CONSIDER APPROVAL OF RESOLUTION 99-XX
AUTHORIZING THE EXECUTION OF A TRAFFIC CONTROL
SIGNAL AGREEMENT WITH MNDOT FOR THE SIGNAL AT
TRUNK HIGHWAY 13 AND DULUTH AVENUE.
DISCUSSION:
HISTORY
In May of 1978 the City, the Minnesota Department of
Transportation (MnDOT), and Scott County entered into an
agreement for construction and maintenance of the traffic signal
system at Trunk Highway (TH) 13 and Duluth Avenue. Scott
County had jurisdiction over Duluth Avenue north of TH 13 at the
time and was therefore a party to the agreement. The agreement
was never modified despite the County's turnback of Duluth
Avenue to the City of Prior Lake.
On June 15, 1998, the City Council approved Resolution 98-XX
awarding bids for the 1998 Improvement Projects which included
traffic signal revisions at TH 13 and Duluth Avenue as a part of
State Aid Project 201-101-04 (City Project 98-16). As a result of
the signal revisions, MnDOT has seen fit to re-write the
agreement. The new agreement was received by the City on
January 19, 1999.
CURRENT CIRCUMSTANCES
The current agreement, dated May 3, 1978, requires the City to
provide power and maintenance to the traffic signal. Because of
the signal revisions, which included the addition of Emergency
Vehicle Preemption (EVP), MnDOT requires the city to enter a
new agreement which addresses responsibility for the cost of the
revisions as well as maintenance of the signal. A copy of the
agreement is attached.
The new agreement provides: The City will 1) design and
construct all signal revisions (this has already been accomplished
through the Duluth Avenue improvements and was funded with
Municipal State Aid funds); 2) provide the necessary electrical

power for operation; 3) maintain/replace the luminaires; 4) relamp
the signal and street lights; and 5) clean and paint the signal,
cabinet, and mast arm extensions. The State (MnDOT) will 1)
maintain the signing; 2) maintain the interconnect; 3) maintain the
EVP system; 4) control the signal cycle; and 5) perform all other
traffic control signal and street light maintenance.
ISSUES
Based on experience at this location, this signal costs the City
approximately $1500 to operate annually. With the new revisions
this is estimated to remain approximately the same and is a
budgeted operating expense in the approved 1999 budget.
CONCLUSIONS
This is a routine agreement that is similar to others currently in
place between the City and MnDOT.
ALTERNATIVES:
There are three alternatives for the City Council to consider:
1. Approve Resolution 99-XX authorizing the execution of a
traffic control signal agreement with MnDOT for the signal at
TH 13 and Duluth Avenue.
2. Deny this item for a specific reason and provide staff with
direction.
3. Table this item until some date in the future.
RECOMMENDED
MOTION:
A motion and second to approve Resolution 99-XX authorizing the
Mayor, City Manager, and City Attorney to execute the attached
agreement.

A RESOLUTION AUTHORIZING THE EXECUTION OF A TRAFFIC SIGNAL AGREEMENT
WITH MNDOT FOR THE SIGNAL AT TRUNK IDGHW A Y 13 AND DULUTH AVENUE IN
THE CITY OF PRIOR LAKE, MINNESOTA

WHEREAS,
the City of Prior Lake planned the traffic signal revisions at Trunk Highway 13 and
Duluth Avenue; and
WHEREAS,
such revisions are completed and the traffic signal is in operation.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that the
City enter into an agreement with the State of Minnesota, Department of Transportation for the following
purposes, to wit:
To provide maintenance and electrical energy for the revised traffic control signal with street
lights, emergency vehicle pre-emption, interconnect and signing on Trunk Highway No. 13 at
Duluth Avenue in accordance with the terms and conditions set forth and contained in
Agreement No. 78290M, a copy of which was before the Council.
BE IT FURTHER RESOLVED that the proper City officers be and hereby are authorized to execute
such agreement, and thereby assume for and on behalf of the City all of the contractual obligations
contained therein.

THIS AGREEMENT made and entered into by and between the
State of Minnesota, Department of Transportation, hereinafter
referred to as the "State", and the City of Prior Lake,
hereinafter referred to as the "City", WITNESSETH:
WHEREAS, Minnesota Statutes Section 161.20 (l999)
authorizes the Commissioner of Transportation to make
arrangements with and cooperate with any governmental authority
for the purposes of constructing, maintaining and improving the
Trunk Highway system; and
WHEREAS, it is justified and considered mutually
desirable to revise the existing traffic control signal with
street lights, emergency vehicle pre-emption, interconnect and
signing on Trunk Highway No. 13 at Duluth Avenue; and
WHEREAS, the City requests and the State agrees to the
installation of an Emergency Vehicle Pre-emption System,
hereinafter referred to as the "EVP System", as a part of the
revised traffic control signal installation on Trunk Highway
No. 13 at Duluth Avenue and in accordance with the terms and
conditions hereinafter set forth; and
WHEREAS, it is considered in the public's best interest
for the State to provide a new cabinet and control equipment to
operate said revised traffic control signal, all at the cost and
expense of the State; and

WHEREAS, the City and State will participate in the
maintenance and operation of the revised traffic control signal
with street lights, EVP System, interconnect and signing as
hereinafter set forth;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. The City shall prepare the necessary plan,
specifications and proposal which shall constitute "Preliminary
Engineering". The City shall also perform the construction
inspection required to complete the items of work hereinafter set
forth, which shall constitute "Engineering and Inspection".
2. The City with its own forces and equipment or by
contract shall revise the existing traffic control signal with
street lights, EVP System, interconnect and signing on Trunk
Highway No. 13 at Duluth Avenue in accordance with the plan and
specifications for State Aid Project No. 201-101-04 and City
Project No. 98-16, all at the cost and expense of the City.
3. The construction work provided for herein shall be
under the direction and supervision of the City. It is agreed,
however, that the State shall have the right to periOdically
inspect said construction work.
4. The City shall perpetuate an adequate electrical
power supply to the service pad or pole, and upon completion of
said revised traffic control signal with street lights

installation shall continue to provide necessary electrical power
for its operation at the cost and expense of the City.
5. Upon completion of the work contemplated in
Paragrapt 2 hereof, it shall be the City's responsibility, at its
cost and expense, to:
(1) maintain the luminaires and all its
components, including replacement of the luminaire if necessary;
(2) relamp the traffic control signal and street lights; and
(3) clean and paint the traffic control signal, cabinet and
lumina ire mast arm extensions. It shall be the State's
responsibility, at its cost and expense, to maintain the signing
and interconnect and to perform all other traffic control signal
and street light maintenance.
6. The EVP System provided for in Paragraph 2 hereof
shall be installed, operated, maintained or removed in accordance
with the following conditions and requirements:
a) All maintenance of the EVP System shall be
done by State forces.
b) Emitter units may be installed and used only
on vehicles responding to an emergency as
defined in Minnesota Statutes Chapter 169.01,
Subdivision 5 and 169.03. The City will
provide the State's Assistant Division
Engineer or his duly appointed representative

a list of all such vehicles with emitter
units.
c) Malfunction of the EVP System shall be
reported to the State immediately.
d) In the event said EVP System.or components
are, in the opinion of the State, being
misused or the conditions set forth in
Paragraph b above are violated, and such
misuse or violation continues after receipt
by the City of written notice thereof from
the State, the State shall remove the EVP
System. Upon removal of the EVP System
pursuant to this Paragraph, the field wiring,
cabinet wiring, detector receiver, infrared
detector heads and indicator lamps and all
other components shall become the property of
the State.
e) All timing of said EVP System shall be
determined by the State through its
Commissioner of Transportation.
7. Any and all persons engaged in the aforesaid work
to be performed by the City shall not be considered employees of
the State and any and all claims that mayor might arise under

the Worker's Compensation Act of this State on behalf of said
employees while so engaged, and any and all claims made by any
third party as a consequence of any act or omission on the part
of said employees while so engaged on any of the work
contemplated herein shall not be the obligation and
responsibility of the State. The City shall not be responsible
under the Worker's Compensation Act for any employees of the
State.
8. All timing of the revised traffic control signal
provided for herein shall be determined by the State, through its
Commissioner of Transportation, and no changes shall be made
therein except with the approval of the State.
9. Upon execution and approval by the City and the
State and completion of the construction work provided for
herein, this agreement shall supersede and terminate Agreement
No. 59028 dated May 3, 1978, between the City, Scott County and
the State.
