SPECIFICATIONS FOR FISH POINT ROAD WITHIN THE
PLAT OF CARDINAL RIDGE

INTRODUCTION:
The purpose of this Agenda item is to authorize MSA to prepare
the plans and specifications for Fish Point Road.
BACKGROUND:
Sienna Corporation is in the process of platting the plat of Cardinal
Ridge. The City Council approved the preliminary plat on June 7,
1993. The fIrst phase of the plat includes the construction of Fish
Point Road, which is proposed to be constructed by the City with
Municipal State Aid Funds.
The developer is requesting that the City proceed with the design
of Fish Point Road prior to the fmal approval of the plat. The
reason for this is that the public bid process and State Aid approval
requires additional time beyond the developer's timing. Staff
requested a proposal from MSA for the design and construction of
Fish Point Road for the fIrst phase of Cardinal Ridge. MSA fees
for the design and construction of Fish Point Road is $27,525.00
and $23,600.00 respectively. The engineering fees are eligible for
Municipal State Aid funding, and per our assessment policy the
developer would not be responsible for engineering design costs on
a collector street. Staff is requesting a cash deposit in the event
that the plat is not approved. Authorization for construction
services will be deferred until the plat is approved.
DISCUSSION:
On March 15, 1993, Resolution #93-16 was approved by the City
Council which included the authorization of preparation of plans
and subject to further Council review of projects. The intent being
that this project would be subject to Council approval since it was
not an approved plat.
The developer will provide security to the City for payment of the
engineering design fees in the event that the developer does not
complete the plat. (See the attached letter from the developer.)
The authorization of the preparation of plans would be subject to

the developer providing security for the payment of engineering
fees in the event that the plat is not completed.
The developer is covering the engineering design cost in the event
that the plat is not completed.
ALTERNATIVES:
The alternatives are as follows:
1. Authorize MSA to prepare the plans and specifications for
Fish Point Road for Phase I of Cardinal Ridge. subject to
the developer providing a cash deposit.
2. Remove from the Consent Agenda for discussion and/or
table the item for a specific reason.
3. Deny the request.
RECOMMENDATION: Staff recommends Alternative Number 1.
ACTION REQUIRED: Motion as part of the Consent Agenda to authorize Maier Stewart
& Associates, Inc. to prepare the plans and specifications for Fish
Point Road for Phase I of Cardinal Ridge not to exceed
$27,525.00. Approval is subject to the developer providing an
acceptable cash deposit to the City of Prior Lake.

Dear Larry,
Sienna Corporation hereby requests the City of Prior Lake to design State Aide Road Fish
Point Road from the intersection of County Road No. 44 (l60th Street) south approximately
1600 l.f., approximately 130' beyond the proposed intersection of Street 'E' in the Cardinal
Ridge subdivision.

Sienna Corporation will deposit with the City of Prior Lake a financial instrument or
guarantee acceptable to the City of Prior Lake to cover the estimated costs of $27,525.00
for design and engineering for this approximately 1600 1.f. of Fish Point Road. This
instrument shall be placed in the City's safe (not cashed) as security and only cashed if the
City expends funds to design Fish Point Road and the final plat of Cardinal Ridge is not
approved by September 1, 1993. The City of Prior Lake will return the financial instrwnent
upon the signing of a developer's agreement for Cardinal Ridge, if final plat is approved by
September 1, 1993, with a similar alignment for Fish Point Road as shown on approved
preliminary plat.
