HomeMy WebLinkAbout7A - Jefferson's Second Addition "suttee' AGENDA NUMBER: PREPARED BY: SUBJECT: DATE: INTRODUCTION: BACKGROUND: DISCUSSION: 7A JAMES HAYES, ASSOCIATE PLANNER CONSIDER APPROVAL OF RESOLUTION PRELIMINARY PLAT AND RESOLUTION 93-72, PLAT OF JEFFERSON'S SECOND ADDmON AUGUST 16, 1993 93-71, FINAL The Planning Department has received an application from Harlan Anderson for the subdivision of Jefferson's Second Addition. The subject site consists of approximately 0.75 acres, bordered on the north by Carriage Hill Road and on the south by Shore Trail. The subject site is zoned R-l, Urban Residential and also located in the S-D, Shoreland District. The property being proposed for development into two single family lots under the Abbreviated Subdivision Process of Section 6-3-1 of the Subdivision Ordinance. The subject site was platted as an outlot when Jefferson's First Addition was platted. This outlot was served with water and sewer utilities in 1982 under project 82-3 and has been 100% assessed for frontage and trunk acreage charges. There are hookups in place for both of the proposed lots as well. In addition, all park dedication fees were paid at the time of platting the First Addition. The Street Collector Fee is still applicable and due at the time of Final Plat approval. When the First Addition was platted, Lot 1 was graded for a building pad. This pad is markedly higher in grade than the adjacent lots. The home to the east was graded approximately three feet below this lot when it was constructed. While the home to the west was built on a lower building pad approximately eight feet below the building pad on Lot 1. In addition, there is an existing pole shed on the site which may reduce the actual building pad on Lot 2. The Development Review Committee reviewed this proposal on August 5, 1993 and two major issues were discussed. First, the proposed Lot 1 needs to be regraded to match the existing home grade to the east. This requires the removal of approximately three feet of the top of the site at the time of building permit. Staff 4629 Dakota 51. 5.E., Prior Lake, Minnesota 55372 / Ph. When this lot is graded, a drainage swale shall be created along the common property line relocating it five feet to the west of its current location. Second, the pole shed located on the proposed Lot 2 may decrease the available building envelope. It should be noted that when this lot applies for a building permit all applicable zoning requirements shall apply. This includes the 22% coverage ratio and the 30% impervious surface ratio. These are the only major issues affecting this plat. ALTERNATIVES: 1. Approve Resolution 93-71 approving the Preliminary Plat and Resolution 93-72 approving the Final Plat of Jefferson's Second Addition. 2. Continue the public hearing for lack of information or detail. 3. Deny the plat due to inconsistencies with the Comprehensive Plan or Zoning Code. RECOMMENDATION: The Development Review Committee recommends Alternative number 1. ACTION REQUIRED: Two motions are required for approval, one for the Preliminary Plat and one for the Final Plat adopting each Resolution. MOTION BY: SECONDED BY: WHEREAS, the City Council held a hearing on the 16th day of August, 1993 to consider a petition submitted by Harlan Anderson to approve the Preliminary Plat of Jefferson's Second Addition; and WHEREAS, Notice of the public hearing on said motion has been duly published and posted in accordance with the applicable Minnesota Statutes. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that it should and hereby does approve the Preliminary Plat of Jefferson's Second Addition. The plat dedication be subject to approval by the City Attorney. 2. A legal opinion or commitment of title insurance be submitted acceptable to the City Attorney. 3. No building permits shall be issued until the Final Plat is filed and recorded with Scott County. 4. Payment of park support fees in accordance with City Policy at time of building permit 5. Payment of Street Collector fee in accordance with City Policy before plat is filed and recorded with Scott County. 6. Submittal of the required utility and drainage easements as approved by the City Engineer. 7. No building permit shall be issued for Lot 1, Block 1, until the site is graded consistent with the existing grade on Lot 3, Block 1, Jefferson's First Addition. 8. The proposed setback and garage slab elevation for Lot 1, Block 1, should be shown to determine the driveway grade of the lot. I recommend tha the driveway grade be at 10% maximum. The housing style should also be shown. 2. A grading plan acceptable to the City Engineer for lots 1 & 2 needs to be provided at the time of the building permit. Prior to the original subdivision, the property existed as a portion of a 2.0 acre unplatted parcel which was 100% assessed for frontage and trunk acreage charges. All past applicable assessment amounts, current and deferred, were redistributed on a unit basis against Lots 1-4 Block 1 of Jefferson's 1st Addition. Outlot A was excluded for purposes of the assessment calculation, therefore no special assessments exist against the property. The tax status of the property is in a current state with no outstanding delinquencies. Since the subdivision requires no associated street improvements or storm water facilities, no storm water fee is applicable. The property is a back tier of lots from the lake with the plat of North Shore Crest between it and the shore of Prior Cake. Public sewer and water lines and services have been installed along the north and south sides of the property. Proposed lot 1, was graded with the grading of the First Addition. There is a 32'x 60' metal pole shed on proposed lot 2, which also contains scatterd volunteer growth elm and boxelder trees. Public electrical services are available to the site at this time. STORK WATER RUlIOFF: Predevelopment stormwater runoff flows northerly and southerly into the existing storm sewer system on Shore Trail and Carriage Hill Road. This will be adequate after the development is completed. Preliminary review of the si te indicates that because of existing storm sewers, on site ponding of surface water runoff will not be necessary for the requested improvements. As required by city ordinance proper erosion control and runoff containment will be provided during construction of the houses. The proposal as presented will not require any disturbance to the existing roadways. TREE IllVEHTORY The site contains 9 spruce trees 5 to 7 feet tall along the west line. these trees will remain. There are also 6 trees ranging from 6 to 14 inches in diameter as located on the exhibits, none of the existing trees will be lost wi th the construction of the house on lot 1, and three of the larger trees will be lost in the future with the construction of the house on lot 2.
