ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW)
AUGUST 2, 1993
The City of Prior Lake has included in its 1993 construction
project the roadway construction of Carriage Hills Parkway from
CSAH 21 to Pike Lake Trail. Under Minnesota Statutes, Section
116D.04 and 116D.045, part 4410.4300, sub part 22, paragraph A,
a mandatory EA W is required for the construction of a road on a
new location over one mile in length that will function as a
collector roadway. Carriage Hills Parkway is classified in the
City's Transportation Plan as a local collector. Since this roadway
will be constructed as a new alignment, an EA W is mandatory.
The purpose of this Agenda item is for the City Council to review
the findings of the EA W and decide whether the environmental
impact has a negative declaration or an Environmental Impact
Statement (EIS) should be performed.
The City contracted with Maier, Stewart & Associates, Inc. to
perform the EA W. An EA W was prepared and distributed to all
required points on the Environmental Quality Board (EQB)
distribution list Notice of EA W review were given to the EQB
Monitor and Prior Lake American in which notices were published
on June 7, 1993 and May 29, 1993, respectively. Enclosed with the
Council's Agenda packet is a copy of the EA W for review.
The EA W review process allows for a thirty (30) day comment
period from the public and governmental agencies. The comment
period was officially over on July 7, 1993. Comments were
received from the following agencies and are attached for Council
review:
1.) Metropolitan Council
2.) Minnesota Department of Natural Resources
3.) Minnesota Pollution Control Agency
4.) Minnesota Historical Society
The City of Prior Lake is the Responsible Governmental Unit
(RGU) on the Carriage Hills Parkway EAW, and consequently the
sole legal determiner of who makes the decision on whether or not

an EIS is required for this project. According to the rules, "the
primary purpose of the EAW process is to provide the facts needed
to determine if an EIS is necessary." From the Guide to the Rules
of the Minnesota Environmental Review Program, an EIS shall be
ordered for projects that have the potential for significant
environmental effects. The criteria for deciding whether a project
has the potential for significant environmental effects are the
following factors:
CRITERIA FACTORS:
1. Type, extent and reversibility of environmental effects;
2. Cumulative potential effects of related or anticipated future
projects;
3. The extent to which environmental effects are subject to
mitigation by ongoing public regulatory authority; and
4. The extent to which environmental effects can be
anticipated and controlled as a result of other
environmental studies undertaken by public agencies on the
project proposer, or of EIS 's previously prepared.
The Council should consider the comments received on the
environmental impact and review the scope of the project to
determine if an EIS is warranted. The comment period is over and
staff has enclosed all comments received on the EA W.
Enclosed also with the Agenda item is a response memorandum on
City letterhead prepared by Maier Stewart & Associates, Inc. to the
comments received on the EA W. It is required that the applicant of
the EA W, in this case the City, respond to the comments received
in the comment period. This memorandum effectively addresses
each issue raised by the comment letters.
In the comment letters, none of the agencies asked for an EIS to be
done on the project. The main issues raised were in regards to
storm water quality, wetlands and possible unreported historical
properties in the project area. During the implementation stage of
the roadway project, staff will have water quality ponds
constructed and erosion control practices to meet the City's storm
water ordinance which adopts the Best Management Practice
Manual as published by the MPCA. A reconnaissance level survey
of the project area will be completed this fall as recommended by
the Minnesota Historical Society. Construction will not commence
until after the reconnaissance survey is complete.
The EAW is for the entire segment from CSAH 21 to Femdale
Avenue. The First Phase of construction is the segment from
CSAH 21 to Pike Lake Trail. Each Phase of construction will
necessitate implementation of Best Management Practices, wetland
deliniation and compliance with all rules which are applicable at
the time each Phase is constructed. Pat Arlig from MSA in
reviewing the comments received believes that the response is
appropriate and a negative declaration can be made.
Enclosed with the Agenda Report is Resolution 93-62 which finds
a negative declaration for the EA W and does not require an EIS be
prepared for the Carriage Hills Parkway roadway from CSAH 21
to Ferndale Avenue.
ALTERNATIVES:
The alternatives for the Council on this item are as follows:
1. Adopt Resolution 93-62.
2. Do not adopt Resolution 93-62 and direct the preparation of
an EIS on this proposal.
3. Table any action for further review and consideration.
RECOMMENDATION: Staff recommends adopting Resolution 93-62 as the environmental
impacts are insignificant for the proposed roadway from CSAH 21
to Ferndale Avenue.
ACTION REQUIRED: Make a motion to approve Resolution 93-62.

WHEREAS,
the City Council of Prior Lake on August 2, 1993, considered the
comments of the Metropolitan Council, Department of Natural
Resources, Minnesota Pollution Control Agency, and Minnesota
Historical Society; and
WHEREAS,
the comments of these agencies will be taken into account during the
upcoming permitting and review process for Carriage Hills Parkway.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE.
MINNESOTA. that an Environmental Impact Statement is not necessary for Carriage Hills
Parkway because the project does not have significant environmental effects and is not
more than of local significance.
BE IT FURTHER RESOLVED, BY THE MAYOR AND CITY COUNCIL OF PRIOR
LAKE, MINNESOTA, that a negative declaration notice shall be officially filed with the
Minnesota Environmental Quality Council.
