ANDERSON, DIRECTOR OF PUBLIC WORKS CONSIDER APPROVAL OF RESOLUTION 90-25 TO REQUEST A VARIANCE FROM STATE AID STANDARDS JUNE 4, 1990 The purpose of this item is to request MnDOT to approve a variance to State Aid Standards for the construction of the sidewalk on Fish Point Road. The Fish Point Road - T.H. 13 Project included the extension of sidewalk from T.H. 13 to the Middle School. During the plan review process it was discovered that the standards have changed since 1979. This primarily was due to the use of smaller cars requiring vertical curves to be slightly longer. The curves by today's design standard are from 28 to 30 m.p.h. vs 30 m.p.h. A variance from the standards is required to expend funds for the construction of the sidewalk. At the time this was discovered the project was divided into two projects, one the intersection improvements and the other the sidewalk improvements. The reason for this was to have plan review and cooperative agreement preparation ongoin'1 for the intersection improvements pr10r to the approval of a variance. The variance committee will meet in June or July. Once the variance is approved the project can be advertised for bids. Construction will probably commence at the end of August. Plan ap~roval and the preparation of the cooperat1ve agreement for the intersection improvements are anticipated by MnDOT to be complete at the end of June. (612) 447-4230 / Fax (612) 447-4245 DISCUSSION: RECOMMENDATIONS: ALTERNATIVES: ACTION REQUIRED: In order to utilize MSA funds for the construction of the sidewalk, a variance from MSA standards is required. If the Council chooses to construct the sidewalk without MSA funds, a variance is not required. The estimated cost is $60,000 for the construction of the sidewalk. Another option is to reconstruct Fish Point Road to meet MSA standards. This option is not practical as the deviation from 30 m.p.h. standards is minimal and would require complete reconstruction from Huron Street to the north. The recommendation is to approve Resolution 90-25 requesting a variance to the standards. The alternatives are as follows: 1. Approve Resolution 90-25. 2. Construct the sidewalk without MSA funds. 3. Reconstruct Fish Point Road from Huron Street to T.H. 13. 4. Table this item for a specific reason. 5. Do not construct the sidewalk. Make a motion as part of the Consent Agenda to approve Resolution 90-25. HERITAGE 1891 COMMUNITY 1991 C/YJ.5C)fi 2{(91 RESOLUTION 90-25 RESOLUTION TO REQUEST A VARIANCE FROM STATE AID STANDARDS MOTIONED BY SECONDED BY WHEREAS, the City Council of the City of Prior Lake has ordered construction of sidewalks on Fish Point Road between Glory Circle and Huron Street using Municipal State Aid Funds; and WHEREAS, Fish Point Road was previously Municipal state Aid Funds; and WHEREAS, Minnesota Rule 8820.9912 requires a 30 mile per hour design speed on Municipal state Aid funded projects; and constructed using WHEREAS, the design speed of a horizontal curve on the existing street of 28.6 miles per hour does not conform to Minnesota Rule 8820.9912; and WHEREAS, the design speed of 4 vertical curves on the existing street of 29.4, 27.8, 29.5 and 29.8 miles per hour do not conform to Minnesota Rule 8820.9912; and WHEREAS, the project complies with all other State Aid standards and rules. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that we hereby authorize the City Engineer to request a variance from Minnesota Rule 8820.9912 for the design speed of the horizontal and vertical curves.
