Initially, preliminary plat was~ granted in 1985. However, the final plat was not filed within the one year time frame nor was an extension granted, resulting in the expiration of preliminary plat approval. In August of 1990, Mr. Knoblauch again petitioned for preliminary plat approval which was subsequently granted by both the Planning Commission and Council based on the following eight conditions: 1. Paint the exterior of the buildings. 2. Title opinion be completed. 3. Exterior of building be repaired. 4. Determine whether internal curb was required. 5. The name of the plat be changed to priorview Second Addition. 6. Conditions of the City Engineer be met. 7. Landscape plan must be implemented as approved. 8. The blacktop must be patched and sealed. Mr. Knoblauch contacted Staff to inform us that the only remaining condition - *4 curbs, was finally finished. Staff conducted an inspection which revealed that all site improvements required in the preliminary plat, including the internal curb, have been completed. 1. 2. 3. GRASER, DIRECTOR OF PLANNING CONSIDER REQUEST OF JOE KNOBLAUCH MARCH 18, 1991 Mr. Joe Knoblauch has re9Uested to address the City Council on a prelim~nary ~lat amendment and final plat approval for Pr~or~~a Second Addition. The preliminary plat requires the completion of 8 items (listed below). Mr. Knoblauch is of the opinion that internal curb (item 4) has never been required throughout the process and the blacktopping (item 8) is a maintenance item which should be left to the discretion of the owner. Please refer to August 20, 1990, agenda packet for more information. Prion-a_a-Second Addition, consisting of 20 Townhouses, has had a long and controversial history. The Second Addition was given initial preliminary plat approval under the PUD format in April 1985. The final plat however, was not applied for within the one year time limit, thus resulting in the expiration of preliminary approval. On August 2, 1990, Mr. Knoblauch again petitioned for preliminary approval which was granted by the Planning Commission and subsequently by the City Council on August 20, 1990. Council conditions were as follows: 1. Paint the exterior of the buildings. 2. Title opinion be completed. 3. Exterior of building be repaired. 4. Determine whether internal curb was required. 5. Cn--\""'I""l'cr ALTERNATIVES: RECOMMENDATION: ACTION REQUIRED: Knoblauch argues that his plan does not show curbs. The Council did grant preliminary plat approval on April 1, 1985, with no curb requirement. This results in a confusing direction to Mr. Knoblauch. We should clarify our requirements on curbs. Also, item number 8 has not been completed. It would be impossible to do any blacktop work until May. Mr. Knoblauch feels that since the blacktopping is now 6 years old, maintenance will become an issue. However, he represents that this requirement should not be an item of final plat approval. An option for the Council would be to require that Mr. Knoblauch enter into an agreement with the City of Prior Lake to do the work, with surety to the City, to include a letter of credit or personal check in the amount of the work. 1. 2 . Deny the final plat based on specific findings. Continue the item for additional information or performance. Approve the final plat eliminating items 4 and 8 of the preliminary plat requirements. 3 . Frankly, Staff would like to see this item approved. The major items in your action of August 20, 1990, have been completed. We have spent a great deal of time on this matter and it is time for this item to be completed. That being said, Staff is also conscious of your strong position on August 20, 1990. If you retain that position, please be specific to Mr. Knoblauch so he is aware of his requirements before he can receive final plat approval. Will vary based on Council discussion. The next item considered was Consent Agenda Item (1) _ Consider Approval of Resolution 90-43 and 90-44 Establishing Public Hearing Date and Declaring Cost To Be Assessed For Project 90-12 Toronto Avenue/Tower Street. Anderson explained that the reason for pulling this item froa the Consent Agenda was for the pUrpose of revising the dollar amount to be assessed in the Resolution. The total project cost will remain unchanged. The next order of business ~as: Consider Approval of priorwood P.U.D. Phase 3A Preliminary Plat Amendment. City Manager Unmacht introduced applicant, Joe Knoblauch, 13017 Maywood Lane, Hopkins, MN. Mr. Knoblauch requested the Council to amend four items on the original preliminary plat and asked them to consider deleting the items from the list of 19 contingencies required on the original P.U.D. City Planner Graser presented a short summary of the issue and noted preliminary plat contingencies which had never been performed by the developer. (See staff re~ort for listing of uncompleted contingencies.) Extensive dlScussion Occurred regarding the condition of the development, and ste~s the Council could take to insure that the development lS completed to include much needed site and building improvements. Further discussion occurred regarding item j4 on the Planning Commission's recommendations. City Manager Unmacht clarified the purpose of this item which in essence was meant as a recommendation of concern. Also discussed was the timing of when the title opinion will be required. PHASE 3A APPLICATION, INCORPORATE THE ~ RECOMMENDATIONS OF THE PLANNING COMMISSION, AND ALSO RECOMMEND f>. U. D. THAT THE COUNCIL INCWDE CONTINGENCIES REQUIRING PAINTING OF 'PluMe J~ EXTERIORS IN A CONSISTENT MANNER, A TITLE OPINION, REPAIR OF EXTERIOR TO BUILDINGS (I.E. GARAGE DOORS) AND INSTALL CURBS IF SPECIFIED IN ORIGINAL PRELIMINARY PLAT CONTINGENCIES. (See restated motion on page 4.) Extensive discussion occurred regarding which method the City could use to insure the construction standards of the project be improved, whether in guaranteeing financing the method should be a letter of credit, bonding, or a development a9reement. City Manager Unmacht suggested that Council might conslder including in the motion direction to staff to investigate whether or not a development agreement is in order, and if it is, then process the P.U.D. in this way. Additional discussion occurred regarding the placement of sidewalks and curbs. 3 Minutes Of The Prior Lake City Council August 20, 1990 Councilmember Larson restated the motion to read as follows: LARSON AMENDED THE MOTION, SECONDED BY ANDREN TO APPROVE AMENDED PRIORWOOD P. U . D. PHASE 3A CONTINGENT UPON ITEMS 1 , PIl.~,.o'lL 2, 3, AND 5 OF THE PLANNING COMMISSION RECOMMENDATIONS, THAT P.u.n, STAFF INVESTIGATE WHETHER CURBS WERE REQUIRED BY ORIGINAL ~haj, P.U.D. PLAN, THE EXTERIOR BE UPGRADED TO STAFF'S SATISFACTION BEFORE FINAL PLAT APPROVAL, AND AUTHORIZE STAFF TO DETERMINE THE FINANCING VEHICLE FOR SECURING COMPLETION OF THE CONTINGENCIES. (IT WAS NOTED FOR THE RECORD THAT A TITLE OPINION IS REQUIRED IN THE SUBDIVISION ORDINANCE PRIOR TO FINAL PLAT APPROVAL.) Planner Graser asked a procedural question regarding steps staff should take on this issue. Council concurred that the work should be completed, or there should be financial guarantees in place that the items will be completed before approval of a final plat. Upon a vote taken, ayes by Andren, Fitzgerald, Larson, Scott and White, the motion passed unanimously. A sh~rt recess was taken. The meeting reconvened at 8:45 p.m. The next order of business was: Presentation of BusineSS/Office Park Study by Advanced Resources, Inc. - City Manager Unmacht introduced Consultant, Ed Tschida, who reviewed the process use~ to compile the Study. Economic Development Committee Chairman, Bob Barsness, and Planning Commission Chairman, Tom Kedrowski, briefly discussed their recommendations on the Study to the Council. Discussion occurred regarding the various area locations suggested in the Study. County resident Lisa Shaw, 17410 Revere Way, expressed concern over the possible annexation and its possible effect on their property values. Council concurred that they needed time to review the Study and conduct a joint workshop to discuss the report with the Planning Commission and the Economic Development Committee. General consensus was that a workshop should be held sometime in October before placing it on the Agenda for discussion.
