AMENDMENT FEE

The City of Prior Lake is currently in a very
high 9rowth stage. During this period the
Plann1ng Department has been, and will
continue to be, extremely busy. An amendment
to the Comprehensive Plan can be a very time
consuming task, especially for a large scale
or major Comprehensive Plan Amendment.
According to the City Planner, Horst Graser,
more than half of the Comprehensive Plan
Amendments anticipated for 1993 will be major
amendments. This agenda item requests Council
approval to establish a major and a minor
Comprehensive Plan Amendment fee at a rate of
$1,000 (major) and $500 (minor).
As a result of the January 4, 1993 Council
Meeting, staff was 9iven the task of exploring
fee ranges for a maJor and minor Comprehensive
Plan Amendment. Currently, the City has one
fee for either a major or minor amendment that
is $500.00. The sU9gestion to divide the fee
into a major and m1nor category is a result of
the complexity and costliness of the major
Comprehensive Plan Amendment relative to the
minor Comprehensive Plan Amendment.
The following information came from a phone
survey conducted on nine neighboring
communities. The contact ~erson at each of
these cities was the Plann1ng Director.

As you can see, the only city which divides
this fee into two categories (major/minor) is
Shakopee. It is, however, im~ortant to note
that most of these cities ind1cated that they
were in the process of raising this fee in
order to cover rising costs. This did include
the possibility of making a distinction
between a major and minor Comprehensive Plan
Amendment.
The City of Prior Lake, in order to stay up to
speed with the various costs involved with
this process, has discussed the idea of
dividing this fee into a major and minor
category. The Planning Director, Horst
Graser, has suggested a charge of $1,000 for a
major, and $500 for a minor Comprehensive Plan
Amendment.
City staff believes this request is consistent
with the discussions at the Council meetings
regarding Comprehensive Plan Amendments.
staff recommends approval of this request, to
divide the Comprehensive Plan Amendments into
two categories and charge $1,000 for a major
and $500 for a minor amendment.

2. Remove Agenda item 3(d) for discussion
and clar1fication.
3. Table the action until a later date for a
specific reason.
4. Deny the request for approval for a
specific reason.
A motion to approve the Consent Agenda would
constitute approval of this request to divide
the Comprehensive Plan Amendments into two
categories and charge $1,000 for a major
Comprehensive Plan Amendment and $500 for a
minor Comprehensive Plan Amendment.
