VACATION IN BLOCK 37, SPRING LAKE TOWNSITE
MARCH 5, 1990
The Planning Department has received a
petition from six residents who own property
in Block 37, Spring Lake Townsite to vacate
approximately 150' of unimproved alley. See
attached petition, maps and Resolution 90-05
for reference.
In October of 1989, staff investigated a
complaint in the neighborhood of the ~roposed
vacation site. At that time, 1t was
discovered that a fence had been constructed
within an alley dedicated to the public. The
owner of the fence was contacted and advised
that the fence had to be moved from the public
alley to private property, or that the option
was available to petition the city to vacate
the alley.
Several roads and part of the alley in Block
37 have been previously vacated with the
exception of approximately 150' of the alley
located adjacent to lots 4, 5, 6, 7, 8, and 9.
All utility companies and the Department of
Natural Resources have been contacted
regarding the proposed vacation. There are no
public or private utilities within the
vacation site and staff does not anticipate
the need to retain that part of the alley for
future road or utility purposes.
Staff forwarded a copy of this application to
the Scott County Recorder's Office for review.
The property located adjacent to the alley is
torrens propertr, therefore the County
Recorder cannot f1le Resolution 90-05. Staff
will provide a copy of the resolution to each

RESOLUTION PROVIDING FOR THE VACATION OF PART OF THE ALLEY
LOCATED WITHIN THE PLAT OF SPRING LAKE TOWNSITE
MOTION BY SECONDED BY
WHEREAS, a petition for Alley vacation has been duly presented to
the City of Prior Lake, signed by a majority of the
owners of the property abutting the following described
Alley situated in the City of Prior Lake, Scott County,
Minnesota to wit:
DESCRIPTION:
That part of the Dedicated Alley in Block 37, SPRING
LAKE TOWNSITE, Scott County, Minnesota, described as
follows:
That part of the 16.00 foot Alley in Block 37, SPRING
LAKE TOWNSITE lying and being between the northeasterly
extension of the northerly lot line of Lot 7, Block 37
and the northeasterly extension of the southerly lot
line of Lot 9, Block 37, SPRING LAKE TOWNSITE, Scott
County, Minnesota.
WHEREAS, notice of the hearing on said petition has
published and posted in accordance with the
Minnesota Statutes; and
been duly
applicable
WHEREAS, a public hearing was held on said petition
March 5, 1990 at 7:35 p.m. in the Prior
Council Chambers; and
on Monday,

WHEREAS, the City Council then proceeded to hear all persons
interested in said petition and persons interested
afforded the opportunity to present their views and
objections to the granting of said petition; and
WHEREAS, the City Council of Prior Lake has determined that the
vacation of said Alley would be in the public interest.

NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
PRIOR LAKE, that pursuant to Minnesota statutes 412.851,
the above described Alley situated in the City of Prior
Lake, Scott County, Minnesota is hereby vacated.
BE IT FURTHER RESOLVED that a copy of this Resolution will be
forwarded to all affected property owners for their use to
petition the court to expand their torrens certificates of title
to include the land in the vacated alley.

You are herebr notified that a Public Hearing will be held by the
City Council 1n the Prior lake City Council Chambers at 4629
Dakota street S.E. on Monday, March 5, 1990 at 7:35 p.m.
The purpose of the hearing is to consider vacating the following
legally described Alley.
DESCRIPTION:
That part of the Dedicated Alley in Block 37, SPRING LAKE
TOWNSITE, Scott County, Minnesota, described as follows:
That part of the 16.00 foot Alley in Block 37, SPRING LAKE
TOWNSITE lying and being between the northeasterly extension
of the northerly lot line of Lot 7, Block 37 and the
northeasterly extension of the southerly lot line of Lot 9,
Block 37, SPRING LAKE TOWNSITE, Scott County, Minnesota.
Or more commonly described as the vacation of a 16 x 150 foot
strip of unimproved alley which is located near the rear property
lines of 2865, 2875 and 2883 Center Road and 2840, 2850 and 2860
Spring Lake Road. A map of the proposed vacation site is
available from the Planning Department at Prior Lake City Hall
for reference.
If you desire to be heard in reference to this vacation, you
should attend this hearin9. Oral and written comments will be
considered by the City Counc1l. If you have questions regarding
