ANDERSON, DIRECTOR OF PUBLIC WORKS CONSIDER APPROVAL OF TKDA CONTRACT MAY 7, 1990 Due to a change in design standards, the Fish Point Road/T.H. 13 Project has been split into two projects, necessitating a change in TKDA's contract. Fish Point Road was constructed in 1979. Since that time, MSA Standards have changed due to smaller cars. The design height of the driver's eye is now 0.25 feet lower than in 1979. This requires the curves to be slightly flatter. To obtain MSA Funding for the sidewalk portion of the project, a variance to the standards is required. variance approval is not expected to be a problem but may not be obtained until August. The Variance Committee meets approximately four (4) times per year depending upon the number of variance requests. The project cannot be approved by MnDOT until the variance is approved. Staff felt that the intersection improvements need to commence prior to August. Staff met with Chuck Weichselbaum from MnDOT to determine the most expeditious method to commence with the Fish Point Road/T.H. 13 improvements. The result of this meeting was to split the project into two (2) complete separate projects so that the intersection improvements could commence earlier. The other options were to delete the sidewalk completely or pay for the sidewalk w/o using MSA Funds. The sidewalk cost is approximately $60,000.00. On April 3, 1990, Staff directed TKDA to split the project into two (2) projects, and told TKDA that they would be compensated for their 4629 Dakota 51. 5.E., Prior Lake, Minnesota 55372 / Ph. (612) 447-4230 / Fax (612) 447-4245 efforts. The amount of compensation is $6,000.00 and Staff feels that it is a fair amount considering the extent of work involved. Staff knew at the commencement of this project that one of the curves was originally deficient (28 m.p.h. vs. 30 m.p.h.) and asked MnDOT if they could foresee any problems, and they did not. At that time, it was not known that the height of eye standard change had caused several curves to be deficient. This was determined during MnDOT plan review. By today's design standard, the curves are one to two miles per hour short of thirty miles per hour, which does not, in and of itself, warrant reconstruction of the road. DISCUSSION: MnDOT Plans and specifications review is nearly complete. Once complete, the Cooperative Agreement will be completed and submitted to the Council along with final plans for approval. At this point, Staff anticipates construction to commence in July. Staff has directed TKDA to split the project into two (2) projects to expedite the project. The project has been separated and resubmitted to MnDOT. Staff's decision to do this was based upon the need to have this project started earlier in the year versus September. The attached contract authorizes payment for the project being separated. The recommendation is to approve the TKDA contract. RECOMMENDATION: FINANCIAL IMPACT: The fees will be paid from the Construction Fund. MINNESOTA APRIL 18, 1990 SUPPLEMENTAL AGREEMENT NO.3 between THE CITY OF PRIOR LAKE, MINNESOTA and TOLTZ, KING, DUVALL, ANDERSON AND ASSOCIATES, INCORPORATED for T.H. 13 FROM CANDYCOVE~TOGREENOAKSTRML and FISH POINT ROAD (MSAS 105) FROM 450' WEST OFT.H. 13 TO GLORY CIRCLE CITY PROJECT 89-01 Date of Initial Agreement, October 17, 1988. This Supplemental Agreement No.3 entered into this day of , 19_ provides for a revision to the above-referenced agreement, all as hereinafter described, and unless otherwise provided herein, shall be subject to all of the contract covenants and stipulations. I. Purpose The purpose of this Supplemental Agreement is to (1) provide additional services, and (2) increase the amount of compensation to cover resulting costs. SA3-1 II. Additional Services Provide revised final plans for two separate construction projects which involve an increase in engineering services for work in Items IT B (2-5) of the initial agreement dated October J 7, 1988. The revised fmal plans are required because of the decision to separate the sidewalk construction from Glory Circle to Huron Street into a separate construction project. The addition will include the following: A. Revise Title Sheet and quantity sheets to remove sidewalk Construction. B. Prepare new Title Sheet and quantity sheets for sidewalk project. C. Remove plans and cross sections for sidewalk and renumber sheets. D. Prepare cost estimates for two projects. E. Prepare separate sets of specifications and bid documents for two projects. ID. Section III - Compensation Compensation for services provided under Subsection IIB - Plans shall be increased by $6,000, limited to a maximum payment of $54,000 unless adjusted pursuant to Article 4 of the Basic Agreement.
