On February l6, 1993, the Council approved both the Feasibility Study for the ~roject and Resolution 93-05 calling for a Publ~c Hearing on the improvement project. On AU9ust l7, 1992, the City Council author1zed Staff to prepare a Feasibility Study for the improvements to both Center Road and Lime Road based on the resident's petition. Council also authorized Staff to prepare a Feasibility Study for this project on November 2, 1993. The proposed improvements for the project area is to install bituminous pavement and concrete curb and gutter to the unpaved streets. sanitary sewer, water and storm sewer improvements were made to these streets in 1976. The street paving was deleted at the time in order to minimize the 1976 assessment costs. The costs and assessment estimates for the project were presented to the affected property owners at an informational meeting held on September 29, 1992. This meeting was also used to discuss the scope of project, to answer questions, and to hear comments from the property owners. Of the approximately 32 properties on the project, about l3 were represented with 17 individuals attending the meeting. After the meeting, a show of hands indicated about lO of the property owners were for the project and 3 were against. This second meet1ng will be at 6:30 P.M. on March 15, 1993. Attached to the Agenda ~acket is a letter that was sent out to the res1dents to clarify the public hearing notice. At the top heading of the notice, the improvement description inadvertently included the words "WALKS and LIGHTING". Staff did consult with the city attorney about the public hearing notice and this error does not invalidate the procedings. In recent years, several of the vacant lots along Center Road have been built upon with residential housing. with more residents, the interest in paving Center Road has increased to reduce the dust from traffic. Lime Road is fully developed, however, the residents on this street have not expressed a desire to proceed with the project. The Council should receive and consider the impact from affected property owners of the proposed improvements. Based on the input received at the hearing and all other relevant factors, the Council can discuss if the project merits approval at this time. Resolution 93-13 is attached which orders the improvement and the preparation of plans. Approval of Resolution 93-13 is in order if the project is to proceed. The alternatives are as follows: DISCUSSION: RECOMMENDATION: 1. Adopt Resolution 93-13 ordering the improvement and preparation of plans for Project 93-l2. 2. Deny approval of Resolution 93-l3 and abandon Project 93-l2 at this time. 3. Table this item for a specific reason(s). Staff has no recommendation as to whether the project should be approved or not. Action on the Resolution should be withheld until after the Public Hearing and comments have been received by the property owners. FINANCIAL IMPACT: The cost of the project will be recovered through special assessments. ACTION REQUIRED: The action required will be to make a motion to approve or deny Resolution 93-13. On the top heading of the notice which contains the Project description of the area and improvement type, two types of improvements were inadvertently listed in the heading. The improvement types listed as "WALKS, and LIGHTING" should have not been included in the heading and this error was not discovered until one of the residents called and inquired about the project. In the second paragraph of the notice, the correct project description with improvement types was shown as follows: LIME ROAD AND CENTER ROAD Center Road from Northwood Road to Lime Road and Lime Road from Spring Lake Road to end terminus by the construction of storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing and appurtenant work; It was or is not the City's intent to install walks or lighting on these streets and we apologize for any misunderstanding that this mistake on our part may have caused. This error does not invalidate the Public Hearing proceedings. The Public Hearing is still scheduled for March 15, 1993 at 8:15 P.M. in the Council Chambers. Also an Informational Meeting will be conducted at 6:30 P.M. on March l5, 1993 in the Council Chambers for those who desire more information before the hearing. ANDERSON, DIRECTOR OF PUBLIC WORKS LIME ROAD AND CENTER ROAD IMPROVEMENT PROJECT MARCH 9, 1993 Please find attached to this memorandum a letter and a summary of the important facts from the Appraisal Report that was prepared by Frank J. Wicker for the Lime Road and Center Road Improvement Project. From the analysis, it was estimated that lake shore property would benefit from the improvement by $l35.00 per front foot. Non-lakeshore property would benefit by $70.00 an estimated $70.00 per front foot. The proposed assessment rate for the improvement on Lime Road and Center Road has been estimated at $48.00 per front foot. Most of the parcels on the project are single family residential housing lots. One property owner, Quentin Sprank, 16850 Lime Road, has an estimated 27l feet of assessable frontage. Mr. Sprank has a house and a large shed on the property with the appearance of a farmstead. His parcel consists of Lots l, 2, and 3, Block 25, Spring Lake Townsite and half of a 30 foot vacated strip (PID #25-133-095-0) and a metes & bound parcel (PID #25-133-012-0). The planning department would need a detail survey of the site in order to determine the number of buildable sites. At this time, it is felt that only one building permit can be granted where the large shed exists which is currently located on Lots 1, 2, & 3, Block 25 due to the Shoreland Ordinance requirements. A house exists on the metes and bound parcel which would be given a building permit to rebuild provided that City ordinances are met. The Sprank assessment would be approximately 27l feet and with a $48.00 per assessable front foot rate, the total assessment for both parcels would be $13,008.00. If the parcel is viewed as a large parcel which is residential in nature and can have two homes, the asse~sment is not excessive. If the parcel is viewed as by the Court as one parcel the assessment may be viewed as excessive.
