INTRODUCTION:
The purpose of this Agenda item is to discuss
the proposed policies for Private Development
Projects and for Council approval for policy
implementation. The policies are as follows:
A. Erosion Control Plan
B. Construction Inspection of Developer
Projects
BACKGROUND:
On November 2, 1993, Director of Public Works,
Larry Anderson, discussed the concern of
quality of construction work done by
developers and their contractors. The
recommendation that the City or their
consultant should perform the inspection to
insure compliance. Council directed Staff to
make the necessary changes in the Developer's
Agreement to allow either city Staff or a
consultant to perform the inspections.
Staff has drafted the attached policies for
construction inspection and erosion control of
private development projects for Council
review and approval. The first policy for
consideration is the Erosion Control Policy.
Recently, the City has adopted three (3)
ordinances for storm Water Management and
Erosion Control. The policy reiterates the
ordinance portions which pertain to erosion
control and provides more specific
requirements on erosion control measures for
development sites and building sites.
The policy states that construction site
erosion control measures shall meet the
standards outlined in the MPCA's "PROTECTING
WATER QUALITY IN URBAN AREAS" manual. The
policy also requires new developments to
install a silt fence along the curb after the
concrete curb and gutter has been installed
and for a temporary rock construction entrance
to be installed on each individual building
site for the site access.

The policy also outlines when building ~ermits
will be issued for new developments WhlCh is
upon the com~letion of the grading of each
block. Certlficate of Occupancies will be
issued after the bituminous base course
pavement is installed and this has been the
policy in past years.
The second policy drafted by staff pertains
with the construction inspection of private
development projects. The ~olicy has three
(3) sections which descrlbe the policy
statement, construction inspection engineering
services fee structure and the list of
construction inspection services to be done by
the city.
The policy states that all private development
projects within the City are to be inspected
by City personnel. Each private development
would be required to escrow 8% of net
construction costs with the City to pay for
construction inspection services. Unused
escrow amount will be returned to the
developer upon final acceptance by the Cit~.
If the escrow account for a development lS
depleted before the project is completed, the
developer will be required to provide
additional funds to cover the inspection
expenses.
The policy outlines which construction
services will be done by the city and which
will be done by the developer's engineer. The
services by the City include inspection of
public improvement systems, documentation of
work and testin~, as-built location
dimensions for sanltary sewer, water, and
storm sewer facilities, and coordination with
the testing company for soil and material
testing. All other services relating to
construction will be the responsibility of the
developer.
staff feels this policy will provide the City
with more quality control of the public
improvement construction. The policy fee is
structured so that each development will be
paying for the actual construction inspection
services provided versus charging a fixed
~ercentage of the improvements to pay for the
lnspection services.
DISCUSSION:
Staff will be conducting a meeting with the
current developers in the City on April 1,
1993 to discuss the Storm Water Management and
Erosion Control Ordinances as well as the
policies mentioned in this report. Staff will
present the results of this meeting to Council
at the Council Meeting.
Staff has met with the Glenn Kessel, City
Attorney, about the policies and the affects
to future Developer's Agreements. It is
anticipated that Mr. Kessel will have reviewed
the above mentioned items and may have
comments at the Council Meeting.
The purpose of the policies is to provide
standard written statements which tell how the
City of Prior Lake will deal with the areas of
erosion control and construction inspection in
future developments. These policies will
provide a clearer, more consistent,
expectation to all developers.
The alternatives are as follows:

staff recommends Alternative Number 1 as
several private development projects will be
proceeding in construction soon and the
policies need to be implemented and
incorporated into future developer agreements
with the City.
FINANCIAL IMPACT: The cost of the construction inspection and
erosion control policies will be by the
developers and builders.
ACTION REQUIRED:
The action required will be to make a motion
to implement the policies on Erosion Control
and Construction Inspection of Private
Development Projects within the City of Prior
Lake as presented or as amended at the April
5, 1993 Council Meeting.

POLICIES FOR PRIVATE DEVELOPMENT PROJECTS
POLICY STATEMENT
1. EROSION CONTROL PLAN
It is the pOlicy of the City of Prior Lake that the
construction of private developments shall have a site
construction plan outlining the erosion control measures
based on the 1989 Edition, Protectinq Water Quality in Urban
Areas as published by the Minnesota Pollution Control Agency
or an equivalent set of standards and as written in the City
Code.
The requirements included in the proposed Storm
Management Ordinances are as follows:
Water
1. Locations and dimensions of all proposed land disturbing
activities and any phasing of those activities.
2. Locations and discussions of all temporary soil and dirt
stockpiles.
3. Locations and discussions of all construction site
erosion control measures necessary to meet the standards
as outlined in Protectinq Water Quality in Urban Areas,
published by the Minnesota Pollution Control Agency or
an equivalent set of standards.

In addition to the above site construction plan
requirements, the city will require silt fence be placed
behind the streets concrete curb and gutter within 7
calendar da~s after the concrete curb and gutter is

determined by the city Engineer within the street
boulevard area.

These erosion control measures shall be required for all
new construction, except in those cases where the
weather makes the installation of such measures
unpracticable as determined by the City Engineer or
Building Official.
Building permits will not be issued until lot grading,
topsoil placement, erosion control, and re9uired turf
placement are completed. The building permlts can be
obtained in Blocks rather than waiting until the entire
subdivision grading is complete. The existing policy of
issuing one Building Permit per parcel remains in effect.
Certificate of Occupancy permits have been issued in the past
after the bituminous base course has been placed for the
streets in the development. This policy will be continued
for future developments.

POLICY FOR PRIVATE DEVELOPMENT PROJECTS
CONSTRUCTION INSPECTION OF DEVELOPER PROJECTS AND TESTING
REQUIREMENTS
It is the policy of the City of Prior Lake that construction
activity for all private development projects within the city
shall be inspected by city staff personnel or city
engineering consultant firm personnel. The construction
inspection fee charged to the private development shall be
based upon the fee structure outlined in this policy and the
actual engineering services completed by the city's
Engineering Department or their consultant's representative.
CONSTRUCTION INSPECTION ENGINEERING SERVICES FEE STRUCTURE
All private development projects shall escrow 8% of the net
construction cost of the development to the city and this
escrow account shall be used to pay for the construction
inspection services. Construction inspection time will be
charged against the escrow with any unused escrow amount to
be returned to the developer. If the construction inspection
charges exceeds the 8% net construction cost, the developer
will add funds as determined by the City Engineer to the
escrow to cover city expenses. If the escrow is not
replenished, the contractor shall terminate construction
activities. If city staff is used for construction
inspection services, the hourly charge shall be as per the
rates established by the city's Finance Director.
CONSTRUCTION INSPECTION SERVICES
The construction inspection services includes the inspecting
of public infrastructure construction relating to the
development.
The construction inspection service shall include:

include grading, sanitary sewer, watermain, storm
sewerjponding, and street systems. Grading
inspection is for overview of drainage swales and
not for detail site gradin~.
Documentation of constructlon work and all testing
of improvements.
As-built location dimensions for sanitary sewer,
watermain, and storm sewer facilities.
Coordination with testing company for soil and
material testing.
