HomeMy WebLinkAbout9C - Wilds PUD Amend & Rezone MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT JUNE 2, 2003 9C JANE KANSIER, PLANNING COORDINATOR CONSIDER APPROVAL OF A RESOLUTION APPROVING AN AMENDMENT TO THE WILDS PUD AND APPROVAL OF AN ORDINANCE APPROVING A REZONING FROM PUD TO R-4 FOR OUTLOTS I AND J, THE WILDS (Case File #03-034 & 03-35) History: The City Council has previously approved an amendment to the Comprehensive Plan consistent with this request. Shamrock Development has filed an application for an amendment to The Wilds Planned Unit Development to remove 8 acres from the PUD and to rezone those 8 acres from The Wilds PUD to R-4 (High Density Residential). The property is located on the east side ofCSAH 83, 1//4 mile south ofCSAH 42, and directly north of Wilds Parkway. This property is presently zoned C-4 PUD (Low Density Residential) and C-4 (General Business-The Wilds Planned Unit Development) and is designated as C-HG (Hospitality General Business) on the 2020 Comprehensive Plan Land Use Map. The Planning Commission recommended approval of a request to amend the Comprehensive Plan for this site to R-HD (High Density Residential) on April 28, 2003. The City Council considered and approved the Comprehensive Plan amendment on May 19,2003. The Wilds original PUD plan identified this area for commercial uses, specifically a hotel. This site was also the location of the original sales building, which has since been removed, for the development. At this time, the applicant is planning to develop these 8 acres in conjunction with the property to the north in The Wilds North, already planned for High Density Residential uses. On May 12,2003, the Planning Commission held a public hearing to consider this proposal. Current Circumstances: The total site consists of approximately 8 acres. The north half of the site is vacant land. The south half of the site was the site of the original sales building for The Wilds. This portion ofthe site is wooded. Access to this property is presently from Wilds Drive. The site will be developed in conjunction with the property to the north. The access will be a part of this development. Sewer and water services are also available to this site from the existing services in Wilds Drive. Adjacent to this property on the north is vacant land, currently zoned C-2 and designated for High Density Residential uses. To the south and east is The Wilds golf course, presently zoned R-l PUD, and designated as R-L/MD. To the west, across CSAH 83, is vacant land, zoned Agricultural and designated as C-HG. On May 19,2003, the City Council approved an amendment to the 2020 Comprehensive Land Use Plan designating this property for High Density Residential uses. This amendment must still be reviewed by the Metropolitan Council before it is official. The applicant has submitted this rezoning application in anticipation of that approval. The Issues: There are two separate applications included in this proposal. AMENDMENT TO THE WILDS pun PLAN: The amendment to the PUD plan removes 8 acres of commercial development from the overall PUD plan, and reduces the overall land area ofthe PUD from 580.4 acres to 572.1 acres. The proposal does not reduce the number of dwelling units in the PUD plan. Removing this land will increase the overall density from 1.13 dwelling units per acre to 1.14 dwelling units per acre. REZONING FROM THE WILDS pun TO R-4: Outlots I and J, The Wilds, consist of 8 acres and are currently zoned PUD. Ifthe above amendment to the PUD is approved, the developer is requesting this area be zoned R-4. Section 1108.600 of the Zoning Ordinance identifies the following policies for amendments to the Official Zoning Map: . The area, as presently zoned, is inconsistent with the policies and goals of the Comprehensive Plan, or the land was originally zoned erroneously due to a technical or administrative error, or 1:\03 files\03 rezone\wildsouti&j\cc report. doc Page 2 CONCLUSION: FISCAL IMPACT: ALTERNATIVES: RECOMMENDED MOTION: . The area for which rezoning is requested has changed or is changing to such a degree that it is in the public interest to rezone so as to encourage redevelopment of the area, or · The permitted uses allowed within the proposed Use District will be appropriate on the subject property and compatible with adjacent properties and the neighborhood. The property is currently designated as C-HG (Hospitality General Business) on the 2020 Comprehensive Plan Land Use Map. Presumably, this designation will be amended to R-HD as requested by the applicant and recommended by the Planning Commission. If this is the case, the R-4 district is consistent with this designation. The impact of the density ofthe proposed townhouse development on the adjacent streets and other public infrastructure will be less than the original hotel proposed as part ofthe PUD. The overall density is consistent with the original PUD plan, and with the Comprehensive Plan. The Planning Commission and the staff recommend approval of this proposal. The ordinance approving the rezoning from PUD to R-4 cannot be published until the Metropolitan Council has approved the amendment to the Comprehensive Plan. Budf,!et Impact: There is no budget impact as a result ofthis action. Approval of the project will facilitate the development of the area and increase the City tax base. The City Council has three alternatives: 1. Adopt a resolution approving the amendment to The Wilds PUD and adopt an ordinance 00- XX approving the zone changes as requested. 2. Deny the PUD amendment and rezoning on the basis they are inconsistent with the purpose and intent of the Zoning Ordinances and/or the Comprehensive Plan. In this case, the Council should direct the staff to prepare a resolution with findings of fact based in the record for the denial ofthese requests. 3. Defer consideration ofthis item and provide staffwith specific direction. The staff recommends Alternative # 1. REVIEWED BY: 1:\03 files\03 rezone\wildsouti&j\cc report. doc Page 4 RESOLUTION 03-XX RESOLUTION APPROVING AN AMENDMENT TO THE WILDS PLANNED UNIT DEVELOPMENT MOTION BY: SECOND BY: WHEREAS: Shamrock Development has submitted an application to amend the approved development plan for the Wilds Planned Unit Development Plan by removing Outlots I and J, The Wilds, from the approved PUD plan; and WHEREAS: The Prior Lake Planning Commission considered the proposed amendment at a public hearing on May 12,2003; and WHEREAS: The Prior Lake City Council considered the proposed amendment to the approved development plan for The Wilds PUD on June 2, 2003; and WHEREAS: The City Council finds the amendment to The Wilds PUD consistent with certain elements of the Comprehensive Plan and the Zoning Ordinance; and WHEREAS: The City Council finds the amendment is in harmony with both existing and proposed development in the area; and WHEREAS: The City Council finds the amendment does not significantly affect the approved overall density of the PUD; and WHEREAS: The City Council finds the amendment is compatible with the stated purposes and intent of the Section 1106 Planned Unit Developments of the Zoning Ordinance; and WHEREAS: The City Council finds the proposed amendment adequately provides for internal organization, uses, circulation, public facilities, recreation areas and open space. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, 1. It hereby approves the amendment to The Wilds Planned Unit Development. 2. Cases #03-034 and 03-035 Shamrock Development is requesting an Amendment to The Wilds PUD to remove 8 acres - Outlots I and J and Rezone from Planned Unit Development (PUD) to High Density Residential (R-4). Planning Coordinator Jane Kansier presented the Planning Report on file in the office of the City Planning Department. Shamrock Development has filed an application for an amendment to The Wilds Planned Unit Development and for a rezoning from The Wilds PUD to R-4 (High Density Residential) on approximately 8 acres of property located on the east side of CSAH 83, 1//4 mile south ofCSAH 42, and directly north of Wilds Parkway. The proposal removes the 8 acres from the PUD and rezones the property to R-4. This property is presently zoned C-4 PUD (Low Density Residential) and C-4 (General Business-The Wilds Planned Unit Development) and is designated as C-HG (Hospitality General Business) on the 2020 Comprehensive Plan Land Use Map.
