CONSIDER APPROVAL OF A RESOLUTION APPROVING
THE APPLICATION FOR OFF-SITE LAWFUL GAMBLING
FOR THE PRIOR LAKE OPTIMIST CLUB
Current Circumstances
The State of Minnesota requires a municipality to adopt a resolution
approving the application of an off-site lawful gambling permit for
organizations that have premise permits within the city limits. State
law allows premise permit holders to conduct lawful gambling off site
for up to twelve consecutive days in a year. The Prior Optimist Club is
applying for an off-site lawful gambling permit in order to sell pull-
tabs during Lakefront Days, July 30-31, 2003 and August 1-3, 2003.
Pull-tab sales would be conducted in the entertainment tent. The Prior
Lake Optimist Club currently has premise permits for Holly wood Bar
& Grill and Extra Innings Saloon.
The Issues
The Prior Lake Optimist Club has provided the necessary documents
for this permit and has paid the $10.00 application fee. The Prior Lake
Police Department has found no ordinance violations or other reason
to deny the permit request.
The City Council has the following alternatives:
1. Adopt the proposed off-site lawful gambling permit resolution.
2. Deny the off-site lawful gambling permit request.
Staff recommends Council approve the off-site lawful gambling permit
for the Prior Lake Optimist Club for July 30-31,2003 and August 1 -
3,2003, to be held at Lakefront Park during Lakefront Days.

WHEREAS,
the State of Minnesota requires that a municipality adopt a resolution in support of
an organization to conduct off-site lawful gambling of their premise permit, and
WHEREAS,
the State of Minnesota Gambling Control Division allows premise permit holders to
conduct lawful gambling off-site for up to twelve consecutive days, and
WHEREAS,
the Prior Lake Optimist Club is requesting approval of their off-site lawful gambling
permit, and
WHEREAS,
the Prior Lake Optmimist Club is planning to sell pull-tabs during Lakefront Days,
July 30, 31, 2003 and August 1, 2, 3, 2003 in the entertainment tent at Lakefront
Park.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that the Prior
Lake Optimist Club is hereby approved to conduct off-site lawful gambling at Lakefront Park July 30,
31, 2003 and August 1, 2, 3, 2003 upon approval by the Gambling Control Division of the State of
Minnesota.

CONSIDER APPROVAL OF TWO RESOLUTIONS
APPROVING PRIOR LAKE OPTIMIST PREMISE PERMITS
FOR LAWFUL GAMBLING

Under state statute the City has the right to deny lawful gambling
permit requests with respect to pulltabs. The City has received a
renewal request from the Prior Lake Optimist Club for pulltab premise
permits for Hollywood Bar & Grill and Extra Innings Saloon.
The Issues
The Prior Lake Optimist Club has provided the City with the required
documents and has paid the $200.00 renewal fee ($100.00 for a
premise permit at each location). The Prior Lake Police Department
has completed its investigation of this organization and has found no
reason to deny these permit renewal requests.
The City Council has the following alternatives:
1. Adopt the proposed premise permit resolutions.
2. Deny the premise permit renewal requests.
Staff recommends Council approve the renewal of premise permits for
the Prior Lake Optimist Club for Hollywood Bar & Grill and Extra
Innings Saloon.

an organization to conduct lawful gambling at a particular premise, and
WHEREAS,
the Prior Lake Optimist club is requesting renewal of their lawful gambling permit,
and
WHEREAS,
the Prior Lake Optimist Club has been conducting lawful gambling at the premises
of Hollywood Bar & Grill, and
WHEREAS,
the Prior Lake Optimist Club's previous gambling licenses will expire.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that the Prior
Lake Optimist Club is hereby approved to conduct lawful gambling at the premise of Hollywood Bar &
Grill for a period of two years effective upon approval by the Gambling Control Division of the State of
Minnesota.

LICENSE FOR PRIOR LAKE CHAMBER OF COMMERCE

The Prior Lake Chamber of Commerce is requesting a temporary 3.2
liquor license in order to sell 3.2 beer at Lakefront Days. They have
requested, and been granted a temporary 3.2 liquor license in past
years. The Chamber of Commerce will be selling 3.2 beer in the
entertainment tent located at Lakefront Park from 5:00 P.M. to 10:00
P.M. on Friday, August 1,2003, from 12 P.M. to 12:00 A.M. on
Saturday, August 2, 2003, and from 12:00 P.M. to 5:00 P.M. on
Sunday, August 3, 2003.
The Issues
Dram shop insurance will be carried through Prior Lake State Agency.
The Prior Lake Police Department has found no reason to deny the
application. The Chamber of Commerce will pay to have a security
officer present at the tent on all days of the event.
The City Council has the following alternatives:
1. Adopt a motion as part of the consent agenda approving the
temporary 3.2 liquor license for the Prior Lake Chamber of
Commerce.
2. Deny the temporary 3.2 liquor license request.
Staff recommends Council approve the temporary 3.2 liquor license
for the Prior Lake Chamber of Commerce for the period of August 1,
2003 through August 3, 2003.
