HomeMy WebLinkAbout3K - Busse Final Plat .~< ,'< } AGENDA NUMBER: PREPARED BY: SUBJECT: ADDITIONAL ITEM #1 DEB GARROSS, ASSISTANT CITY PLANNER CONSIDER FINAL PLAT APPROVAL FOR BUSSE FIRST ADDITION APRIL 19, 1993 DATE: INTRODUCTION: The purpose of this item is to consider final plat approval for Busse First Addition. The development consists of two commercial zoned lots located northeast of the intersection of S.T.H. 13 and Duluth Avenue. See attached plat for reference. BACKGROUND: The City Council approved the preliminary plat of Busse First Addition on March 1, 1993 subject to the following conditions: 1. An erosion control plan be submitted subject to approval of the City Engineer. 2. The right-of-way for Duluth Avenue be increased by 7 feet for the easterly 152 feet of Duluth Avenue. 3. Sewer and water plans must be subject to the approval of the City Engineer. 4. The dimensions for Lot 1, be adjusted to a minimum lot size of 20,000 square feet. DISCUSSION: Staff reviewed the final plat of Busse First Addition for compliance to the approved preliminary plat. The lot configuration and dedication of road and easements are consistent with the approved preliminary plat. The City Engineer is in the process of drafting a DeveloJ?er's Agreement to provide for the installat10n of required subdivision improvements. The Developer's Agreement was not drafted prior to the City Council meeting due to late SUbmission of J?lans and specifications. The City Attorney 1S in the process of reviewing the title opinion submitted by the developer on April 15, 1993. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLDYER ALTERNATIVES: RECOMMENDATION: ACTION REQUIRED: the Council agenda for approval in order to facilitate the development. In addition to plat ap~roval, it is recommended that the Counc11 adopt Resolution 93-22 setting forth conditions to be met by the developer prior to release and filin9 of the final plat of Busse First Addit10n. The conditions outlined in Resolution 93-22 are sufficient to allow the development to continue in a timely manner and implement the sUbdivision process. This situation is unique due to the limited size of the project and the fact that the outstanding issues are minor and can be accomplished via formal adoption of Resolution 93-22. 1. Approve the final plat of Busse First Addition and approve Resolution 93-22 setting forth conditions under which the plat may be released and filed with Scott County. Table or continue this item for specific reasons. This alternative may result in withdrawal of the development proposal due to time constraints related to closin9 and financing of the project. Deny f1nal plat approval for specific facts and findings. Alternative #1. 2. 3. A motion to approve the final plat subject to the conditions for filing of the final plat as stated in Resolution 93-22. A separate motion to approve Resolution 93-22 as written or subject to changes directed by the City Council. RESOLUTION 93-22 RESOLUTION OF THE PRIOR LAKE CITY COUNCIL SETTING FORTH CONDITIONS TO BE MET PRIOR TO FILING OF FINAL PLAT FOR BUSSE FIRST ADDITION. MOTION BY: SECONDED BY WHEREAS, the City Council has approved the Final Plat of Busse First Addition; NOW, THEREFORE, BE IT RESOLVED BY LAKE, MINNESOTA, that it should following conditions to be met, recording of said plat: 1. Submittal of required plans, specifications, cost estimates and other detail required by the City Engineer, in order to prepare a Developer's Agreement for installation of utilities. The plat dedication be amended to specify that Duluth Avenue is dedicated for roadway, utilit~ and drainage easement purposes in addition to the dedicat10n of easements .... 3. Payment of park support fees in accordance with City Policy at the time of building permit. 4. Payment of $5,830 dollar park dedication fee. 5. (612) 4474230 I Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLDYER Subway restaurant with hours limited to weekday closing at midnight and Friday and Saturday hours closing at 1:00 a.m.; and variance to reduce required parking spaces from 40 to 27 spaces for the Subway development. 10.
