If the Council finds that development has not occurred within a reasonable period oftime after original approval, it may direct the Planning Commission to initiate a rezoning to remove the PUD designation from the subject property. Current Circumstances On February 22, 1999, the Planning Commission reviewed a report which outlined the major provisions of each PUD district in the City and summarized the development status of each. A two page summary of that report is attached for your information. According to this summary, more than one-half of the approved PUD districts are completed. We continue to issue building permits for construction in the active PUD's. The Planning Commission accepted this report and forwarded it to the Council for review with no changes. 1. Accept the report as part of the consent agenda without directing further action. The staff recommends Alternative #1. (612) 447-4230 AN EQUAL OPPORTUNITY EMPLOYER / Fax (612) 447-4245 1998 PUD STATUS REPORT PRIOR LAKE PLANNING DEPARTMENT February 23, 1999 Chapter 5-5-11 (D, 7 ,e) of the Prior Lake City Code requires the Planing Commission to review all Planned Unit Development, (PUD), districts within the City at least once each year. The Planning Commission is directed to submit a report to the City Council on the development status of each PUD District in order to monitor the development progress of each PUD District. In the event that the City Council would find development has not occurred within a reasonable time after the original approval, the City Council may instruct the Planning Commission to initiate rezoning to the original zoning district by removing the PUD district from the official Zoning Map. The City of Prior Lake currently has eight PUD districts which are indicated on the attached PUD Inventory Map. Half of the PUD's are completely developed. This report provides a brief history, site data, current development status and a recommendation pertinent to the disposition of each PUD. The eight PUD districts are identified as follows: PUD IN PROGRESS PUD 6-93 Cardinal Ridge PUD COMPLETED PUD 7-76 The Harbor PUD 82-12 Prior View PUD 8-82 and PUD 4-83 Sand Pointe PUD 9-93 The Wilds PUD 12-16 Tower Hill Apartment East PUD 5-83 Wind song On The Lake PUD 8-93 Westedge Estates The following is a summary of 1998 activity that occurred within the five PUD's in progress. Cardinal Ridge: Fifth and final plat was approved in August 1997. 11 Of the 38 lots were developed in 1997 and 17 in 1998. Of the Fourth Addition, platted in 1996, 27 of the 35 lots are developed and of the Third Addition, platted in 1995, 39 of the 39 lots are developed. The Harbor: In May, 1998, Outlot A, Harbor 7th Addition was final platted with 3 lots as previously approved in the preliminary plat and PUD. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER Prior View: In September, the City Council approved a PUD amendment and Preliminary Plat for a 61 unit "Assisted Living" facility. The developer failed to submit complete plans regarding the final PUD amendment and final plat for the project within the required 12 month period. Therefore, the preliminary plat and PUD amendment are voided and must be re-applied for in the future. Staff continues to meet with the developer on the project. The Wilds: Wilds Third Addition was final platted in June 1997. Wilds Fourth Addition was approved in September 1997. In October 1997, a PUD amendment was approved allowing for single family detached "Golf Villas" in Sterling South. To date, there are 41 of 68 lots available in The Wilds; 13 of the 24 lots are available in the Wilds 2nd Addition; and 33 of the 38 lots platted in the Wilds 3rd are vacant. None of the 8 lots in the Wilds Fourth have been developed; 4 of the 18 lots are vacant in Sterling North (townhomes) and 79 of the 88 plated lots are available in Sterling South. In 1998, 10 permits were issued for single family dwellings and 2 for townhomes in the Wilds PUD. Windsong on the Lake: In October 1998, Windsong on the Lake 3rd Addition was final platted. The developer requested this area be included within the PUD; however, this amendment was not approved. Two permits were issued in 1998 for Windsong on the Lake 2nd Addition. There are 4 lots remaining. The final platting of Outlot A, Windsong on the Lake 2nd Addition was anticipated to commence upon completion of c.R. 21 to match grades and coordinate engineering specification into the platting.
