DESIGNATING THE PARCEL AS PUD 6-93.
OCTOBER 18, 1993
Sienna Corporation, represented by Jim Johnson, has filed for final
plat and developers agreement approval for Cardinal Ridge First
Addition. The final plat is being filed in accordance with Sections
6-5-1 and 6-7-1 through 6-7-17 of the Subdivision Ordinance. In
addition, the Council is requested to approve Ordinance 93-27
which would designate PUD 6-93 on the Official Zoning Map. The
Council approved the schematic and preliminary PUD plan for
Cardinal Ridge via Resolution 93-40 on June 7,1993.
The principle requirements for final plat approval include a signed
developers agreement with surety for the installation of utilities and
streets and the satisfactory completion of all preliminary plat
contingencies. The developers agreement was not complete as of
the date this agenda report was written. It is the intent of
Engineering staff to forward a signed developers agreement to the
Council under separate cover, prior to the meeting on October 18,
1993.
The preliminary plat was approved by the City Council on June 7,
1993 subject to ten conditions outlined in Resolutions 93-40 and
93-47. See attached Council minutes and Resolutions for
reference to the contingencies placed upon the preliminary plat.
The 147 acre single family development was contemplated to be
completed in four phases over the next four to six years. There are
a total of sixty four lots within the First Addition.
The conditions placed upon the preliminary plat have been satisfied
or will be accounted for in the developers agreement and
Resolution 93-84 approving the final plat. The park improvements
associated with this phase include installation of sidewalk adjacent
to Crossandra Street and Cardinal Ridge Trail as per attached map.

In addition, Outlot E was Identified on the preUmlnary plat as pubHc
open space therefore, the ownership of Outlot E will have to be
transferred to the City as part of the First Addition. Parks Director,
Bill Mangan will address the park system In a separate memo.
The developers agreement will be prepared by Bruce Loney and
Glenn Kessel. The agreement will specify that the developer Is
responsible for installation of all utilities, streets, park trails and all
other improvements as specified by the subdivision ordinance.
Engineering staff will be present at the meeting to review details of
the developers agreement with the Council.
Fish Point Road improvements associated with the first phase of
the plat have been bonded and are included In the 1993 CIP. The
City Council approved Resolutions 93-78 approving the plans and
specifications, authorizing advertisement for bid on September 30,
1993. The project cost for Fish Point Road was estimated to be
$482,000.00 dollars which will be funded as follows: Street
Collector Fund $29,000; Storm Water Management Fund $25,000;
Construction Fund $35,000 and Municipal State Aid $393,000
dollars.
ALTERNATIVES:
Adopt Resolution 93-84 approving the final plat of Cardinal
Ridge First Addition, the developers agreement and
Ordinance 93-27 as presented.
2. Table or continue this item for specific reasons as
determined by the City Council.

ACTION REQUIRED: Two motions are recommended, one to approve Resolution 93-84
approving the final plat and developers agreement and a separate
motion to approve Ordinance 93-27.

RESOLUTION 93-84
RESOLUTION OF THE PRIOR LAKE CITY COUNCIL SETTING FORTH
CONDITIONS TO BE MET PRIOR TO RELEASE OF THE FINAL PLAT OF
CARDINAL RIDGE FIRST ADDITION.

WHEREAS, the City Council has approved the Final Plat of Cardinal Ridge First Addition.
NOW, TIIEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PRIOR LAKE, MINNESOTA, that it should and hereby does require the following
conditions to be met, prior to release of, and recording of said plat:
1. A title opinion or commitment of title insurance be submitted acceptable to the City
Attorney.
2. Payment of park support fees in accordance with City Policy at the time of building
permit
3. Building permits shall not be issued until a contract has been awarded for the
construction of municipal sewer and water. Occupancy permits will not be issued until
improvements are accepted by the City Engineer.
4. No building permits shall be issued until the Final Plat is rued and recorded with Scott
County with the exception of one permit which may be issued to the underlying legal
description for the entire parcel.
5. The Developer's Agreement, as drafted by the City Engineer, shall be signed and fully
executed prior to the release of the Final Plat All fees shall be paid prior to release of the
Final Plat
6. Homes built upon lots within the subdivision will be subject to architectural controls and
the 22% lot coverage ratio of the Zoning Code.
7. Boulevard and front yard trees be planted upon each lot as indicated on the planting plan
for the final plat
8. The "City Copy" hardshell, containing all required signatures be returned to the Prior
Lake Planning Office prior to issuance of any building permits for the plat
9. A final set of construction plans be submitted acceptable to the City Engineer along with
fmal construction costs in order to prepare an accurate developers agreement
10. Appropriate drainage and utility easements be provided acceptable to the City Engineer.

11. The tree planting plan for Block 4 be amended to increase the percentage of Summit Ash
to at least 20% in order to comply with the Subdivision Ordinance.
12. Outlot E be given to the City for parks and open space as specified on the preliminary
plat and in a manner approved by the City Attorney.
13. The Developer and Owner agree that Outlot B shall be conveyed for consideration to the
City for road and utility purposes at the earlier of the following two events, (1) Final
platting of any portion of the property which includes Outlot B; or, (2) the subdivision
and development of the contiguous land to the south of the property, if the Oty
determines that Outlot B is reasonably necessary for access to and from said land. Upon
written notice from the City of the occurrence of either event, Owner and/or Developer
shall execute and deliver to the City a quit claim deed for Outlot B. Reimbursement for
Fish Point Road land right-of-way will be based upon the City's policy at the time of
dedication for street collectors.
14. The developer agrees to distribute literature to future buyers of lots which indicate the
park/traiVsidewalk improvements approved as part of the development.

AN ORDINANCE AMENDING PRIOR LAKE CITY CODE SECTION 5-2-1 AND
PRIOR LAKE ZONING ORDINANCE NO. 83-6 SECTION 2.1.
The Prior lake Zoning Map, referred to in Prior Lake City Code Section S-2-1 and Prior Lake
Zoning Ordinance No. 83-6 Section 2.1, is hereby amended to change the zoning classifications
of the following legally described property to PUD 6-93.
PROPERTY LEGAL DESCRIPTION:
The Northeast Quarter of Section 1, Township 114, Range 22, Scott County, Minnesota except
the north 330' of the west 330' thereof, and except S.28 acre tract described as follows: That part
of the Northeast Quarter of Section I, Township 114, Range 22, Scott County, Minnesota,
described as follows: Commencing at the northeast corner of said Northeast Quarter, a distance
of 449.00 feet to the point of beginning of the tract of land to be described; thence continuing
westerly along said north line, a distance of SOO.OO feet; thence southerly at right angles to said
north line a distance of 460.00 feet; thence easterly parallel with said north line, a distance of

petition submitted by Sienna Corporation to approve the Schematic and

WHEREAS,
The Prior Lake Planning Corrunission conducted a public hearing on the
20th day of May, 1993, to consider a petition submitted by Sienna
Corporation to approve the Schematic and Preliminary P.U.D. Plan for
Cardinal Ridge; and
WHEREAS
Notice of the public hearing on said motion has been duly published and
posted in accordance with the applicable Minnesota Statutes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that it should and hereby does approve the Schematic and Preliminary P.U.D.
Plan for Cardinal Ridge subject to the following:
1. Approve the revised Schematic and Preliminary P.U.D. Plan for Cardinal Ridge dated
May 12, 1993.
2. To reduce the sideyard setback for all buildable lots in the P.U.D. to be no less than five
(5) feet for the garage.
3. A sidewalk shall be installed the entire length of Crossandra Street.
4. The trail connecting Outlots Band D contain a sidewalk alternative.
5. The Developer be allowed to plant the total required front yard trees of all lots in
clustered locations throughout the P.U.D. as approved by the Parks Department.
6. Reduction of lots to satisfy the maximum number of eighty (80) foot frontages in Block
8, Block 11, Block 14, Block 15 and readjustment of the flag lot proposed for Lot 13,
Block 7, but in no event shall the width be less than seventy (70) feet The redesign
resulted in a total of 47 lots with a lot width of less than 80' in accordance with the

dissenting opinion. Planner Graser presented a plat of the proposed
area and stated that the Developer Is requesting a five foot side yard

varlance for all. Discussion occurred regardIng the smaller lot
dimensions for the 46 lots, set back deviations to garages and tree
dusters, trail system and cul-de-sacs. Coundlmembers expressed
ooncern regarding stonn water and sanitary sewer easements. Rick
Packer, representing the Sienna Corporation, explained the reasoning
for tree dustering as opposed to spreading them throughout
subdivision. Discussion occurred on bennlng along Flshpolnt Road,
notification of buyers who purchase land adjoining the proposed
parkland, the overall five yard set back and the need for a master park
plan. Another topic of discussion was the proposed Island In
cul-de-sacs and who would be responsible for future maintenance of
them, traffic on CR 44 and future plans for signalization.

CARDINAL RIDGE
Project Overview
Cardinal Ridge is a Planned Unit Development approved by the City of Prior Lake. The site
is located directly south of the Prior Lake High School on the east side of the community and
directly north of Markley Lake.
Cardinal Ridge consists of 223 single family lots on 147 acres. The site plan was developed to
accommodate the site's natural features by protecting natural wetlands, steep slopes, existing
vegetation stands and Markley Lake. These natural areas are located in outlots which will be
dedicated to the City of Prior Lake, who will own and maintain them. Besides preserving and
protecting the natural features of this site, these outlots will also function for stormwater
retention and park purposes. The largest outlot, located on the west side of Cardinal Ridge,
will be made up of wetlands and stormwater ponding on the north half and an active
neighborhood park on the south half.
A trail system is planned through a majority of the outlots, eventually leading to Markley
Lake. This trail system will be installed by the project developer and funded by the City of
Prior Lake. A sidewalk which will connect to the future trail system, will be installed the total
length of Crossandra Street by the project developer. In addition, a sidewalk and bike trail
will be installed on Fish Point Road.
Although formal plans have not been developed by the City of Prior Lake on the outlots,
prospective homebuyers are encouraged to contact the City Parks Department for additional
information.

The subdivision of Cardinal Ridge presents a very unique
opportunity for the City of Prior Lake in the area of parks,
trails and open space. The First Addition of Cardinal Ridge will
be the impetus to placing these opportunities into reality, not
only for the Cardinal Ridge neighborhood, but for the Brooksville
Hills neighborhood as well.
PARKS AND OPEN SPACE OBJECTIVES
There are several Parks and Open Space objectives that need
to be addressed as part of this subdivision. I will list each of
these seperately and identify how the objectives will be met
during the platting process.
1. MARKLEY LAKE. Markley Lake is the most significant
feature of this subdivision which will attract most of
the attention of the neighborhood. In order to asure
that this feature is available to all residents of the
subdivision, staff has negotiated open space with the
developer so that Markley Lake remains the significant
feature. The trails that have been identified within
the plat will bring people to Markley Lake.
2. NEIGHBORHOOD PLAYGROUND. Within the subdivision, there
is a large parcel of open space that will serve as the
neighborhood park for Cardinal Ridge. This park will
be able to serve as the focal point for future
recreation activities such as summer playground and tot
lot programs. In addition, the neighborhood park will
be within walking distance of both the Cardinal Ridge
and Brooksville Hills neighborhoods.
3. TRAILS AND WALKWAYS. within Cardinal Ridge, there is a
system of trails and walkways designed not only for the
residents of the subdivision, but for the community as
well. Fish Point Road will have sidewalk on one side

and a hiking/biking trail on the other. Crossandra
Street will have a sidewalk that will, eventually
connect to the trail on Franklin Trail to the west and
will bring residents to Markley Lake to the east. The
Parks department will be responsible for a trail on the
southern portion of the subdivision that will link Fish
Point Road with Markley Lake as well as making a
connection from 160th street south to Markley Lake. In
addition, the city will be making a trail connection
from the neighborhood park to the west, through a storm
water management ponding area, eventually linkingup,
once again, with Markley Lake.
4. MARKLEY LAKE COMMUNITY PARK. While in the purist
terms of a community park, this does not have
sufficient acreage to qualify (15+ acres), this open
space in the very southeasterly part of the subdivision
will have community significance. At this location, a
small (25-30 cars) parking lot should be developed so
that residents who don't live in the neighborhood can
have access to this water feature. While the water
quality may prohibit swimming, other activities such as
canoeing, water bikes, picnicing, and hiking/biking
will be very popular in this park. Community access
needs to be provided so that all residents can enjoy
this open space.
5. OUTLOT .E.. This is the remnant portion of the parcel
that should be used as an entry monument for the City
of Prior Lake. In addition, it is at this location
that there should be perhaps an informational kiosk or,
at the very least, informational signs that would point
out the access to the trail and the recreational
opportunities located at Markley Lake. Since it is to
become part of the open space system, it would be
prudent to utilize this space to the best advantage.
All in all, staff is excited about this subdivision. From a
parks and open space perspective, it has it all---trails,
neighborhood park serving two neighborhoods, a water feature,
lots of open space for recreational activities or storm water
management, and a beautiful, wooded, passive recreation area
located on the very southern part of the subdi vision. In
addition, Markley Lake will become a community amenity, not just
available to those who live close by.

WHEREAS, pursuant to an Advertisement for Bids for the improvement of Fish Point
Road from CSAH 44 to 0.31 miles south of CSAH 44 along Fish Point
Road by the construction of grading, storm sewer, aggregate base,
concrete curb and gutter, bituminous surfacing, sidewalks, and appurtenant
work; bids were received, opened, and tabulated according to the law, and
the following bids were received complying with the advertisement:

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that
1. The Mayor and City Manager are hereby authorized to enter into the
attached contract with Enebak Construction Company of Northfield,
Minnesota in the name of the City of Prior Lake for the
improvement of Fish Point Road from CSAH 44 to 0.31 miles south
of CSAH 44 along Fish Point Road contingent upon Minnesota
Department of Transportation State Aid Office plan approval and
final plat approval of Cardinal Ridge First Addition by the
construction of grading, storm sewer, aggregate base, concrete curb
and gutter, bituminous surfacing, sidewalks, and appurtenant work;
according to the plans and specifications therefore approved by the
City Council and on file in the office of the City Manager.
2. The City Manager is hereby authorized and directed to return
forthwith to all bidders the deposits of the successful bidder and the
next two lowest bidders shall be retained until a contract has been
signed.

3. Award of Project 93-05 is contingent upon approval of the project
by the State Aid Office of the Minnesota Department of
