CONSIDER APPROVAL OF PARTICIPATION IN THE
SOUTHWEST METRO DRUG TASK FORCE
November 4, 1991
Drug abuse is one of the most important issues
concerning the general health and welfare of
our country during the 1990's. Many
approaches are being employed in
communities to discourage the use of dru~s.
Besides education, task forces are be1ng
formed to fight drugs on a local level.
Currently there are 27 task forces in the
state active in narcotics investigation.
Monies are available for these task forces
through federal grants that match funds with
local communities. The City of Prior Lake for
the last year has been a member of the
Southwest Metro Drug Task Force.
About two and half years ago, Staff enlisted
the aid of the Southwest Metro Task Force.
This unit was principally operating in western
Hennepin, and Carver Counties. Our department
gave the Southwest Metro Task Force a
motorcycle that was seized in return for
partial services. The City has formally been
involved with the Task Force for one year
(1991). Over the past year staff is very
pleased with the results being achieved with
the Task Force.
This year the police would actively like to
participate again with the Southwest Metro
Drug Task Force. It would compliment programs
such as DARE and complete the circle of drug
~revention and enforcement services necessary
1n Prior Lake.

The 1992 participation fee for the Southwest
Metro Drug Task Force is $8400 and can either
be incorporated into the 1992 budget or
committed out of 1991 contingency funds.

this year's cont1ngency balance. The 1992
budget is tight and sufficient contingency
funds exist to make the $8400 payment this
year. This would be consistent with your
actions in 1990.
A motion to partici~ate in the Southwest Metro
Drug Task Force is 1n order with funds for
1992 allocated out of the 1991 contingency
balance.

Consider Approval of Payment for Drug Task
Force - On August 6, 1990 the City Council
passed Resolution 90-42 which allowed the City
of Prior Lake to participate in the Southwest
Metro Drug Task Force. The City Council
agreed that monies should be taken from the
1990 contingenc~ fund to finance the 1991 Drug
Task Force comm1tment. Currently there is a
balance of $67,223.00 in the fund. After
paying Prior Lake's share of $8,000.00 to the
Task Force, $59,223.00 would remain in the
contingency fund. A motion as part of the
consent agenda to pay for the Task Force with

Consider Ap~roval of Tax Levy Resolution 90-56
- Attached 1S the final ad valorem tax levy
Resolution certifying Prior Lake's property
tax levy to Scott Countf. The amount is
equivalent to the Prelim1nary certification
and the tax dollars approved by the City
Council within the 1991 Operating Budget. As
indicated upon the Resolution, approximately
10% of the total levy is project debt related
and the remainin9 90\ reserved for general
budgetary expend1tures. A motion as part of
the consent agenda is in order to approve
Resolution 90-56.

SOUTHWEST METRO DRUG TASK FORCE
JOINT POWERS AGREEMENT
January 1, 1992 - December 31, 1992
THIS AGREEMENT is made by and between Carver County,
Scott County, South Lake Minnetonka Public Safety, Chaska,
Chanhassen, Shakopee, Mound, St Boni/Minnetrista and Prior
Lake through their respective law enforcement agencies.
WHEREAS, MN Statutes 471.59 provides for the joint
exercise of powers by two or more governmental units and
specifically allows for joint exercise of police power;
WHEREAS, the Southwest Metro Drug Task Force has been
created by the parties for the interdiction of drug
traffickers and street-level dealers in the named
jurisdictions;
NOW, THEREFORE, in consideration of the mutual
promises contained herein, the parties agree as follows:
I.
PURPOSE
The purpose of the Southwest Metro Drug Task Force is
to provide a comprehensive and multi-jurisdictional effort
to reduce drug trafficking and eliminate local
street-level dealers through the coordination of law
enforcement agencies.
Once established and funded, the Task Force
operations are to be coordinated by the South Lake
Minnetonka Public Safety Department.
Agents will be licensed police officers paid through
the Task Force fund comprised of pooled local and federal
monies. Agents will act as gathers of information.
Offenses taking place in a specific jurisdiction will
involve the prosecution of those individuals by that
jurisdictions attorney. Agents will have discretionary
powers of arrest in all jurisdictions.
Pursuant to MN Statute 471.59, subdivision 12, agents
licensed as Minnesota police officers may cross
jurisdictional boundaries for the purpose of gathering
information for the successful completion of their cases.
II.
FUNDING
The Task Force is to be funded by a combination of
federal money, state money, donations and forfeited money.
South Lake Minnetonka Public Safety, on behalf of the
parties, has applied for and anticipates receiving a
federal grant in an amoun~ yet to be determined.
The grant amount, plus a cash contribution not to
exceed $10,000.00 from each municipality shall be
transferred to South Lake Minnetonka Public Safety for the
administration of the Task Force. Funds may be dispersed
by the South Lake Minnetonka Public Safety, for purposes
including, but not limited to, pensions payments,
insurance and other cost, according to applicable State
law and with the agreement of the parties. The books,
records and documents relevant to this agreement shall be
subject to audit by the parties or the State of Minnesota
at reasonable times upon written notice. Strict
accountability of all funds, receipts and disbursements
shall be provided for.
III.
TERM
This agreement shall commence January 1, 1992 and
terminate December 31, 1992.
IV.
LIABILITY
All worker's compensation and civil liability claims
will be handled by the jurisdiction in which the agent is
employed.
V.
DISTRIBUTION OF PROPERTY
All forfeitures of property, money and other assets
will be divided equally among participating agencies at
the termination of the program. All permanent equipment
purchased through the program shall be shared by the
participating agencies on a need basis during and after
program termination.
VI.
GENERAL PROVISIONS
This program is to be administered under the
jurisdiction of the Bureau of Criminal Apprehension. All
activities are to be consistent with and subject to the
grant application (attached and incorporated by
reference), as well as applicable state and local laws.
