Consent Agenda: a) Consider Approval of Invoices To Be Paid see attached 0 b) Consider Approval of First Quarter Budget Report - see attached report 0 c) Consider Approval of 1990 Financial Report Attached for your review is the 1990 Financial Report as prepared by the George Mo Hansen Companyo A summary of the City's financial condition and fund highlights are presented under the beginning section entitled "Comments" on pages I-Vo As noted within the General Fund, revenues exceeded expenditures b~ $81,721.00 in 1990 thereby increasing the Clty's fund balance to $1,496,3580000 As recommended by the League of Minnesota cities this year, a portion of the Fund Balance has been designated as working capitalo This recommendation is based upon the Legislature's interest in reviewing municipal fund balances during the 1991 sessiono The amount reserved for such purpose is $1,000,000. This is necessary to provide a cash flow during the first half of the year before the City receives its tax settlements and state aids. City Manager Unmacht requested that this item be removed from the Agenda 0 Unmacht stated that it would be placed back on the Agenda as soon as Staff's work is completed. Council concurred. The next order of business was: Consider Approval of Annexation Agreements. City Manager Unmacht reviewed actions taken at the April 1, 1991 Council meeting and turned the meeting over to City Planner Grasero Mro Graser reviewed changes incorporated in the Amended Annexation Agreement, Exhibit B and the Joint Agreement between New Century Construction and the City of Prior Lake 0 Discussion occurred with regard to wording of the documents: specificall~, which portion of Mushtown Road would be included in the annexat10n, the accurate legal description of the property and the current fee owner, access to Mushtown Road by property owners alon9 the portion annexed, maintenance of Mushtown Road, extent and tlming of overlay improvement, and payment date of the required reimbursement 0 A short recess was calledo The meeting reconvened at 8:35 porno A short discussion occurred regarding the payment date of the required reimbursement 0 (New Century Construction officials declared that the stated date of December 31, 1991 was acceptable.) Further discussion occurred on the percentage of the annexed portion of the Mushtown Road improvement cost to be shared between New Century Construction and the City of Prior Lake and who would be responsible for paying the engineering and soil boring costso Council concurred that the engineering and soil boring costs should be part of the project cost and included in the agreement. Upon a vote taken, ayes by Andren, Fitzgerald, Larson, Scott and White, the motion passed unanimouslyo 2 Minutes of The Prior Lake City Council April 15, 1991 MOTION MADE BY FITZGERALD, SECONDED BY LARSON, TO APPROVE THE AGREEMENT BETWEEN THE CITY OF PRIOR LAKE AND NEW CENTURY CONSTRUCTION AS AMENDED 0 Upon a vote taken, ayes by Andren, Fitzgerald, Larson, Scott and White, the motion passed unanimously. The next order of business was: Consider A~proval of Council Workshop Outlineo City Manager Unmacht distrlbuted copies of the proposed agenda and stated that in an effort to cut costs he would be acting as facilitator and that this workshop would be a task oriented workshop 0 Council discussed materials they would need for the workshop and general consensus was to approve the outline. The next order of business was: Consider Approval of Resolution 91-15 Directing City Engineer to Prepare a Feasibility Study for Phase 1 of the City-wide Trail System. Director of Parks and Recreation Mangan presented details of the bike and hiking trails as designed "in house" and proposed by the Parks Advisory Committee 0 Mangan displayed a map depicting the proposed trailways and discussed the area to be included in the feasibility study 0 A short discussion occurred regarding the linkage of trails from CR 21, to Lakefront Park and long range plans for the trail system along CR 42 and Highway 130 MOTION MADE BY FITZGERALD, SECONDED BY SCOTT, TO APPROVE RESOLUTION 91-15 DIRECTING CITY ENGINEER TO PREPARE A FEASIBILITY STUDY FOR PHASE 1 OF THE CITY-WIDE TRAIL SYSTEM. Upon a vote taken, ayes by Andren, Fitzgerald, Larson, and White, the motion passed unanimously 0 Parks and Recreation Director Mangan discussed the City's plans to commemorate Earth Day (April 20) and Arbor Day (April 26). On Monday, April 22, Westwood Elementary and Five Hawks Elementary students in cooperation with the City will be planting trees in recognition of Earth Dayo Ma~or Andren will issue a Proclamation proclaiming the City of Pr10r Lake as a Tree City USAo Mangan invited all Councilmembers to attend these ceremonieso Scott The next order of business was: Discussion on Metropolitan Council's Action on County Road 18 Bloomington Ferry Bridge Interchange 0 city Manager Unmacht introduced the new District 14 Metropolitan Council Representative, Bonnie Featherstone, who was present at the meeting. Unmacht explained that this item was on the agenda in order to allow Council discussion of the Metropolitan Council's actiono Unmacht handed out an analysis of free standing growth centers and developing areas compiled by the Planning Department. Councilmember Larson led a discussion on a draft of a ten step plan to be taken by Council and staff with regard to the Bloomington Ferry Bridge/C.R. 18 Interchange problem. 3 Minutes of The Prior Lake City Council April 15, 1991 1. Staff continue efforts in working with the Metropolitan Council, especially District 14 Representative, Bonnie Featherstone, and Metropolitan Council staff. 20 City staff should attempt to secure from the Metropolitan Council, in writing, identification of the specific changes which must occur in order for the access to be built and a written commitment from them that if these changes occur they will overturn their initial decisiono 30 Direct City staff to organize an effort by the City Council, staff and local citizens wherein we all participate to press politically through active and direct communication with elected and appointed officials to persuade them of the great need for complete, safe and direct access to the Bloomington Ferry Bridge. 40 City of Prior Lake secure a commitment from jurisdictions supporting our position and request help, aid and assistance in accomplishing objective 0 50 Communicate with our citizens about this problemo Begin with an open letter to the citizens of Prior Lake from the Mayor and City Council informing them of the situation and requesting their help in communicating with elected and appointed officialso other their our 6. Council is gravely concerned over the impact that Metropolitan staff recommendations will have on our investment and infrastructure 0 We have considerable dollars invested in infrastructure in this community on the north side in anticipation of that bridge and easy access to the bridgeo 4 Minutes of The Prior Lake City Council April 15, 1991 Council directs the City attorney to research the possibility of litigation to determine whether or not some of that investment is recoverable in the event we are denied complete, safe and direct access to the Bloomington Ferry Bridgeo Determine if the action of the Metropolitan Counc1l was within their appropriate legal framework. 10. Consider instituting legislative changes through our elected officialso Discuss with them the feasibility of a "bill" to be introduced which would effectively over rule the Metropolitan Council's decisiono Extensive discussion occurred regaring the action taken by the Metropolitan Council with regard to the Bloomington Ferry Bridge/CR 18 access and the directives as listed aboveo Metropolitan Council District 14 Representative, Bonnie Featherstone, addressed the Council and expressed her view of the situation and made several suggestions regarding possible action the City could take. The Council requested City Manager Unmacht to fine tune the draft plan and resubmit to Council on May 6 for final approval 0 The following topics discussed under Other Business were: City Manager Unmacht announced that 20 reservations have already been received for the star cities Awards presentation on May 1 at the Hollywood Inn. Staff announced that June 6 is Volunteer Appreciation Day at Memorial Park. The event will be in conjunction with a picnico City Manager Unmacht stated that the North Shore Oak assessment trial will be conducted on Wednesday, April 17 at the Scott County Court Houseo The League of Minnesota Cities Conference will be June 11 through June 140 Unmacht sought feed back from the Council on who was interested in attending the Conference this year.
