BACKGROUND:
On May 17, 1993 Ray Lemley of the Hollywood Bar and Grill
presented a request to the Council regarding amending the' City Code
to accommodate extended sunday sale of intoxicating liquor hours for
restaurants and allowing for off-sale liquor sales until 10:00 p.m.
Monday thru Thursday.
DISCUSSION:
I have discussed these issues with the Liquor Committee. The
Committee finds no reason to oppose such an ordinance amendment
since it provides the opportunity for local businesses to extend their
hours if they desire. It also places them on equal footing with other
retail establishments in the immediate area. (See attached letter.)
State Statutes currently allow cities the discretion of setting off sale
liquor sales until 10:00 p.m. each night.
ALTERNATIVES:
The City Council has the following alternatives to consider:
1. Adopt the attached ordinance, revising the hours of Off-Sale
and On-Sale Sunday Liquor sales.
2. Take no action which would continue the existing ordinance
and On and Off-Sale liquor hours.
RECOMMENDATION:
Staff recommends adoption of the attached Ordinance 93-13
amending Off-Sale liquor hours to 10:00 p.m. Monday through
Thursday and allowing On-Sale Liquor to be sold commencing at
10:00 a.m. on Sunday for restaurants with On-Sale liquor licenses.
ACTION REQUIRED:
Adopt Ordinance 93-13 amending Off-Sale liquor hours to 10:00 p.m.
Monday through Thursday and allowing On-Sale liquor to be sold
commencing at 10:00 a.m. on Sunday for restaurants with On-Sale
liquor licenses.

ORDINANCE NO. 93-13
AN ORDINANCE AMENDING PRIOR LAKE CITY CODE TITLE 3, CHAPTER 1.
The City Council of the City of Prior Lake does hereby ordain:
1.
Parag~aph (C) of Section 3-1-14 of Prior Lake Clty Code is hereby
amended to read as follows:
(e) No off-sale of intoxicating liquor shall be made on Sundays
or before elght o'clocK (8:00) A.M. and after ten o'clock
(10:00) P.M., on Monday through Saturday. No off~6ale of
intoxicat1ng liquor shall be made on Thanksgiving Day; on
Christmas Day, December 25; or after eight o'clock (8:00
P.M. on Christmas Eve, December 24. Off-sales of
intoxicatlng liquor may be made until ten o'clock (10:00)
P.M. on December 31 and July 3 unless otherwise prohibited.
II.
The third paragraph of Section 3-1-15 of Prior Lake CIty Code 1s
hereby amended to read as follows:
Licenses shall be issued pursuant to Minnesota Statutes, section
340A.504 to hotels, restaurants, bowling centers or clubs which
have facilities for serving not less than thirty (30) guests at
one time, and they may serve intoxicating liquor between the
hours of ten o'clock (10:00) A.M. on Sundays and one o'clock
(1:00) A.M. on Mondays in conjunction with the serving of food
only.
This ordinance shall become effective from and after its passage
and publication.

SUBJECT: CITY LIQUOR ORDINANCE
Dear Mr. Boyles:
Item One: Would like to have the off-sale hours, Monday through Thursday, extended to
10:00 p.m. instead of8:00 p.m. required by City Ordinance to correspond with our
surrounding communities and state law. These communities close at 10:00 p.m. Monday
through Saturday -- New Prague, Jordan, Lakeville, Apple Valley, Shakopee and Mystic
Lake.
Item Two: Would like also to change the Sunday serving time of 12:00 Noon to 10:00
a.m. serving time for a full service food and restaurant because of Sunday brunch. These
communities serve at 10:00 a.m. full food restaurants: Lakeville, Bloomington,
Bumsville, Egan and Apple Valley.
I have discussed this with the on and off sale owners and seven agree to the 10:00 p.m.
closing time. I have also discussed this with the Chief of Police, Dick Powell, and he saw
no problem with the change. I have also discussed this with all of the council members of
the above hour changes and found it to be favorable.
