Attached for Economic Development Authority information is the agenda item the City Council has received relating to the proposed Economic Development Authority tax levy. Also attached is the report which EDA President Barsness will give to the City Council on December 6, 1999. MOTION BY: SECOND BY: WHEREAS, EDA Resolution 99-01 certified a proposed 2000 EDA property tax levy to the Scott County Department of Taxation, subject to City Council approval; and WHEREAS, the City Council adopted City Council Resolution 99-87 certifying the EDA levy for Downtown Redevelopment and directing a public hearing on the matter; and WHEREAS, the EDA adopted Resolution 99-01 with the understanding that the Downtown Redevelopment project report would be complete and a specific project(s) would be identified prior to the public hearing (December 6, 1999) for which the levy funds would be used; and WHEREAS, the Downtown Redevelopment Plan has not progressed to a point where a specific Downtown Redevelopment project has been identified. NOW THEREFORE, be it resolved by the Economic Development Authority for the City of Prior Lake, Minnesota as follows: 1. EDA Resolution 99-01 is hereby rescinded in its entirety, including elimination of the proposed $76,000 levy under Minnesota Statutes 1469.107. 2. The EDA hereby recommends that the City Council rescind its Resolution 99-87 and that consideration of the proposed levy be rescheduled after such time as the Downtown Redevelopment project report is.complete. My name is Bob Barsness. I am President of the Prior Lake Economic Development Authority. I am here this evening to make a presentation about the proposed $76,000 Economic Development Authority Levy to support the downtown redevelopment effort. I. HISTORY: . As the Council is aware the EDA has proposed a $76,000 levy to assist in providing the financial wherewithal to accomplish the downtown redevelopment project. . The levy's specific purpose is to provide funds in addition to current resources to purchase property, raze existing structures, relocate existing owners or provide low interest loans for store front improvements. . The use of public dollars to support such efforts is by no means unique. . Example: Shako pee acquired and cleared the land upon which their retail/multi-family project is located using public funding in the approximate amount of $2.5 million. The funds were TIF funds generated by existing districts. . Example: Savage has recently completed a downtown redevelopment study. Phase I of the downtown project will cost $3.7 million of which $3 million is public money from tax-exempt bonds guaranteed by the full faith and credit of the city. . The point is that both public and private investment is necessary to complete this important community project and the City must take a leadership role to leverage private dollars with public funding from available sources. In the case of Prior Lake, there is very little tax increment available necessitating the consideration of other funding sources. II. CURRENT STATUS: . As you know the Economic Development Authority has enlisted the assistance of the professional firm of Hoisington and Koegler to prepare a detailed downtown redevelopment plan. . The plan preparation process has been intended to be inclusionary. To that end we have had three well publicized and attended workshops. . Through public input we have narrowed three downtown development concepts and three downtown design themes to one of each. L:\99FILES\99EDA \EDACORR\BARSLEVY.DOC 1 ,. . We are now evaluating the impact of the Post Office location in or outside of the downtown and the County traffic signal report for Main Avenue and County Road 21. Each of these issues have significant implications for downtown planning. . Today, however, we are not to the point where I or the EDA wants to be. The study has not progressed to the point where one or more specific projects have been identified toward which the $76,000 EDA levy would be dedicated. . The EDA recognizes that without a specific project to dedicate the levy to, it is best to delay the levy request. III. CONCLUSION: . Therefore, after considerable discussion at our November 29th workshop, the EDA convened a special meeting earlier this evening. At that meeting the EDA adopted a resolution rescinding its proposed levy for 2000. . The EDA's action should not be interpreted as a lack of commitment to the downtown redevelopment plan and program. . On the contrary, we have decided it is better for the well being of the project to delay the levy recommendation until a specific project can be identified. This will occur when the plan is completed this spring. By withdrawing the 2000 EDAlevy request we have: . 1. Provided additional time for specific information to be prepared about the use of the levy funds. . 2. Defused the controversy surrounding this levy and the downtown redevelopment project recognizing that the project's success is not dependent on this levy. . 3. Acknowledged other funding alternatives are available to the EDA in 2000 if resources are required before 2001 to initiate downtown redevelopment efforts. . 4. Provided the opportunity to take additional steps to educate Prior Lake residents and business persons about the project and enlist their support. . 5. Confirmed that for the downtown redevelopment project to be successful both the EDA and the City Council must be in complete support and willing to take the leadership role in funding and project implementation. NEXT STEPS: · The EDA is requesting time on the Annual City Council Workshop Agenda to review the status of the downtown redevelopment plan with the new Council so that adequate information is provided to garner Council support. · Second, the Economic Development Authority requests a place on an upcoming City Council agenda to review the plan 'so that the audience present and the cable television audience can become more familiar with the current status of the project. · On behalf of the Economic Development Authority we thank the City Council for this opportunity to comment upon this key community project. "-r IIY ME AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: ISSUES: ALTERNATIVES: RECOMMENDED MOTION: CITY COUNCIL AGENDA REPORT December 6, 1999 7D Frank Boyles, City Manager PUBLIC HEARING TO CONSIDER PROPOSED ECONOMIC DEVELOPMENT AUTHORITY LEVY AND TO CONSIDER ADOPTING RESOLUTION 99-XX RESCINDING CITY COUNCIL RESOLUTION 99-87. History On August 16, 1999, the City's Economic Development Authority adopted Resolution 99-01 declaring their desire to levy a $76,000 property tax under Minnesota Statutes 1469.107. On September 7, 1999, the City Council adopted Resolution 99-87 relating to the Proposed 2000 City of Prior Lake Economic Development Authority property tax levy. The Resolution acknowledges the ability of the EDA to levy a property tax under Minnesota Statutes 1469.107 in the amount of $76,000 with the City Council's concurrence. This Resolution has been filed with Scott County and the levy is incorporated in residential truth-in-taxation notices. The Resolution also calls for a public hearing to be conducted on the levy. The hearing is scheduled for December 6th at 8pm and has been noticed in the Prior Lake American. Current Circumstances The EDA action to propose the levy occurred at their August 16, 1999 meeting by EDA Resolution 99-01. The understanding at that meeting was that by December 6th, the Downtown Redevelopment Plan report would be concluded and specific project(s) would be identified toward which the funds would be used. The study has not progressed to the point where a specific Downtown Redevelopment project has been identified. Therefore, the EDA, at its November 29th workshop, reached a consensus that the request for the levy should be deferred. At a special EDA meeting held December 6, 1999, the EDA rescinded its Resolution 99-01. Conclusion EDA President Bob Barsness will make a presentation to the City Council more clearly identifying the EDA's rationale for the proposed action. The recommended action may raise a question about the level of commitment the EDA has to the proposed Downtown Redevelopment process. President Barsness' presentation will address this concern. (1) Adopt Resolution 99-XX concurring with the EDA recommendation; or (2) Defer action to the December 20, 1999 City Council meeting. Alternative (1). Motion By: Second By: on August 16, 1999, the Prior Lake Economic Development Authority adopted Resolution 99-01 recommending a $76,000 levy to support the Downtown Redevelopment program; and the City Council adopted Resolution 99-87 confirming this action and calling for a public hearing to consider this matter; and Resolution 99-87 was filed with Scott County and said levy was incorporated into the City's preliminary levy; and the actions of the EDA and City Council were predicated on the completion of the Downtown Redevelopment Plan by the public hearing date (December 6, 1999) which would identify a specific project for which the levy funds would be used; and the study is not yet complete and the information prerequisite to defining the use of the levy is not available; and in light of this fact, the Economic Development Authority has taken action to rescind EDA Resolution 99-01 and recommends that consideration of the levy be rescheduled after such time as the Downtown Redevelopment project report is complete; and the City Council acknowledges the support and leadership the EDA continues to provde to this project and concurs that this recommendation is most supportive of the project's long-term success. NOW THEREFORE, be it hereby resolved by the City Council of the City of Prior Lake, Minnesota as follows: 1. City Council Resolution 99-87 is hereby rescinded in its entirety, including elimination of the proposed $76,000 levy under Minnesota Statutes 1469.107. 2. The developer is interested in developing a congregate housing/assisted living project on the site. One of the questions raised by this individual was whether the City would consider some kind of assistance for this type of project, such as tax increment financing or tax abatements. In the past, the City's position has been not to provide assistance to housing proj ects on the theory that the market would adequately respond to the demand for housing. The site in question is located in the Downtown area and has been considered for multiple family housing in the past. The Public Comment Composite Plan for the Downtown which Mark Koegler reviewed with Commissioners at the last meeting shows multiple-family residential development in this area. There are two issues here. The first is philosophical in nature and deals with the issue of subsidizing housing developments. This is a policy issue requiring the concurrence of the EDA and the City Council The second deals with the timing of the request and whether Commissioners want to consider this before a definitive Downtown Redevelopment Plan is adopted or before clear input can be provided by the city council. Staff is of the opinion that any housing development on this site will likely require some form of assistance if it is to succeed. Endorsing a policy of assistance for any housing development does not seem prudent at this time. 1. Do nothing 2. ECONOMIC DEVELOPMENT AUTHORITY CITY OF PRIOR LAKE MEETING DATE: AGENDA#: PREPARED BY: DECEMBER 6, 1999 III DONALD RYE, PLANNING DIRECTOR AGENDA ITEM: CONSIDER AMENDMENTS TO EDA BYLAWS DISCUSSION: The City Council bylaws require each board or commission to review its bylaws annually and, if appropriate, recommend changes to the City Council. Staff has reviewed the bylaws and has two suggestions for changes. The first change is on the top of page two of the bylaws and is a typographical correction. The first sentence should be amended as follows: "All vacancies in the Board of Commissioners, whether caused by resignation, termination of Councilmembers, death or otherwise, shall be filled by City Couneil Mayoral appointment with City Council confirmation." Under Article V -Officers on page two, the treasurers position is required to be filled by an EDA commissioner. State statute also requires that the position be filled by a Commissioner. However, the statute allows for an assistant treasurer position to be filled by someone who is not a commissioner. Currently, the City Finance Director has the role of assistant treasurer but this is not spelled out in the bylaws. Staff believes that this relationship should be reflected in the bylaws. If the EDA agrees, the revised bylaw language would be as follows: "The President, Vice-President and Treasurer shall be members of the Board of Commissioners. The City Manager's designee~ will serve as the Secretary and assistantTreasurer. Commissioners should review their copy of the bylaws to determine if there are other sections of the bylaws in need of attention. ALTERNATIVES: 1. Recommend the changes in the staff report plus any others which may be agreed upon by the EDA. 2. Make no recommendation RECOMMENDED MOTION: Motion to adopt alternative I.
