Prior Lake. The following agenda item is
being proposed to provide an outline for the
Task Force.
The idea of the Prior Lake Development Task
Force was initiated as a result of the
coverage ratio issue that has been discussed
in detail over the last several months.

discuss the issues regarding the coverage
ratio and other development issues with the
development community including builders,
developers, citizen coalition members,
Planning Commission members, and etc.
As a result of those discussions, a Task Force
was identified as one method in which to bring
forward all of the issues surrounding
development for a thorough discussion. The
ultimate goal of the task force is to make
recommendations to the city on how we can
improve the development process and/or
policies for the betterment of the community.
Please see the attached draft outline for the
Prior Lake Development Task Force.
Staff wanted to clarify that development
issues and improving Prior Lake's development
community has been discussed on several
different occasions with several different
groups. Initially in 1991, staff asked
several developers into the Planning
Commission Annual Retreat to address ~roblems

hosted development days wlth developers and
builders in the community over the last
several ~ears. These sessions have been seen
as posltive and staff has received
substantiative comments regarding changes to
ordinances and procedures. The develo~ment
days have expanded to include the communlties
of Prior Lake, Savage, Shakopee, and an
invitation list of our 500 builders and
developers.

that includes those who have developed and/or
those who have indicated interest in
developing in Prior Lake, a list of all Real
Estate agents from Edina Realtf, Burnet
Realty, and the other realty bus1nesses in
Prior Lake, and Marianne Whitin~ and Carl and
Jan Hanson of the citizen coal1tion. An ad

DRAFT OUTLINE FOR
PRIOR LAKE DEVELOPMENT TASK FORCE
Obiective:
The goal of the Prior Lake Development Task Force is to anallze
through an open discussion the problem experienced w th
development in Prior Lake. The results of the discussion will be
notes that identify areas in which the City needs to consider
modifications to: policies, procedures, ordinances, codes, and
etc.
Timeframe:
The Prior Lake Development Task Force (PLDTF) is designed to meet
several times to work throu9h the issues. The Task Force is not
intended to be a long standlng City committee.
Participants:
The City Council invites anyone interested in the issue to
attend. Specific identification of the following groups has been
made: Cit~ Council representatives, Planning Commission
representatlves, builders, develo~ers, real estate
representatives, citizen coalition, and Cltizens. (See attached
list)
Administrative Support:
Carol Scott has agreed to facilitate the meetings. Staff will
not be in attendance but will provide all administrative support.

SUMMARY OF THE 1991 PLANNING COMMISSION RETREAT
FEBRUARY 25, 1991
The topics of discussion at the 1991 Plannin~ Commission Retreat
related to subdivision and neighborhood deslgn. The retreat was
held on February 1 and 2, 1991 at the Riverwood Conference Center
near Monticello, Minnesota. Tapes of the Retreat are on file with
the Planning Department and may be obtained by contacting Rita
Schewe.
FRIDAY SESSION - "FORCES THAT SHAPE OUR SUBDIVISIONS"
The Friday evening session included a discussion led by Horst
Graser on the forces that shape our subdivisions. The
subdivisions that were develo~ed in the 70's and early 80's were
in ~art, a result of posltive economic forces that prompted
houslng development along with abundant shoreline resources
located adjacent to one of the largest lakes in the Metropolitan
Area.
During those decades Prior Lake's corporate area grew from one
square mile to over sixteen square miles via several land
annexations. Subdivisions were developed to take advantage of
the lake resource and recreational access to it. Common beach
areas for back lot homeowners along with homeowners associations
provided a successful marketing tool for early neighborhoods.
The typical subdivision was developed by local land holders
rather than outside professional development firms. The decades
of the 70's and 80's were a time of transition for Prior Lake
where the small, remote, lake village was transformed into a
metropolitan suburb. Growth occurred rapidly and required
substantial community investments in infrastructure and
government services. Prior Lake experienced growing pains
associated with the transition, that are still evident today.
SATURDAY SESSION - "INSIGHT INTO SUBDIVISION DESIGN"
In 1987 the Subdivision Ordinance was completely rewritten and a
new set of standards were developed for future subdivisions.
Forces that shape our subdivisions today are public opinion,
market trends, economic factors, environmental issues and
awareness along with governmental oversight from various
agencies. The subdivision process has become more legally
complex with the advent of environment and fiscal impact
analyses.

The development process is no longer a mere compromise between
the developer and City government. Instead, neighborhood desi~n
is shaped through an extensive process which incorporates publlC
opinion, local and non-local politics as well as private sector
forces. The lakeshore resource which has been the major
attraction for neighborhood development is nearly depleted.
Future community growth will depend upon how Prior Lake markets
other attributes including its school, religious, business and
environmental resources.
SATURDAY SESSION - "COMPONENTS OF PHYSICAL DEVELOPMENT"
A topic of discussion at the Retreat concerned subdivision design
and the physical components that shape neighborhoods. A
successful nei9hborhood is developed only if community values are
evident withln the subdivision. In order to incorporate
community values into a development, it is necessary to
understand what they are. Values can be determined through
survey and other research means but they also develop as a result
of the decisions that elected and appointed officials make. For
exam~le, several surveys and the efforts of the Prior Lake 2000
Commlttee and Lake Review Committee indicate that natural
resources are highly valued by citizens of the community. One
way to translate that communit~ value in a subdivision is to
conduct a natural feature lnventory for the site.
Natural features such as wetlands, steep slopes, major tree
stands, unusual knolls or unique features should be retained
within the development. The idea when reviewing a subdivision
proposal is to locate the features, then plan lot configurations
and roads around them. It should be the responsibility of the
Planning Commission to seek out these types of features and to
9Uestion the developer to make sure that the community values are
lncorporated into each neighborhood design and to insure the
public has access to them.
Other forces that shape our subdivisions are found in the
regulations and requirements of the myriad of ~overnment agencies
that regulate land development. City Offlcials must have a
strong foundation and understanding of the values its citizens in
order to develop ~olicies that will translate into physical
development practlces. It is essential that the value structure
be understood so that the City can effectively work with other
government entities to accomplish community goals. If there is
no foundation, the City will continue to develop at the
discretion of outside government jurisdictions instead of at the
will of its citizens.
SATURDAY SESSION - "PRIORVIEW PUD CASE STUDY"
The case study of Priorview PUD evaluated the historical
development of the neighborhood. The PUD was conceived in the
earl~ 80's when the economy was down and the single family
hous1ng market was dwindling. At that time, the metropolitan
area experienced growth in apartment and multifamily construction
in part to help reduce land and construction costs for housing.

The PUD case study outlined the ~roblems associated with the
project both from the develo~er and Clty'S perspective. The PUD
is best reviewed as a learn~ng experience that should not repeat
itself again in Prior Lake. Perhaps future PUD's and their
develo~ers should be more closely scrutinized in terms of their
financlal status and previous development experience prior to
approval of the PUD. It may also be prudent to enter into
performance contracts with the developer to insure that the
approved development design is indeed implemented. The City
should require that pro~osed public improvements are developed in
phases in conjunction wlth the phases of housing development. In
this way, if markets change and the final phases of the PUD are
no longer economically feasible, the public will at least benefit
from improvements made to the initial phases.
SATURDAY SESSION - "FORUM DISCUSSION WITH DEVELOPERS"
Speakers who participated in afternoon discussions were Marve
Eggum, Steve Harvey, Bob Walsh, Rick Packer, and Terrr Forebord.
The speakers have all had extensive development experlences and
various degrees of experience with development within the city of
Prior Lake. Marve Eggum, Bob Walsh and Steve Harver have
developed property under former Subdivision Ordlnance
requirements. Rick Packer and Terry Forebord are associated with
firms that may develop large tracts of land in the future under
new subdivision controls. The speakers were asked a variety of
questions and their responses were at times frank and critical of
the Prior Lake process. There were also favorable comments
offered concerning the communit~'s potential for future
develo~ment and the professionallsm offered by City staff. The
follow1ng outline represents the s~eakers paraphrased responses
to various questions and issues ralsed.
WHAT WOULD THE CITY OF PRIOR LAKE HAVE TO DO TO IMPROVE THE
SUBDIVISION PROCESS? WHAT ELEMENTS OF THE PROCESS ARE INTEGRAL
FOR A SUCCESSFUL SUBDIVISION TO OCCUR?
The city must understand that there is a timing crcle for
residential development that is tied to economic condit10ns. The
market fluctuates and delays in the subdivision hearing process
can cause a development to miss the cycle which in turn lessens
the probabilit~ of creating a successful subdivision. The cost
of land is incldental to a development. A developer looses money
when lots sit vacant over extended periods of time, because taxes
and assessments continue to accrue even though the property is
vacant. Market research is valid for a very short period of
time. Delays extend a project beyond the date for which the data
is valid. If the preferences of potential consumers change
dramatically, the result of the delays could be devastatin9 to a
development. Developers are risk managers and desire to mltigate
risk as much as possible. Therefore, it is their desire to
complete a project in a time frame that is consistent with the
market research they have conducted.

To make the process work better, "to]? management" has to have
confidence in their staff. Many t1mes hearings get bog~ed down
because Commissioners and Council people get involved wlth the
nitty gritty components of a project. The details should have
been worked out by staff prior to the hearings and officials
should concentrate on larger policy issues. "If they don't trust
their staff, they should fire them and hire people they do
trust."
It is absolutely essential that the city portray a unified
opinion and explain, up front, the process, fees and associated
procedures that will impact a development. The City must be
coordinated in their review process at a staff and Council level
in order to efficiently process subdivision applications. All
major issues should be resolved prior to the public hearing phase
of development. Another problem identified by the developers was
the ambiguity associated with politics. Most agreed that they
would rather be told up front, that an application is
insufficient than to be led to believe their proposal will pass
and have the "rug pulled out from under them" at the last
minute. Most of the costs associated with subdivisions are
accrued at the planning stages where technical. survey drawings
and plans are l?roduced. Problems associated with the proposal
should be identifled early so that only one set of detailed plans
and specifications need be prepared.
Another point that was raised is that the City should operate and
build projects under their own set of rules. It was stated that
projects built by the City often are constructed at lower
standards than those required of the private sector.
Several examples were cited of negative experiences developers
had which were attributed to disorganization and unwillingness to
make commitments on the part of the city.
One suggestion to shorten the process might be to utilize special
meetings for public hearings. In addition, perhaps a subdivision
review committee could be developed to review the technical
components of a plat ~rior to the public hearings. That way, the
Commissions and Councll could concentrate on the larger issues at
hand. Another possibility would be to coordinate neighborhood
meetings with staff present. The neighborhood meeting should
take place after the initial Planning Commission hearing so that
the hearing can establish parameters for future discussions. The
Commission has the opportunity to scrutinize the project and
indicate directions for changes. Then a neighborhood meeting
should take place to get specif1c input from citizens. staff
should be present at this meeting to identify what the legal
requirements of the appropriate codes and Comprehensive Plan are.
Then, the information generated from the neighborhood meeting can
be incorporated into the development design and or brought out at
future Planning Commission or Council hearin~s. The two tier
hearing process with the Planning commlssion and Council
conducting separate public hearings is a good process.

The City's assessment policy and associated fee schedule was
interpreted to be too restrictive on new development. The
develo~ers felt that the fees for trunk sewer, storm sewer, parks
and bU1lding permit fees were too high in relation to other
communities. The developers agreed that costs attributed to
their development should be paid however, the current policy
attempts to recoup dollars from new developments that should have
been paid br former subdivisions. The example was given that a
new subdivislon are required to pay for impacts of their
development as well as those that have been created by previous
developments. In the case of the storm sewer, the policy assumes
that the new development should par an assessment for its
impacts. The policy was not in eXlstence when adjacent lands
developed and they too, contribute to the storm water problems.
It is unfair to require the new develo~ment to pay for their own
costs as well as for the "sins of prevlous developments." The
City should assess the developer for impacts that are generated
by a development. However, impacts caused by previous
development should be levied against the properties that
contribute to the problem or the costs offset by general
taxation.
WE HAVE IDENTIFIED SEVERAL PROBLEMS WITH THE SUBDIVISION PROCESS
WHERE 00 WE GO FROM HERE; WHAT 00 YOU SEE FOR THE FUTURE OF
DEVELOPMENT WITHIN PRIOR LAKE?
cities and governments must realize that future development will
require team efforts of both the public and private sector. No
one entity will be able to develop without the assistance of
others. The City should become more business minded and approach
problems with a mindset toward accomplishing specific goals in a
timely and fiscally res~onsible way. The City should always keep
in mind economic feasibllity and understand the costs associated
with indecision, delays and last minute changes. cities and
their staff people should view their positions as "ambassadors of
the community" rather than regulators of the private sector. Be
objective.
Prior Lake is attractive because of the lake. Once the lake
access is gone, there will be little attraction for development
in the community because it is located so far from the
metropolitan area. There are many areas with better access,
amenities and positive features that are open for development.
Those areas will continue to be more attractive until
improvements, such as the Bloomington Ferry brid~e, are complete.
Essential components of a successful communlty include the
viability of the local school district. The schools in the
community are probably the most important factor in development
decisions. Another important factor are recreational amenities
including parks, and natural features. Once the lakeshore is
~one, it will be essential for the City to concentrate on
lmproving the other areas in order to remain competitive in the
housing development market. Developers do monitor issues related
to referendums, transportation and local political battles.

City staff were given several complements on improving processes
and initiating changes in assessment policies. staff must be
available for meetings and accessible. The Prior Lake staff has
been receptive to change and negotiation with respect to the
development process. However, the process could be improved by
using a series of check lists and by establishing uniform
construction specifications for roads, utilities and other
physical improvements. The standards seem to change from parcel
to ~arcel and year to year. It would make sense to have an
Englneerin9 Guide that specifies standards to be used throughout
the communlty for development improvements. City staff must also
be able to communicate to developers what the desires of the
commissions and Council are on particular issues. The elected
and appointed officials should make their positions clear on
issues so that those ideas can be incorporated into pro~osed
developments. Several of the developers felt that the Clty's
initiative to hold a forum with the Planning Commission and
development community was a great step and applauded the effort.
Most communities do not take the time or effort to utilize round
table discussion to plan for the future. The City may want to
consider instituting a developers forum whereby ideas or future
ordinance amendments would be shared with the developers to
decipher their potential impact on the development community,
prior to their implementation.
