Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT JULY 16, 2007 5N STEVE ALBRECHT, DIRECTOR OF PUBLIC WORKS CONSIDER APPROVAL OF A RESOLUTION APPROVING PRIVATE USE OF PUBLIC RIGHT OF WAY PERMIT FOR FLINT ROAD Introduction The purpose of this agenda item is for the City Council to approve a Private Use of Public Right of Way Permit for Flint Road. Historv Currently Flint Road is a gravel road that is maintained by the six residences that utilize the roadway. The existing driveway is posted as "private" even though it is located within a 33 foot public right-of-way. The City currently maintains utilities including a lift station along Flint Road but does not plow or maintain the roadway other than minor gravel placement to maintain lift station access. The City Council vacated a portion of this right-of-way near the lake in the 1990's. The City has reviewed the roadway on several occasions regarding whether it should be reconstructed a City street. Previously it has been determined that the right-of-way is insufficient to build a street that meets minimum City Standards and that the existing roadway should remain private. Current Circumstances The residents of Flint Road have approached the City regarding the upgrade of the gravel roadway to a paved roadway at the residents cost. City staff believes this is appropriate and has reviewed the issue to determine what City approvals are required. City staff is recommending issuance of a Private Use of Public Right of Way Permit for upgrade of the roadway by the residents. This will allow the residents to upgrade the driveway within the existing public right-of-way at their own cost. The permit will also allow the City to clarify our maintenance responsibilities regarding the roadway. The upgrade of the roadway will provide better emergency vehicle and utility maintenance access for the City. Additionally because the cost of the upgrade is being paid by the benefiting residents it is consistent with the City's Street improvement program. As part of the agreement the City will adjust our manholes and gate valves. This is a minimal cost and is more than offset by the gravel repairs the City completes annually to maintain lift station access. R:\CouncillAgenda Reports\2007\07 16 07\x Flint Agenda,doc .t f . The paving of the roadway will reduce City costs associated with maintenance. The initial cost for adjustment of the existing utilities will be minimal. ALTERNATIVES: The alternatives are as follows: 1. Approve a Resolution approving a Private Use of Public Right of Way Permit for Flint Road. 2. Deny this item for a specific reason and provide Staff with direction. 3. Table this item until some date in the future. RECOMMENDED Alternative 1 MOTION: R:\CouncillAgenda Reports\2007\07 16 07\Flint Agenda.doc CONSIDER APPROVAL OF A RESOLUTION APPROVING AN A PRIVATE USE OF PUBLIC PROPERTY PERMIT FOR FLINT ROAD Motion By: Second By: WHEREAS, Flint Road is currently maintained as a private gravel roadway within an existing 33 foot City right-of-way; and WHEREAS, The City currently maintains utilities in the right-of-way but has no plans to upgrade the existing roadway to a public street; and WHEREAS, The residents along Flint Road wish to pave the existing gravel road at their own cost; and WHEREAS, The paving of Flint Road will provide better emergency vehicle and utility maintenance access. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The Mayor and City Manager are authorized to execute a Private Use of Public Property Permit with the Residents of Flint Road for the proposed paving of the existing gravel road.
