HomeMy WebLinkAbout4F - Payment to Larkin, Hoffman & Daley for Indian Issues AGENDA #: PREPARED BY: SUBJECT: DATE: BACKGROUND: ISSUES: ALTERNATIVES: STAFF AGENDA REPORT ~~ (f) FRANK BOYLES, CITY MANAGER CONSIDER APPROVAL OF CONTINGENCY FUND ALLOCATION FOR FINAL PAYMENT TO LARKIN HOFFMAN LAW FIRM FOR SPECIAL SERVICES RENDERED ON INDIAN ISSUES AUGUST 16, 1993 At the April 2 and 3 workshop the Council directed that Jerry Seck, of the law firm of Larkin, Hoffman and Daley, be retained as special counsel for the City on Indian issues. Mr. Seck was to work with Prior Lake on the two sewer agreements requested by the Dakota community and work toward the completion of a Fee in Lieu of Taxes agreement. On July 6, 1993 I received City Council authorization to expend up to $10,000 from contingency for legal fees incurred in this pursuit. The sewer agreements and Fee in Lieu agreements have now been finally drafted and executed. The total cost for Mr. Seck's services have amounted to $17,406.30. This exceeds the City Council's previous authorization by $7,406.30. I am requesting that the City Council authorize an additional allocation from the contingency fund to provide for final payment for these services. The City has received the services for which we have been billed. Mr. Seck's efforts were fruitful, both with respect to the sewer agreements and Fee in Lieu of Taxes agreement. Council has the following alternatives: 1. Authorize an expenditure from the contingency account of $7,406.30. 2. Authorize an expenditure from other sources for this purpose. RECOMMENDATION: I recommend that the City Council authorize an expenditure of $7,406.30 from contingency for final payment for Mr. Seck's services.
