Each of the improvement projects included in the 2000 Capital
Improvement Program (CIP) have failing bituminous surfaces
and/or bituminous curb with the exception of linden Circle which
has a gravel surface. It is no longer cost effective to continue to
patch most of these streets.
On May 17, 1999, Council adopted Resolution 99-50 ordering the
preparation of a feasibility report for those projects in the 2000
CIP required to follow the Minnesota Statutes Chapter 429
process. The projects studied in the report were: Area 1 -
reconstruction of Oak Ridge Circle Flandreau Circle, Indian Ridge
Circle, Fulbright Circle, Euclid Avenue, Maves Trail, and Forsythe
Road; Area 2 - reconstruction of Shannon Trail, Shannon Circle,
and Prior Circle; Area 3 - mill and overlay of Fairlawn Shores Trail
from 150th Street to Trunk Highway 13; Area 4 - mill and overlay
of Fish Point Road from Trunk Highway 13 to County Road 44;
and Area 5 - construction of Linden Circle. The recommendation
of the feasibility report was to proceed with Areas 1 through 5. On
August 16, 1999, Council adopted Resolution 99-79 ~ccepting the
feasibility report and calling for a public hearing on September 20,
1999 for the 2000 improvement projects.
CURRENT CIRCUMSTANCES
The Public Hearing will cover the following five projects:
1. Area 1 - Reconstruction of Oak Ridge Circle, Flandreau
Circle, Indian Ridge Circle, Fulbright Circle, Euclid Avenue,
Maves Trail, and Forsythe Road including storm sewer,
retaining walls, aggregate base, concrete curb and gutter,
bituminous surfacing, and appurtenant work.

2. Area 2 - Reconstruction of Shannon Trail, Shannon Circle,

3. Area 3 - Mill and overlay of Fairlawn Shores Trail from 150th
Street to Fish Point Road.
4. Area 4 - Mill and overlay of Fish Point Road from Glory Circle

5. Area 5 - Construction of Linden Circle including storm sewer,
aggregate base, concrete curb and gutter, bituminous
surfacing, and appurtenant work.
Details of the projects and proposed financing will be presented to
the public at the hearing.

The properties abutting project areas 1 through 5 are subject to
assessment. Each of the affected property owners has been
notified in accordance with the statute prior to the 'Public Hearing.
Public Informational Meetings were held on September 14 and 15,
1999 to provide the property owners an opportunity to discuss the
projects in an informal setting prior to the Public Hearing. Notes
from the informational meetings will be supplied to the City
Council.
ISSUES
The purpose of this public hearing is to determine whether the
projects should move forward. The next step is preparation of
plans and specifications which will provide greater information
about expected project cost and, therefore, the assessments
associated with these improvements. The Council could decide
not to continue with one or more of the projects upon receipt of
bids. A separate assessment hearing will be conducted following
review of the proposed assessments by the City Council's
Assessment Review Committee who could recommend
modifications to the proposed assessments to deal with unique
circumstances.
At the August 16, 1999 Council meeting an issue was brought up
about funding on the Linden Circle project (Area 5). The
Feasibility Report recommended watermain (trunk) costs to be
funded from the Trunk Reserve fund. It was questioned whether
this was consistent with the City's Assessment Policy of assessing
100% of the first time street construction costs. The Council
directed that this issue be looked at further by the Assessment
Review Committee at the appropriate time, which is during the
assessment hearing process. That process will begin once the
City receives bids on the projects.
CONCLUSION
Areas 1 through 5 are feasible from an engineering and economic
standpoint. As with the 1999 Improvement Projects, if the
preparation of plans and specifications is approved, the design
work is proposed to be done by City staff.
ALTERNATIVES:
There are three alternatives for the City Council to consider:
1. Conduct the Public Hearing and approve Resolution 99-XX
which orders the 2000 Improvements and authorizes City staff
to prepare plans and specifications for Areas 1 through 5.
2. Deny this item for a specific reason and provide staff with
direction.
3. Table this item until some date in the future.

WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given,
and the hearing was held on the 20th day of September, 1999, at which time all
persons desiring to be heard were given an opportunity to be heard thereon.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCil OF PRIOR lAKE,
MINNESOTA:
1. Such improvements are hereby ordered as proposed in Council Resolution
99-79 adopted the 16th day of August, 1999.

INTRODUCTION
On May 17, 1999, the Prior Lake City Council adopted Resolution 99-50, which ordered the
preparation of a feasibility report for improvements to the project areas listed below:
· Area 1 - Oak Ridge Circle, Flandreau Circle, Indian Ridge Circle, Fulbright
Circle, Euclid Avenue, ,Maves Trail, and Forsythe Road are located within
Section 36, Township 115 North, Range 22 West, Scott County, Minnesota.
· Area 2 - Shannon Trail, Shannon Circle, and Prior Circle are located within
Section 36, Township 115 North, Range 22 West, Scott County, Minnesota.
· Area 3 - Fairlawn Shores Trail from 150th Street to TH 13 is located within
the northeast quarter of Section 36, Township 115 North, Range 22 West,
Scott County, Minnesota.
· Area 4 - Fish Point Road from TH 13 to CSAH 44 is located within the
sOl:ltheast quarter of Section 36, Township 115 North, Range 22 West, Scott
County, Minnesota.
. Area 5 - Linden Circle is located within the northwest quarter of Section 3,
Township 114 North, Range 22 West, Scott County, Minnesota.
SCOPE
This report evaluates the feasibility of reconstructing these streets. All existing infrastructure
elements (streets, utilities, etc.) were evaluated, improvements recommended, cost estimates
of the proposed improvements prepared and funding strategies developed by this report.
DESCRIPTION OF PROJECT
AREA 1 - Oak Rid2e Circle. Flandreau Circle. Fulbri2ht Circle. Indian Ridee Circle.
Euclid Avenue. Maves Trail. and Forsythe Road
Area 1 is shown on Exhibit 1. Oak Ridge Circle, Flandreau Circle, Fulbright Circle, Indian
Ridge Circle, Euclid Avenue, Maves Trail, and Forsythe Road have failing bituminous
surfaces and bituminous curb. The existing widths of all of the roads with the exception of
Forsythe Road are 30 feet. Forsythe Road is currently 16.5 feet wide. There are some
existing reinforced concrete storm sewers and culverts that carry storm water runoff to an
existing system and ultimately to Prior Lake. These failing bituminous surfaces were
originally paved in 1975. The streets no longer meet minimum design standards and it is not
cost effective to continue to patch the streets.
Sanitary sewer and watermain were installed in 1974. The watermain consists of 6"
diameter ductile iron pipe. The sanitary sewer in the project area is 8" diameter vitrified clay
pipe. The sanitary sewer was televised in 1995. The televising report indicates areas of pipe
that show vertical sags, cracked joints, cracked pipe and roots.

Proposed improvements include 7-ton design street reconstruction with storm sewer,
retaining walls, concrete curb and gutter, driveway restoration, and bituminous surfacing.
Street widths for Oak Ridge Circle, Flandreau Circle, Fulbright Circle, Indian Ridge Circle,
Euclid Avenue, and Maves Trail are proposed to be 28 feet. A street width of 22 feet is
proposed on Forsythe Road due to the topography of the area. The typical street section is
shown on Exhibit 4.
Sanitary sewer will be repaired as necessary to correct sags and cracks. Additional fire
hydrants will be added to the project as the existing hydrant spacing is not in conformance
with City requirements. Existing storm sewer pipe will be utilized where possible.
The existing right-of-way is 50 feet wide on all of the streets in Area 1. Temporary
construction easements or right-of-entry agreements will be necessary for driveway
restoration due to the topography of the area. No additional right-of-way requirements are
anticipated. The benefiting property owners will be assessed for street and storm sewer
construction. Tax levy funds will be used to finance the city portion of the street
reconstruction costs. Trunk reserve funds will be used to finance the water and sanitary
sewer repairs.
AREA 2- Shannon Trail. Prior Circle and Shannon Circle
Area 2 is shown on Exhibit 1. Shannon Trail, Prior Circle and Shannon Circle have
bituminous surfaces with bituminous curb. The existing width of all of the roadways in Area
2 is 30 feet. There are some existing reinforced concrete storm sewers and culverts that carry
storm water runoff to an existing system and ultimately to Prior Lake. The streets in Area 2
were originally paved in 1982. The streets in the Prior Hill Addition were constructed seven
years after the streets in Area 1 and do not show as many signs of deterioration.
Sanitary sewer and watermain were installed in 1982. The watermain consists of 6"
diameter ductile iron pipe. The sanitary sewer in the project area is 8" diameter vitrified clay
pipe. Sanitary sewer will be televised to determine if any repairs are necessary.
The existing right-of-way is 50 feet wide on all of the streets in Area 2. Temporary
construction easements or right-of-entry agreements will be necessary for driveway
restoration due to the topography of the area. No additional right-of-way requirements are
anticipated. The benefiting property owners will be assessed for street and storm sewer

Area 3 is shown on Exhibit 2. Fairlawn Shores Trail from Fish Point Road to 150th Street
was constructed in 1979 to a Municipal State Aid standard with concrete curb and gutter at a
width of 36 feet. The bituminous portion of the street is failing and no longer meets design
standards. Proposed improvements includes milling of bituminous edges with a 2"
bituminous overlayment.

The Fairlawn Shores Trail overlay project is proposed to be funded through special
assessments to the benefiting property owners and tax levy funds.
AREA 4 - Fish Point Road Mill and Overlay
Area 4 is shown on Exhibit 2. Fish Point Road between Glory Circle and 160th Street
(CSAH 44) is a Municipal State Aid roadway and was constructed with concrete curb and
gutter in 1979. The existing street width is 28 feet from Glory Circle to Huron Street and 44
feet wide from Huron Street to 160th Street. A 5-foot wide concrete sidewalk was
constructed along Fish Point Road in 1993. The bituminous portion of the street is failing.
Proposed improvements includes milling of the bituminous edges and a 2" bituminous
overlayment.
The Fairlawn Shores Trail overlay project is proposed to be funded through special
assessments to the benefiting property owners and tax levy funds.
AREA 5 - Linden Circle
Area 5 is shown on Exhibit 3. Linden Circle is located east of Northwood Road, north of
Butternut Circle. Linden Circle has a gravel surface and is rural in nature with no curb and
gutter. This area was originally platted in the 1930's. Storm water runoff currently flows
overland to Prior Lake.
Residents of Linden Circle submitted a petition for local improvement in March of 1999.
Proposed improvements include 7-ton design street construction with storm sewer, concrete
curb and gutter, and bituminous surfacing. A street width of 22 feet is proposed due to the
topography of the area and existing right-of-way. The typical street section is shown on
Exhibit 5.
The existing right-of-way is 20 feet wide. Additional right-of-way and easements will be
required to construct the roadway as proposed. In accordance with the assessment policy if
street construction is done over a non-bituminous surface, benefiting properties are proposed
to be assessed for 100% of the street and storm sewer costs.
FEASIBILITY
From an engineering standpoint, the projects in Areas 1 through 5 are feasible, independent
of each other, and can be accomplished as proposed, and not in conjunction with each other
or any other project.
ESTIMATED COST
The following costs were prepared based upon an Engineer's Estimate and are subject to
change, depending on the final design of the project, required easements and/or right of way,

The improvement cost can be assessed on a unit basis or an adjusted front footage basis to
the benefiting properties as per the Assessment Policy adopted by the City Council on.
February 21, 1989, and as amended. Both methods are shown for Areas 1 and 2. For Areas
1, 2, 3, and 4 the following breaks out estimates at 60% City cost and 40% assessment for
streets and stonn sewer. Area 5 is 100% assessable as first time improvements.

From an economic standpoint, projects 1 through 5 are feasible.
With a total estimated project cost of $1,131,000, an estimated bond of $1,066,130 and an
assessment total of $474,890 the assessed amount would be 44%. Minnesota Statutes Chapter 429
Special Assessment Bond issue requires that a minimum of 20% of the total bond amount be
recovered through special assessments.

CONCLUSION
The total estimated cost of the recommended improvements is $1,131,000. A portion of these
projects are proposed to be assessed to the benefiting property owners and the remainder through
other funding sources. The projects are feasible from an engineering standpoint.

2000 Street/Storm Water Improvement Project
Dear Mr. Boyles:
As a property owner affected by the proposed improvement projects. I would like to
express to you and the city council my strong endorsement for this endeavor as it is taken
up in consideration for fmal approval, and ask that my letter be included in the record for
these proceedings.
My property. located at 15223 Oak Ridge Circle SE (Lot I, Block I, Oak Ridge Court,
Second Addition). and the two adjoining homes (Lots 2 and 3) were built in 1987 on a
low-lying outlot left undeveloped in the Oakridae Court First Addition project from
decades ago. (see exhibit 1, attached) Unfortunately, adequate stonn water improvements
were never made at that time to accommodate the water run-off from the surrounding
area. Do to the low-lying nature of the property, coupled with a drainage tube that runs
from an existing water collection point in an unused swamp area of Lot 3, underground
through Lot 2 and draining directly in my backyard,(see Exhihit 2. attached) my property
is routinely flooded with heavy rain, killing the grass and bushes and, when the water
fmally absorbs, creates a mud bog of the area that I have had to perpetually
re-sodlreseedlreplant in order for my family to use and enjoy.
Since the west area of Oakridge Court was the only area equipped with stonn water
collection systems in the original development and experiencing the stonn water
collection inadequacies I have, coupled with the frustration of other nearby property
owners in the East area of Oakridge Court who also have varying degrees of water runoff
problems, I know we all share in support of this much needed project and I congratulate
the city staff for moving forward with it.
