PROJEcr #93-11 WATERFRONT PASSAGE BUSINESS PARK, CONSIDER RESOLUTIONS 93-89 & 93-92 b. PROJEcr #93-12 - LIME ROAD/CENTER ROAD, CONSIDER RESOLUTIONS 93-91 & 93-94 c. PROJEcr #93-13 - FOREST CIRCLE/FOREST OAKS, CONSIDER RESOLUTIONS 93-90 & 93-93 OcrOBER 25,1993 The purpose of this Agenda item is to declare the cost to be assessed, order the preparation of a proposed assessment roll, and to establish a date for the Assessment Hearing for Project #93-11; Waterfront Passage Business Park, Project #93-12; Lime Road/Center Road, and Project #93-13; Forest Circle/Forest Oaks Improvements. Projects #93-11, 93-12, and 93-13 have been awarded for construction by the Council on September 7, 1993, July 6, 1993, and August 16, 1993 respectively. The Lime Road/Center Road and Forest CirclelForest Oaks projects are nearly complete with the Waterfront Passage Business Park at 30% of completion. The next step in the public improvement process is to conduct the Public Hearing for the proposed assessment. Resolutions 93-89, 93-90, & 93-91 are for the establishment of the Assessment Hearing date, preparation of the assessment, publication of the notice in the official newspaper, and the mailing of the individual notices to the owners of parcels to be assessed. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER The public notice to the offichil paper and mailed individual notices to owners of property to be assessed will be done this week in order to meet the minimum two week notification prior to the hearing date of November 15, 1993. The assessment hearings must be held on November 15, 1993 in order to certify the assessments to the County Auditor this year. In past years, the certification of the assessment roll had to be done in September for assessments to be certified in October. ALTERNATIVES: The alternatives are as follows: 1. Approve Resolutions 93-89, 93-90, 93-91, 93-92, 93-93, and 93-94. 2. Table approval of Resolutions 93-89, 93-90, 93-91, 93-92, 93-93, and 93-94. 3. Deny approval of the resolutions. RECOMMENDATION: The recommendation is to approve Resolutions 93-89, 93-90, 93-91, 93-92, 93-93, and 93-94 setting a hearing date of November 15, 1993 for the assessments and declaring costs to be assessed. FINANCIAL IMPACT: Project #93-11 will be paid through Special Assessments, Trunk Reserve Funds, and Sewer and Water Enterprise Funds. Project #93-12 will be paid through Special Assessments. Project #93-13 will be paid through Special Assessments and Trunk Reserve Funds. ACTION REQUIRED: Make a motion, as part of the Consent Agenda, to approve Resolutions 93-89, 93-90, 93-91, 93-92, 93-93, and 93-94. AGE4B.WRT RESOLUTION 93-89 RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT FOR Project 93-11 Waterfront Passage Business Office Park Construction Improvements MOTION BY: SECONDED BY: WHEREAS, by a resolution passed by the Council on November 1. 1993. the City Manager was directed to prepare a proposed assessment of the cost of improvements for Proiect 93-11 and; WHEREAS, the City Manager has notified the Council that such proposed assessment has been completed and filed in his office for public inspection. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of Prior Lake, Minnesota: 1. A hearing shall be held on the ill day of November, 1993 in the City Hall at 7:45 P.M. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given the opportunity to be heard with reference to such assessment. 2. The City Manager is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing. and he shall also cause mailed notice to be given to the owner of each. parcel described in the assessment roll not less than two weeks prior to the hearing. 3. The owner of any property so assessed may. at any time prior to certification of the assessment to the County Auditor. pay the whole of the assessment on such property. with interest accrued to the date of payment. to the City Finance Director. except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. He may. at any time thereafter. pay to the City Finance Director the entire amount of the assessment remaining unpaid. excepting the installment portion appearing upon the current year's property tax statement. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of Prior Lake, Minnesota: 1. The portion of the cost of such improvement is to be paid by the City's Trunk Reserve Fund and Sewer and Water Enterprise Fund hereby declared to be $355.000.00 and the portion of the cost to be assessed against benefited property owners is declared to to be $813.588.63. 2. Assessments shall be payable on an equal principal installment method extending over a period of lQ years. The first installment shall be the annual principal plus interest calculated from the public hearing date to the end of this year plus twelve months of the next year and shall bear interest at the rate of 5!& per cent per annum from the date of the adoption of the assessment resolution. 3. The City Manager, with the assistance of the City Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and he shall file a copy of such proposed assessment in his office for public inspection. 4. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of Prior Lake, Minnesota: I. The portion of the cost of such improvement is to be paid by the City's Trunk Reserve Fund is hereby declared to be $31.827.43 and the portion of the cost to be assessed against benefited property owners is declared to to be $123.244.86. 2. Assessments shall be payable on an equal principal installment method extending over a period of 10 years. The first installment shall be the annual principal plus interest calculated from the public hearing date to the end of this year plus twelve months of the next year and shall bear interest at the rate of Q1Q per cent per annum from the date of the adoption of the assessment resolution. 3. The City Manager, with the assistance of the City Engineer shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation. as provided by law, and he shall file a copy of such proposed assessment in his office for public inspection. 4. Assessments shall be payable on an equal principal installment method extending over a period of 10 years. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of Prior Lake, Minnesota: 1. The portion of the cost of such improvement to be paid by the City's Trunk Reserve Fund is hereby declared to be $31.827.43, and the portion of the cost to be assessed against benefited property owners, less the pre-paid amount of $22.500.00 is declared to be S 100,744.86. 2. Assessments shall be payable on an equal principal installment method extending over a period of .lll years.
