AND CONSIDER RESOLUTION 91-20 ORDERING
PREPARATION OF REPORT ON IMPROVEMENT

The purpose of this Agenda item is to
authorize the preparation of a Feasibility
Study for improvements to the Town Center
areao
In 1990, the Economic Development Committee
and city Staff worked with the Town Center
business people to determine if a
Redevelopment Project would benefit the
business climateo A series of meetings were
conducted and as a result, a petition was
received for improvements 0 The petition was
presented at the AU9ust 6, 1990 city Council
Meetingo The petitlon was not approved at
that meeting because one of the property
owners withdrew their signature, thus
invalidating the petitiono
A new petition has~been receivedo The
petition represents ~ of the assessable
frontage of the property area from Pleasant
Street to the lower entrance to Lakefront Park
(five hundred feet south of CSAH 44.) This
does not include the City property which is
29% of the project areao The attached
petition incorrectly describes the project
area as between Pleasant Street to CSAH 440
In past meetings with the Town Center
merchants, the intent of the project area has
been to stop the project at the south entrance
to Lakefront Parko This would allow the
intersection of T.Ho 13jCSAH 44 and Main
Avenue to be relocated in the future without
disrupting improvements made as part of this
projecto

RECOMMENDATION:

association to re-circulate the petition with
an amended ~roject area description or to use
the city in1tiated petition format 0 The Town
Center Association has met the intent of
initiating the process by presenting the
petition. At this point, Staff and the
Association believe that the intent of the
petition has been met, and that by utilizing
the City initiated format, the Feasibility
Study be authorized to be prepared 0 Clearly,
this is a project that has been initiated by
the property owners. This also would
eliminate the need for the City to publish the
petition for adequacy. In addition, the City
initiated procedure will reduce the potential
challenges to the petitioning process.
The petition requests that the City prepare
cost estimates on three alternatives and
present those to the Town Center Associationo
Staff's intent is to work closely with the
Association to determine what improvements
would be supported by the Town Center
Associationo It is anticipated that a number
of alternatives will be required prior to
developing one which has the support of the
majorit~o This would be completed prior to
presentlng the Feasibility study to the City
Council.

The recommendation is to accept the petition
from the Town Center Association, and
recognize that the intent of the study is to
stop at the south entrance to Lakefront Parko
The recommendation also is to use the
City initiated form of Resolution to
authorize a Feasibility study. The Town Center
supports this so that the petition does not
have to be recirculated. Some of the Town
Center members believe that recirculating a
petition would be counterproductive to their
efforts to initiate a Feasibility Study. The

RESOLUTION ORDERING PREPARATION OF REPORT ON IMPROVEMENT

WHEREAS, it is proposed to improve Main Avenue from Pleasant
Street to a point 500 feet south of ToH. 13 by the
construction of sidewalk, lighting, storm sewer,
bituminous surfacing, concrete curb and gutter and
appurtenant work, and to assess the benefitted property
for all or a portion of the cost of the improvement,
pursuant to Minnesota Statutes, Chapter 429.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
PRIOR LAKE, MINNESOTA, that the proposed improvement be referred
to the City Engineer for study and that he is instructed to
report to the Council with all convenient speed advising the
Council in a preliminary way as to whether the proposed
improvement is feasible and as to whether it should best be made
as proposed or in connection with some other improvement, and the
estimated cost of the improvement ~ recommendedo

Dear Dave,
This letter shall serve as a review of our February 8th,
1991, meeting with youo Where as, the TownCenter Assn and
the City of Prior Lake,have agreed to the process of
redevelopment for the TownCenter areao The three step
process is as follows:
step 1 The undersigned petitioners have agreed with the
TownCenter Association that they will be actively
involved in the design of a possible redevelopment
projecto . It is the intent of the TownCenter
committee to present 3 different scenarios of what
should be included on an artist sketching which will
then be presented to city Staffo
step 2 After reviewing all 3 sketches, an overlay drawing
would probably be the best method of showing the 3
separate ideas, the TownCenter will then request
feasibility studies done on all 3 scenarioso
step 3 Following the review of the feasibility
studies by all interested parties, and after a
design has been selected by the majority of
interested parties, it would be our intent to seek
the support of the majority of the property owners,
50% or greater to proceed to implementation of the
redevelopment project.
The Association is looking forward to a New Look in our
TownCenter areao Let's hope through our cooperative efforts
it will become a reality!

FOR
REDEVELOPMENT
WeJ the undersignedJ hereby petition to the City
of Prior Lake to support the TownCenter Association in
a plan of redevelopment for Main Avenue in Prior Lake.
The area to be redeveloped would include all of Main
Avenue from Pleasant Street to the intersection of
County Road 44.
The redevelopment would consist of minor storm
sewerJ repavingJ curb and gutter) decorative lighting)
treesJ park benchesJ flower potsJ and decorative
disposal facilities. Replacement of existing sidewalksJ
(at some areasJ the side walks would be expanded in
width to accomodate the treesJ lights and benchesJ etc.) ,
increased parking facilities by returning Main Avenue to
angled parking in areas we all feel appropriate (City and
Association).
The intent of this petition is as follows:
1) Request the City Council to support the TownCenter

area in the design work in the form of a overhead
view plan (i.e.. artist sketch),

thorough review and acceptance of the plans by
the TownCenter Association Redevel,opment Committee

hereby requests the City Council to proceed with
feasibility study based on the above mentioned
plans.
We wish to request the Council to consider a SO/50
split for the street improvements (50% to be paid by the
property owner and 50% to be paid by the City). Sidewalk
and landscaping cost are assessed at a rate of 100% cost
to the property owner. Lighting would be assessed to the
City at 100%. Alternate forms of financing will be
considered with City Staff.

The intent o( thlB letter is for further clarification
of the area the petitioners wish to redevelop in out" Town-
center community.
The TownCenter Assrto prepared the original petition for
redevelopmento In the petitIon it 1s stated "The area to be
redeveloped would include all of Main Avenue from Pleasant
st. to the Intersection of County Rd. 440" The actual intent
of the TownCenler Assno was to redevelop all of Haln Avenue
from Pleasant St. thru the last comrnercial parcel, being the
Associate Properties parcel (Prior Lake Auto Body Condos)
and stop thereo
The wording that was entered into the redevelopment
petition by mistake was reprodllced from the standard
"Petition For Local Improvement" which we have enclosQd
with this letter here noted as Exhibit Ao
