The new Minnesota State Building Code
incorporates the same codes as adopted earlier
with one exception. Previously, the
mechanical code was developed by the State of
Minnesota and consequentl~ was enforced only
in Minnesota. The new BU1lding Code adopts a
national code which is the 1988 Uniform
Mechanical Code. The major change between the
two mechanical codes is the requirement in the
Uniform Mechanical Code to establish a
separate mechanical permit and collect a
separate mechanical fee. In the past, the
general building permit fee covered the costs
of mechanical permits and inspections. Under
the new system a mechanical permit will be
issued and a permit fee collected for the
installation of heating, ventilation, and air
conditioning equipment in both residential and
commercial applications. This system will be
very similar to the plumbing permit system
that has been in effect in Prior Lake for
several years.
The proposed fee schedule is outlined below
for mechanical permits. This proposed fee
schedule is identical to the City of
Chanhassen's fee schedule. As you can see the
proposed fee schedule is on a graduated scale.
The higher the cost of the mechanical work
being done, the higher the permit fee.

AN ORDINANCE ADOPTING THE MINNESOTA STATE BUILDING CODE.
The Council of the City of Prior Lake does hereby ordain:
Chapter 1, Buildin9 Code, of Title 4, Prior Lake City Code, is
hereby amended in 1tS entirety to read as follows:

4-1-1: BUILDING CODE: The Minnesota State Building Code
("Code"), established pursuant to Minnesota
Statutes Sections 16B.60 through 168.73, and as may hereafter be
amended from time to time, three (3) copies of which are on file
in the office of the Prior Lake Planning and Inspection
Department, is hereby adopted as the Building Code for the City
of Prior Lake. Such Code, and any future amendments, are hereby
incorporated in this Chapter as completely as if set out in
full.
(A) The adoption of the Code includes the adoption of the
following chapters:

following optional Code provisions:

(C) Section 307(a) of the UBC is hereby adopted, as amended
below:
Section 307(a) - Use or Occupancy. No building or
structure of Group A, E, I, H, B or R, Division 1 and 3
Occupancy, shall be used or occupied, and no change in
the existing occupancy classification of a building or
structure or portion thereof shall be made until the
Building Official has issued a certificate of occupancy
therefor as provided herein.
All new construction in the 1-2 Light Industrial Zoning
District (Prior Lake City Code Section 5-3-3 and Prior
Lake Zoning Ordinance No. 83-6, Section 3.2) shall be
exempt from the provisions of subsection 4-1-1(B)5.
( D)
The organization of the Building Department and
enforcement of the Code shall be as established by
Chapter 2 of the UBC. The Code shall be enforced within
the incor~orated limits of the City, and
extraterr1torial limits permitted by Minnesota
Statutes, 1984.
The Prior Lake Planning and Inspection Department shall
be the Building Code Department of the City of Prior
Lake. The Administrative Authority shall be a State
Certified "Building Official".
The A~pointing Authoritr shall designate the Building
Offic1al for the jurisd1ction of the City of Prior
Lake.
4-1-3: PERMITS, INSPECTIONS AND FEES: Permits,
inspections and collection of fees shall be as
provided in Chapter 3 of the UBC.

4-1-4: SURCHARGE: In addition to the permit fee required
by Section 4-1-3 above, the applicant shall pay a
surcharge to be remitted to the Minnesota Department of
Administration as prescribed by Minnesota Statutes, Section
16B.70.

VIOLATIONS AND PENALTIES:
It shall be unlawful for any person, firm or
corporation to erect, construct, enlarge, alter,
repair, move, improve, convert or demolish, equip, use,
occupy or maintain any buildin9 or structure or cause
or permit the same to be done 1n violation of this
Code.
Any violation of the provisions of this Code is a
misdemeanor, punishable by a fine not to exceed seven
hundred dollars ($700.00) or by imprisonment not to
exceed ninety (90) days, or both.
CASH PAYMENT FOR PARK PURPOSES:
A cash payment, to be reserved for park purposes, shall
be made to the City prior to the issuance of building
permits for construction on unplatted lands or on lands
subdivided or platted prior to February 5, 1973.
The developer of real estate seeking a building permit
shall pay to the City a fee, as determined by the City
Council, for each construction unit.
A standard detached dwelling residence, single family,
shall be considered a standard construction unit. Other
uses shall be charged in accordance with the unit
charges established by the Metropolitan Waste Control
COIIII\l.ssion.

1973, whether or not property in the subdivision has
been donated for park purposes.
All moneys collected hereunder shall be reserved for
public park purposes.
(E)
This ordinance shall become effective from and after its passage
and publication.
