CONSIDER RESOLUTION 93-17 AUTHORIZING
CONVEYANCE OF CERTAIN TAX FORFEITURE LANDS

The City recentl~ received notification by the
Scott County Audltor's Office of the Count~'s
pending tax forfeiture lands sale. Accordlng
to statutes the City has an opportunity at
this time to review those properties that may
serve a public use and acquire them for such
purpose.
with this in consideration, Scott Coun~y is
requesting Council action on two lssues
relating to the aforementioned sale. The first
is for the Council to authorize formal
acquisition, by resolution, of those
properties of interest to the City of Prior
Lake. Second, the Council is asked to a~prove,
for public sale, those parcels on the 11st of
non-conservation lands.
Staff initially reviewed an original list that
included all properties together and, as
requested by Scott County, identified each of
the properties as either conservation lands or
non-conservation lands. By labeling those
parcels as conservation, we were able to
reserve the City's interest on a preliminary
basis for those specific properties.
Attached to your agenda report are copies of-
the forfeited lands list and half section maps
showing the location of the parcels. The list
comprises a total of 31 parcels within Prior
Lake, of which all 14 have been designated on
the conservation list and the one tract on the
non-conservation list for city acquisition.
The properties classified as conservation are
high-lited in blue and those classified as
non-conservation in yellow. Also, the public
purpose reason is indicated in the far right
column on the list itself. Those proposed for
acquisition are circled in red.
As provided b~ Minnesota statute 282.01, the
City may acqulre these parcels, by either one
of the following methods;

l. FEE TITLE:
By paying the selling price, as determined
by the County Board plus all administrative
costs.
RECOMMENDATION:
2. SPECIFIC USE:
Complete an "Application by Governmental
Subdivision for Conveyance of Tax-Forfeited
Lands" stating the intended public use. The
cost includes minimal administration fees.
The obvious advantage of the conveyance method
is that the City need not purchase the
~ropert~ while expending only a nominal amount
ln admlnistrative expenses. However, it is
important for the Council to recognize that
the City retains control of the property as
long as it is utilized for the specific use.
If the use is abandoned, the property must be
deeded back to the State of Minnesota.
options available to the Council are basically
to re-assess and amend the forfeiture list of
conservation properties according to council
priority.
Assuming the City Council is in consensus with
the Conservation list and the public purpose
so indicated for each parcel, Staff would
recommend that Resolution 93-17 Authorizing
Conveyance of Certain Tax Forfeiture Lands be
approved. The appropriate application forms
are also attached and must be si9ned by the
Mayor and City Manager, which wll1 then be
formally considered by the Scott County
Board.
ALTERNATIVES:
The remaining parcels labeled non-conservation
lands, with the single noted exception, will
be appraised by the County and submitted for
tax forfeiture sale proceedings under sealed
bid.

A RESOLUTION AUTHORIZING CONVEYANCE OF CERTAIN
TAX-FORFEITURE LANDS TO THE CITY OF PRIOR LAKE

WHEREAS, the City of Prior Lake has been duly notified by Scott
County of those tax forfeiture lands subject to sale
and located within the City; and
WHEREAS, the list of tax forfeiture properties has been reviewed
and those determined to be appropriate designated as
conservation lands; and
WHEREAS, the City of Prior Lake has identified the specific
public use and intended purpose associated with certain
tax forfeiture parcels; and
WHEREAS, the City of Prior Lake has completed the Application by
Governmental Subdivision for Conveyance of Tax-Forfeited
Lands.
NOW, THEREFORE BE IT RESOLVED, by the Mayor and city Council that
the city of Prior Lake acquire the single property indicated on
the non-conservation list and all those parcels classified as
conservation by specific use conveyance, as allowed b~ Minnesota
Statutes 282.01, according to the attached lists hereln.
BE IT FURTHER RESOLVED, that the remaining
classified lands, on the attached referenced
