See attached petition, maps and Resolution 90-05 for reference. In October of 1989, staff investigated a complaint in the neighborhood of the ~roposed vacation site. At that time, 1t was discovered that a fence had been constructed within an alley dedicated to the public. The owner of the fence was contacted and advised that the fence had to be moved from the public alley to private property, or that the option was available to petition the city to vacate the alley. Several roads and part of the alley in Block 37 have been previously vacated with the exception of approximately 150' of the alley located adjacent to lots 4, 5, 6, 7, 8, and 9. All utility companies and the Department of Natural Resources have been contacted regarding the proposed vacation. There are no public or private utilities within the vacation site and staff does not anticipate the need to retain that part of the alley for future road or utility purposes. Staff forwarded a copy of this application to the Scott County Recorder's Office for review. The property located adjacent to the alley is torrens propertr, therefore the County Recorder cannot f1le Resolution 90-05. BE IT FURTHER RESOLVED that a copy of this Resolution will be forwarded to all affected property owners for their use to petition the court to expand their torrens certificates of title to include the land in the vacated alley. Or more commonly described as the vacation of a 16 x 150 foot strip of unimproved alley which is located near the rear property lines of 2865, 2875 and 2883 Center Road and 2840, 2850 and 2860 Spring Lake Road.
