AGENDA NUMBER: PREPARED BY: SUBJECT: DATE: INTRODUCTION: BACKGROUND: 7 LARRY ANDERSON, DIRECTOR OF PUBLIC WORKS CONDUCT PUBLIC HEARING ON IMPROVEMENT PROJECT 90-13, NORTH SHORE OAKS SEWER AND WATER PROJECT, AND CONSIDER RESOLUTION 90-22, ORDERING IMPROVEMENTS AND PREPARATION OF PLANS APRIL 16, 1990 The purpose of this Agenda item is to conduct a Public Hearing for Project 90-13 and to consider the adoption of Resolution 90-22. On March 19, 1990, the Council approved both the Feasibility Studr for the project and Resolution 90-18 call1ng for a Public Hearing on the improvement project. This project is for the installation of sanitarr sewer, watermain, storm sewer and street lmprovements in the North Shore Oaks area. The streets included in this project are: Ash Circle, Ferndale Avenue, and Hampton Street. This project has been initiated by a petition from residents on Ash Circle and Hampton Street requesting a Feasibility Study be prepared. A copy of the petition is attached. This petition was presented at the March 5, 1990 City Council Meeting and Council adopted Resolution 90-10 ordering the preparation of a Feasibility Study. Resolution 90-10 was published on March 12, 1990 in the Prior Lake American as required by statute whenever a project is initiated by petition. A thirty (30) dar appeal period begins upon the publicatlon date in which anyone can appeal the sufficiency of the petition. To date, no appeals of the petition have been received by the City Manager. The appeal period ends on April 11, 1990 and if no appeal is received by that date, the Council's determination that the petition is sufficient is final and conclusive. 4629 Dakota St. S.E., Prior Lake, Minnesota 55372 / Ph. (612) 447-4230 / Fax (612) 447-4245 DISCUSSION: Staff will make a brief presentation of the project scope and costs at the Council Meeting. The Council should receive and consider the impact from affected property owners of the proposed improvements. Based on the input received at the hearing and all other relevant factors, the Council can discuss if the project merits approval at this time. Resolution 90-22 is attached which orders the improvement and the preparation of plans. Approval of Resolution 90-22 is in order if the project is to proceed. Staff does not have sufficient manpower to do the North Shore Oaks project this year. Due to the time of the year, and the residents desire to have the project completed this year, it is necessary to commence with the project design as soon as possible. In order to expedite the process, Staff solicited proposals from five engineering firms and they were as follows: 1. Howard, Needles, Tammens, & Bergendoff 2. Rieke, Carrol, Muller Associates, Inc. 3. Toltz, King, Duvall, Anderson & Associates, Inc. 4. Valley Engineering Company, Inc. 5. Westwood Professional Services, Inc. Based upon their proposals and interviews, if the Public Hearing is approved, Staff recommends that Rieke, Carrol, Muller Associates, Inc. perform the engineering services for this project. The design fee for the project is $20,000.00. The construction phase would be billed on an hourly rate. It is not possible for Staff or the consulting engineer to determine the amount of hours required for the construction phase due to the variables in dealing with contractors. The interviews were conducted on Friday, April 6, 1990 with reference checks on Monday and TueSday, the 9th and 10th. Due to the timing of the process, the contract with RCM will be presented to the Council prior to the meeting. This contract would only be applicable if the project is approved. ALTERNATIVES: RECOMMENDATION: FINANCIAL IMPACT: ACTION REQUIRED: The alternatives are as follows: 1. Adopt Resolution 90-22 ordering the improvement and preparation of plans for Project 90-13. 2. Deny approval of Resolution 90-22 and abandon Project 90-13 at this time. 3. Table this item for a specific reason(s). Staff has no recommendation as to whether the project should be approved or not. Action on the resolution should be withheld until comments from the affected property owners have been received. If the project is approved, Staff recommends that ReM be retained for professional services. The cost of the project will through special assessments and Reserve Funds. be recovered Trunk System The action required will be to make a motion to approve or deny Resolution 90-22. Larry Anderson, Bruce Loney Thank you for this opportunity to comment on the proposed assessment for water/sewer on Ash Circle in North Shore Oaks. In September, 1989, our dreams came true to buy a home in Prior Lake. To protect our interests, we purchased Title Insurance and contracted the services of Orlins ~ Brainard (Attorneys at Law). We were with our Real Estate Agent when she contacted City H31l to investigate current and pending assessments. <This is the same procedure we followed to sell our first home.) We were NOT advised of the historical feasability studies and pending status of sewer/water. Our world and dreams were abruptly interrupted. Immediately after we purchased our home, the neighbors informed us of pendidng assessment proceedings. In early October, Ropbert's position with Control Data Corporation was eliminated with the divestment of the Imprimis Subsid- iary to Seagate Technology headquartered in another state; consequently we lost 1001. of our family income. Again our world and dreams were abruptly interrupted. In early November a medical problem culminated into a medical emergency requiring immed- iate hospitalization, a major surgery, and extended convalescence. Today, we are both employed in our professions with a combined income LESS than Roberts' Control Data income. Linda is Licensed with her Masters Degree in Special Education. Robert has a Business Degree and works for Seagate Technology. We are intelligent, responsible tax- payers who were never informed by all of our resources and contacts of the historical and current assessment activity. Approval of the assessment will have serious consequences on our family: FINANCIAL: The combination of buying our home, unemployment, and medical expenses have exhausted our financial resources. Our combined income today is a STRUGGLE to meet our obligations. We can NOT qualify for additional credit. EDUCATIONAL: We have identified and eliminated many unnecessary expenses in our home. Proposed assessment expenses will place us at a dis- advantage to support educational and extra-curricular activi- ties that are important to the development of our three young children. LIFESTYLE: Our lifestyle has ALREADY changed. Current expenditures do not allow the convenience of child care. Robert works full-time days. Linda works full-time evenings, Saturdays, and Sundays. EMOTIONAL: Obviously, we have endured EXTREME circumstances during our six month Prior Lake residency. Additional expenses will finan- cially devastate and ruin our family. The financial stress and demands of young children have stretched us to our limit. LONG-RANGE: Our goals for retirement investments and college investments are completely ON-HOLD. Assessment payments will proportion- ally reduce our ability to respond to necessary house repairs, medical bills, and emergencies. REQUEST: We request that you examine the impact on the entire neighbor- hood before you reach a decision. How many homes will be offered for SALE in response to monthly payments that are beyond the financial capabilities of each homeowner? How many homes may be foreclosed by mortgage companies? How many homeowners have "Little" or "No" Owners Equity to market their property if they can NOT afford assessment charges? What impact will the actual assessment have on our property values? What can we DO to avoid losing our home? What control do we have as citizens to protect ourself and our family members? WHY WERE WE NOT INFORMED OF THESE ASSESSEMENT ACTIVITIES WHEN WE CONTACTED CITY HALL? (This would have provided alternatives to make a decision.) However, I have given power of attorney to and will be represented by the firm of Huemoeller & Bates, who are authorized to speak and act on my behalf. It is a matter of record that only a minority of Ash Circle residents are in favor of this project. Like many others, I had no idea when I bought my property that I would be exposed to a ruinous assessment for improvements that I do not need or want. I will retire within two months. This property represents a considerable part of my retirement equity. If you proceed with this unwanted, unexpected proposal, you will be forcing me to assume a hugh debt, one that I cannot be expected to service as a retiree, and one that benefits others but does nothing for my property value. I join the others on Ash Circle who do not agree with this project in asking you to delay consideration of this project for two years. This is to your benefit as well as ours. It would allow you to proceed at a later date with a more favorable consensus and it would allow us options such as a decent amount of time to plan for paying the huge assessment or to sellout. Keith and I had just been married and my life of working sixteen hour days and weekends, just to keep Jeremy and myself off welfare, after his father left us, was over. He needed me then, but I had no choice but to work as much as I could to keep us going. Jeremy is noww17 and still lives some of what I could have prevented by being home more when he was small. Every time sewer and water comes up, some neighbors say why don:t you go to work like everyone else. You know you are a minority and you can't expect to have enough money if you don't both work. Enough money for what? A sewer and water system that we don't need because ours works fine?!! Living with poor people in apartments helped me realize alot about life. When we didn't get our paycheck, we'd pool together and make one supper so all the kids could eat. Are we not even willing to give a year or two on this sewer and water so some of our neighbors don't lose their homes or have to live so tight that the tension is almost breaking up the homes anyway? I now have Ryan, my three year old. My dream was to be home with him at least until school; when daycare doesn't eat up the paycheck and he will not miss me as much when I am at work. All I am trying to say in this letter is we've been against this from the beginning. If payments could wait a year or two) just to help those neighbors who are having big sewer problems, we are now even willing to go along with it. We do empathize with them! Please consider a compromise for all of our fellow neighbors who have almost $1000 house payments and very small children.
