APPROVING THE PRELIMINARY PLAT FOR "FARRELL'S
1ST ADDITION"
History: Douglas Farrell has applied for approval of a Preliminary
Plat to be known as Farrell's 1st Addition. The property is located on
the east side of Femdale Avenue and on the north side of Hampton
Street. There is a single family dwelling currently located on the
westerly portion ofthis property.
On September 13, 1999, the Planning Commission considered this
preliminary plat application. The Planning Commission recommended
approval of the preliminary plat subject to the condition that, prior to
final plat approval, the developer must submit a landscaping plan as
required by Section 1007.100 of the Subdivision Ordinance. A draft
copy of the Planning Commission meeting minutes is attached to this
report for your information.
Current Circumstances: The preliminary plat consists of 0.69 acres
to be subdivided into 2 lots for single family dwellings. Lot 1, Block
1, is the site ofthe existing dwelling. Lot 2, Block 1, is the proposed
site of a future dwelling. The proposed lots meet the minimum lot area
and frontage requirements for the R-l district. Lot 1 is 17,084 square
feet with 113.80 feet of frontage, and Lot 2 is 12,899 square feet in
area with 86 feet of frontage.
Access to the lots is from Hampton Street. There is no public right-of-
way or parkland dedicated in this plat. In addition, there are no
required or proposed utilities, including sanitary sewer, water mains,
or storm sewer proposed. These services are located in the road right-
of-way. Sewer and water stubs to serve Lot 2 were installed in
Hampton Street in 1990.
This development is also subject to the Tree Preservation requirements
of the Zoning Ordinance. A tree inventory on Lot 2 has identified 221
caliper inches of significant trees. The developer is allowed to remove
25%, or 55.25 caliper inches, for the building pad and driveway

without replacement. The preliminary grading plan submitted shows
the removal of73 caliper inches, or 33%, for the building pad.
Therefore, the developer will be required to replace 17.75 caliper
inches at a rate of 1/2 caliper per inch for each inch removed. In this
case, replacement of 8.875 caliper inches, approximately 4 trees, is
required. Since all of the tree replacement occurs on the new building
site, this requirement can be included as a condition ofthe building
pennit for the site.
The Issues: The only issue in this preliminary plat is the landscaping
plan. Prior to final plat approval, the developer must submit a
landscaping plan which meets the provisions of the Subdivision
Ordinance.
Conclusion: The Planning Commission concluded the preliminary
plat is consistent with the Subdivision and Zoning Ordinance
requirements. The Planning Commission recommended approval of
the preliminary plat, subject to the following condition:
1. Prior to final plat approval, the developer must submit a
landscaping plan as required by Section 1007.100 of the
Subdivision Ordinance.
Budf!et Impact: Approval of the preliminary plat will allow the
developer to proceed to the fmal plat, which will in turn allow the
construction of one new house. The new house will contribute to the
City's tax base.
The City Council has three alternatives:
1. Adopt Resolution #99-XX, approving the preliminary plat of
Farrell's 1st Addition with the finding that the preliminary plat is
consistent with the intent and purpose of the Comprehensive Plan
and the Zoning and Subdivision Ordinances.
2. Deny the preliminary plat on the basis it is inconsistent with the
purpose and intent of the Zoning and Subdivision Ordinances
and/or the Comprehensive Plan. In this case, the Council should
direct the staff to prepare a resolution with findings of fact for the
denial of these requests.
3. Defer consideration ofthis item for specific reasons.

RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE
PRELIMINARY PLAT OF "FARRELL'S 1ST ADDITION"
MOTION BY: SECOND BY:
WHEREAS: the Prior Lake Planning Commission conducted a public hearing on September
13, 1999, to consider an application from Douglas Farrell for the preliminary
plat of Farrell's 1st Addition; and
WHEREAS: notice of the public hearing on said preliminary plat has been duly published
and posted in accordance with the applicable Minnesota Statutes and Prior
Lake Ordinances; and
WHEREAS: all persons interested in this issue were afforded the opportunity to present their
views and objections related to the preliminary plat of Farrell's 1st Addition for
the record at the Planning Commission hearing; and
WHEREAS: the Planning Commission and City Council have reviewed the preliminary plat
according to the applicable provisions of the Prior Lake Zoning and
Subdivision Ordinances and found said preliminary plat to be consistent with
the provisions of said ordinances; and
WHEREAS the Prior Lake City Council considered an application for preliminary plat
approval of Farrell's 1st Addition on October 4, 1999; and
WHEREAS: the City Council finds the preliminary plat of Farrell's 1st Addition to be
consistent with the 2010 Comprehensive Plan.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PRIOR LAKE, MINNESOTA, that it hereby approves the preliminary plat of
Farrell's 1st Addition subject to the following conditions:
1. Prior to final plat approval, the developer must submit a landscaping plan as required by
Section 1007.100 of the Subdivision Ordinance.
