HomeMy WebLinkAbout3C - North Shore Oaks Feasibility Study CONSENT AGENDA: PREPARED BY: SUBJECT: DATE: INTRODUCTION: BACKGROUND: CENSUS '90 . 3 (c) BRUCE LONEY, ASSISTANT CITY ENGINEER CONSIDER APPROVAL OF PETITION FOR NORTH SHORE OAKS AREA FEASIBILITY STUDY MARCH 5, 1990 A new petition has been received by the City from residents on Ash Circle and Hampton Street in the North Shore Oaks area for a Feasibility Report to be prepared on the installation of sanitary sewer, watermain, storm sewer, and bituminous surfacing improvements. The purpose of this Agenda item is for the Council to review this request and determine whether to order the preparation of a Feasibility Report for this improvement. On January 16, 1990, a petition from Ash Circle residents requesting a Feasibility Report for the installation of sanitary sewer, watermain, storm sewer, and street improvements was presented to the Council. This petition is enclosed in the Agenda packet as Attachment A. The City Council adopted Resolution No. 90-01 declaring the petition received to be adequate according to Minnesota Statutes and ordered the preparation of a Feasibility Report for this area. On January 26, 1990, Staff received a petition from residents on Hampton Street requesting a Feasibility Report on the installation of sanitary sewer, watermain, storm sewer, and street improvements. This petition is enclosed in the Agenda packet as Attachment B. This petition does have signatures representing five (5) lots out of a total of eleven (11) lots on Hampton Street which do not have sanitary sewer and watermain improvements. The assessable frontage of those five (5) lots is estimated to be 600 feet versus the total frontage of 1,199 feet. The percentage of frontage signing the petition is estimated to be 50% with 35% being the required percentage needed for a valid petition. (612) 447-4230 / Fax (612) 447-4245 On February 7, 1990, an Informational Meeting was held at City Hall with residents on Ash Circle, Hampton street, and 140th street. Staff prepared cost estimates for installing the sanitary sewer, watermain, and street improvements to each street separately, a combination of streets, or for the entire area. A total of twenty-seven (27) people attended this meeting. Another reason for the Informational Meeting was to explain all of the costs associated with a sewer, water, and paving project. Several meetings were held in 1987 on the subject of installing sewer, water, and paving to the North Shore Oaks area. From these meetings in 1987, the residents on Fisher Avenue elected to proceed with a sewer, water, and paving project known as Project No. 87-18. From 1987 to the present, a total of twelve (12) homes have changed ownership. Staff felt that a meeting should include residents from all streets in the area of North Shore Oaks so that the residents are aware of a potential project and its associated costs. A copy of the handouts at the informational meeting is enclosed in the Agenda packet as Attachment c. At the Informational Meeting, Staff explained that the City has received two (2) petitions, one from Ash Circle residents and the other from Hampton Street residents. Staff explained the 429 Process for local improvements and how the process would be less com~licated by proceeding with one petition hav1ng one project area. The general consensus of the attendees were in agreement with having one petition for the proposed project. A new petition was circulated to the residents on Hampton Street and Ash Circle and has been returned to the City. A copy of the petition is enclosed in the Agenda packet as Attachment D. This petition has signatures representing fourteen (14) lots requesting a Feasibility Report be prepared for improvements on Ash Circle, Hampton street, and Ferndale Avenue. The assessable frontage of those fourteen (14) lots is estimated to be 1,541 feet versus the total frontage of the proposed project area estimated to be 3,648 feet. The ~ercentage of frontage in favor of a Feasib1lity Report being prepared is 42%. At the informational meeting, most of the home owners on 140th street were present and verbally stated that they did not want to be included in a sewer and water project at this time. DISCUSSION: The previous petitions from Ash Circle and Hampton street had six and five lots, respectively, signing the petitions. The latest petition has seven lots from Ash Circle and seven lots from Hampton Street signing the petition and requesting a Feasibility Report. Since the informational meeting, an additional three lots on Hampton street and Ash Circle have signed a petition. The latest petition also includes improvements to Ferndale Avenue which affects the unplatted property abutting Ferndale Avenue. Previous petitions for Ash Circle and Hampton street had described the project area location on those streets only and did not include any improvements to Ferndale Avenue. In order to provide sewer, watermain and street improvements to Ash Circle and Hampton street, improvements to Ferndale Avenue will be required. Since this property will benefit for the improvements installed, the description on the latest petition includes the property abutting Ferndale Avenue and its frontage has been included in the total of real property being affected by the petition. Staff has reviewed the petition and feels an adequate petition has been received. Resolution #90-10 is enclosed which is for declaring the adequacy of petition and ordering preparation of a Feasibility Report. This resolution form is used when the proceedings are commenced by petition. The resolution should be published since the time for appeal from the Council's determination of sufficiency of the petition does not commence until the publication is made. Any person a~grieved by the determination may appeal w1thin 30 days after adoption and publication of the resolution. (M.S. 429.036). The notice of appeal is to be served to the City Manager who than notifies the district court of Scott County. The appeal shall be placed upon the calendar of the next general term commencing more than 30 days after the date of serving the notice and the filing of a $250 bond. Unless reversed upon the a~peal, the Council's determination that the pet1tion is sufficient is final and conclusive. RECOMMENDATIONS: ALTERNATIVES: ACTION REQUIRED: Previously Resolution 90-01 was adopted declaring the adequacy of a petition from Ash Circle residents and ordering preparation of Feasibility Re~ort. Resolution 90-10 will rescind Resolut~on 90-01 as Ash Circle is included in the new petition. An official Feasibility Report could be pre~ared shortly as Staff has done the cost est~mate work for this area. Staff recommends that a Feasibility Report be prepared and presented to Council at a future meeting. staff has conducted an informational meeting with the residents on Ash Circle and Hampton street and provided them the costs associated with this proposed project. These owners could then attend the future Council meeting and voice their concerns either for or against the project. Since this project is being initiated by residents, their input would be helpful. The alternatives are as follows: 1. Approve Resolution #90-10 adequacy of petition and preparation of the Feasibility Project #89-12. 2. RESOLUTION DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT MOTIONED BY SECONDED BY WHEREAS; 1. A certain petition requesting the improvement of Ash Circle between Ferndale Avenue to Ferndale Avenue, within the plat of the 3rd Addition to North Shore Oaks by the construction of watermain, sanitary sewer, storm sewer, concrete curb and gutter, bituminous surfacing, and appurtenant work has been filed with the Council on January 16, 1990 and Resolution #90-01 was adopted on January 16, 1990 declaring the adequacy of petition and ordering preparation of feasibility report in conformity to Minnesota Statutes, section 429.035. BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA; that 1. A certain petition requesting the improvement of Hampton Street from Ferndale Avenue to Fisher Avenue, Ash Circle within the Third Addition to North Shore Oaks, and Ferndale Avenue from the south plat line of the Third Addition to North Shore Oaks to the north plat line of the Second Addition to North Shore Oaks by the construction of sanitary sewer, watermain, storm sewer, concrete curb and gutter, bituminous surfacing, and appurtenant work filed with the Council on March 5, 1990, is hereby declared to be signed by the required percentage of owners of property affected thereby. This declarat10n is made in conformity to Minnesota Statutes, Section 429.035. 2.
