VARIANCE
The Planning Department received an
aJ?plication for an administrative land
d1vision and variance from Jim Dunn who is
represented by Attorney, Bryce Huemoeller.
Attached find the application forms, survey
and supporting materials relative to this
item. The required notifications have been
mailed to contiguous property owners and fee
owners within 100 feet of the proposed subject
site. The DNR and utility companies have been
notified of the variance and administrative
plat applications. Staff has received no
objections from neighbors, the DNR nor any of
the utility companies to the proposed land
division.
The subject site consists of six platted lots
of record. The property is zoned R-l Urban
Residential and is located within the S-D
Shoreland District. The applicant proposes to
re-divide Lots 7 through 12, Block 23 Spring
Lake Townsite into two tracts as indicated on
the attached survey.
The required lot size for new subdivision of
lakeshore property is as follows: Lot area
15,000 square feet; lot width at 904 contour -
75 feet; lot width at front yard setback line
- 90 feet. Proposed Tracts A and B contain
22,500+- square feet and are 75 feet wide at
the front setback line.
The survey indicates that Tract A and B
contain 11,298 and 12,660 square feet of lot
area above the 904 respectively. Subdivision
Ordinance 87-10 Section 6-6-4(F) indicates
that "Any lot abutting or including a wetland,
watercourse or marsh shall have at least fifty
percent (50%) of the minimum lot size for that
district as found in the Zoning Ordinance

feature." Mr. Huemoeller contends that a lot
area variance is not required for this
application. However, lot area has
traditionally been calculated based upon land
above the 904 Ordinary High Water Mark and
it is the opinion of staff that the lake is
not a watercourse as described by the
Subdivision Ordinance. Mr. Huemoeller has
obliged staff and submitted an application for
lot width and minimum lot area variances for
both Tracts A and B.
The entire plat of spring Lake Townsite was
subdivided into 50 foot wide lots. This
neighborhood is characterized by lot
combinations similar to the proposed
subdivision. The Alley in Block 23 was vacated
in 1987 by city Council Resolution 87-61.
Lots 1 through 6, Block 24, located
immediately to the east of the subject site
have been re-divided into two tracts, as
proposed by Mr. Dunn.
Access to the proposed subdivision would be
from Center Road which is an unimproved,
gravel road. Sewer and water services are
located in Center Road which can be utilized
to serve both proposed Tracts. Building
Official, Gary Staber recommends that soil
tests be conducted by the applicant to verify
the existence of adequate building J?ads.
There are no drainage easements platted w1thin
the subject site, therefore the applicant
should also provide a draina~e plan for each
lot as a condition of subdiv1sion approval.
The subject site has been assessed 100% for
sewer and water improvements and a balance of
$4,617.38 remains outstanding. The applicant
may opt to pay the entire balance upon
approval of the administrative division or
split the balance of assessments equally among
each tract. There are seven years remaining
on the assessment term. Approval of this
application should be conditioned upon
immediate filing of the new legal descriptions
with Scott County and subsequent notification
of city staff of the new Parcel Identification
Numbers that will be assigned to both Tracts.

The variance observes the spirit and intent of
the Ordinance in that six substandard lots of
record are being combined into two buildable,
single family lots. Hardship is due to
platting practices of a former government that
no longer conform to current City zoning
standards. The proposed tracts will be larger
in width and area, than the majority of lots
within the neighborhood.
If it is the desire of the City Council to
grant approval of the administrative plat and
variances, it is necessary that two separate
motions be made by the Council.

Dear Mr. Graser:
On behalf of my clients James J. Dunn and Linda M. Dunn, I
hereby request the subdivision of the above tract into two
parcels and enclose the following:
1. Application for Administrative Land Division, dated
April 17, 1991 in 15 copies;
2. Application for Variance, dated April 17, 1991 in 15
copies;
3. Survey of Valley Engineering Co., Inc., dated February
24, 1988, revised February 17, 1989 showing proposed subdivision
in 15 copies; and
4. Check for the filing fees in the sum of $110.00.
Although I question whether a variance is required since each
proposed parcel contains over 22,500 square feet and is 75 feet
wide at the ordinary high water line, I have enclosed the
variance application. If a variance is required, please advise
and we will obtain and furnish the owners with 100 feet of the
property.
The property appears to meet all the requirements in the
zoning ordinance for subdivision, with the possible exception of
the 90 foot width requirement (if that applies since each
proposed parcel will be 75 feet wide at the ordinary high water
line). In particular, the two resulting parcels generally
conform to the shape and area of existing parcels in the
surrounding area; and the adjacent Lots 1 to 6, Block 23, and the
east half of the vacated alley have already been subdivided in a
manner that is comparable to the proposed division of Lots 7 to
12.

Dear Mr. Graser:
This letter is to confirm that I authorized you to modify the
Dunns' application of variance to include a variance as to the
area of the lots to be created by the administrative subdivision,
subject to the condition that the additional request not be
construed as a waiver of the position of the Dunns that in
computing the square footage of their property, they are entitled
to consider all of the property that they own and not just that
portion of the property above the 904 elevation.
This letter also confirms that we have ordered the report of
owners within 100 feet of the property and will have the
abstracter send it direct to you.

PROPOSED ADMINISTRATIVE LAND DIVISION
DATE: Monday, May 13, 1991
The Prior Lake Planning Department has received an application
from James Dunn and Linda Dunn c 0 Huemoeller & Bates of 16670
Frankl1n Tra1l( Pr10r Lake to conS1 er an a m1n1strative land
division withIn the existing plat of lots 7, 8, 9, 10, 11, and
12, Block 23, Spring Lake Townsite. The proposal is to
resubdivide lots 7 through 12 in Block 23 of Spring Lake Townsite
into two buildable lots, as per attached survey.
Section 6-1-3 of the Prior Lake Subdivision Ordinance allows the
City Manager or representative to authorize subdivision approval
without a public hearing under the following circumstances:
1. The division of property will not result in more than three
parcels.
2. The property to be subdivided is a lot of record In the
office of the County Recorder of Scott County.
3. The resulting parcels generally conform to the sha~e and
area of existing or anticipated land subdivisions In the
surrounding areas.
4. The division will not cause any structure to be in violation
of setbacks.
5. Any easements which may be required by the City must be
granted.
6. The owners of land contiguous to the parcel must be notified
in writing and no written objection received within ten days
following notification.
7. Any written objection shall constitute an appeal. Such an
objection shall be forwarded to the City Council who shall
hear the objection and decide the matter.
A copy of the proposed administrative land division and location
map are attached. Please accept this as official notification of
this proposed administrative division. Written comments or
objections regarding this matter should be submitted to the
Planning Department by Friday, May 24, 1991.
Under normal circumstances, if the Planning Department were to
receive no written objections, this proposal would be processed
by staff. However, this application also requires the approval
of 15 foot variances to the minimum width at the front set back
lines, and variances to reduce the required 15,000 square feet of
area above the ordinary high water level. Approval of these
variances will require a hearing before the City Council,
tentatively scheduled for Monday, June 3, 1991. If you have
