In 1997, when Knob Hill 2nd Addition was platted and Pike Lake Trail was improved, the road was realigned to the east of the original easement. Four lots in Knob Hill 2nd Addition were platted between the new right-of-way and the easement. Current Circumstances: The plat of Knob Hill 2nd Addition identifies a 16;5' roadway easement along the rear lot line of Lots 1-4, Block 4. Ten feet ofthe existing easement is necessary for drainage and utility purposes; however, 6.5' ofthe easement is no longer necessary. We recently received a building permit application for a garage on one of these lots. Ordinarily, a garage may be located 10' from a rear lot line. In this case, the existing easement requires the garage be set back 16.5' from the rear lot line. The Issues: Minnesota Statutes 412.851 allows the Council to initiate by motion the vacation of any easements or right-of-way. A motion to initiate the vacation will refer this matter to the Planning Commission and allow the staff to schedule a public hearing at the City Council. In addition, this action will eliminate the need for the property owners to file a petition and pay the application fee. Conclusion: The staff recommends the City Council initiate the vacation of this easement. Any issues or need for the easement will be identified during the review process. The City Council has three alternatives: 1. A motion and second as part ofthe consent agenda to approve Resolution 99-XX initiating the vacation of a portion of the road easement adjacent to Lots 1-4, Block 4, Knob Hill 2nd Addition. 1 1:\99files\99vac\99-071 \99071 cc.doc Page 2 RESOLUTION ~ 91 RESOLUTION INITIATING THE VACATION OF A PORTION OF THE ROAD EASEMENT ADJACENT TO LOTS 1-4, BLOCK 4, KNOB HILL 2ND ADDITION BY: SECOND BY: WHEREAS, the original right-of-way for Pike Lake Trail was dedicated by easement; and WHEREAS, the final plat of Knob Hill 2nd Addition dedicated new right-of-way for Pike Lake Trail in a different location, and WHEREAS, the existing road easement remains on Lots 1-4, Block 4, Knob Hill 2nd Addition; and WHEREAS, in order to determine whether the vacation of this easement is or is not in the public interest, the City Council has initiated the vacation process by motion. NOW THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF PRIOR LAKE, that pursuant to Minnesota Statues 412.851, the process for the vacation of a portion of the roadway easement adjacent to Lots 1-4, Block 4, Knob Hill 2nd Addition, is hereby initiated. Passed and adopted this 20th day of September, 1999.
