you have
questions regarding this matter, contact the Planning Department
at 447-~30.
