The vacation of part of Tower Street is a necessary step in the development process proposed by Enivid, to locate a grocery market south of priordale Mall. A public hearing is scheduled for 8:30 p.m. following this vacation public hearing, to consider the subdivision of Enivid First Addition. The subdivision is a replat of parts of Brooksville Center 1st and 2nd Additions. The plat will re-dedicate Tower Street in a different alignment that has been designed to accommodate a "rin~ road" south of the priordale Mall distrlct. Staff has reviewed the vacation application and contacted private utility companies to determine the effect of the vacation on utility lines. Staff has received no objections to the proposed vacation of South Anna Lane. Scott Rice Telephone has indicated that there is telephone cable adjacent to the north line of Tower Street. In addition, the Engineering Department has indicated that there are municipal utility lines within the vacation site. However, the necessary easements will be dedicated in the plat of Enivid First Addition to protect the utility interests of the City and Scott Rice Telephone. 1. WHEREAS, notice of the hearing on said petition has published and posted in accordance with the Minnesota Statutes; and been duly applicable WHEREAS, a public hearing was held on said petition on Monday, June 4, 1990 at 8:15 p.m. in the Prior Lake City Council Chambers; and WHEREAS, the City Council then proceeded to hear all persons interested in said petition and persons interested afforded the opportunity to present their views and objections to the granting of said petition; and WHEREAS, the City Council of Prior Lake has determined that the vacation of said Road would be in the public interest.
