History
Proposed street reconstruction improvements to the Candy Cove
and Lakeside Manor Additions including Candy Cove Trail,
Lemley Circle, Manor Road, Hill Circle and Woodlawn Circle
(Project #99-11) and Centennial Street (Project #99-12) are in the
approved 1999 Capital Improvement Program. Resolution 98-131
authorizing preparation of plans and specifications for the projects
was approved by the City Council on November 2, 1998.
Public informational open houses were held in October of 1998
and February of 1999 to provide affected property owners the
opportunity to discuss the projects. Nine residents of the Candy
Cove/Lakeside Manor area attended the October meeting and
twelve attended the February meeting. Five residents from
Centennial Street attended the October meeting and two attended
the February meeting. Plans were available for review and City
staff was in attendance to answer questions from the public. The
detailed plans for the projects are available in the Engineering
Department for City Council review.

Current Circumstances
Project #99-02: Lift Station Renovations
Renovations of lift stations Nos. 9, 12, and 13 are proposed with
the Candy CovelLakeside Manor project. This includes
replacement of pumps, valves, control panels, guide rails, force
main, structure repair and appurtenant work. Lift station
renovation is included in the 1999 Capital Improvement Program
in the amount of $76,000. The current Engineer's Estimate is
$88,000. The lift station renovations are proposed to be funded
through the Trunk Reserve fund.
Project #99-11: Reconstruction of Candy Cove Trail. Lemlev
Circle. Manor Road. Woodlawn Circle and Hill Circle
This project includes storm sewer, concrete curb and gutter,
aggregate base, bituminous surfacing, retaining walls, and
appurtenant work. The engineer's estimate is $540,900.00.
Indirect costs are estimated at 30%, and include engineering
(17%), administration (5%), and financing (8%) for a total
estimated project cost of $703,170.00. The construction of this
will be funded through assessments, tax levy, and Trunk Reserve
fund.
Project #99-12: Centennial Street
Centennial Street is currently a gravel roadway. Project #99-12
includes aggregate base, concrete curb and gutter, bituminous
surfacing, and appurtenant work. The total project cost from the
Feasibility Report is $62,640.00, which includes the 30% indirect
costs. In an effort to reduce costs and address City Council
Directive 98-72, staff is proposing a 28-foot wide roadway (City
standard in new subdivisions is 32 feet) and a modified cul-de-sac.
The revised project cost estimate for a 28-foot roadway is
$58,140.00, which includes the 30% indirect costs. The
construction of Centennial Avenue is programmed to be funded
through special assessments.
Issues
Introduction
Minnesota State Statute Section 429.021, Subdv. 2 permits
improvements on two or more streets or two or more types of
improvements in or on the same street or streets or different streets
to be included in one proceeding and conducted as one
improvement.

Special Assessments
1.) Project #99-11, Candy CovelLakeside Manor Street
Reconstruction: No real issues related to special assessments based
on input from the informational meeting.
2.) Project #99-12, Centennial Street: Residents of Centennial
Street expressed their opposition to the project both at the
informational meetings and in a letter to the Mayor and
councilmembers, dated November 18, 1998 (attached). One
resident has since expressed support of the project in the attached
letter dated April 3, 1999.
Assessment Hearinf!
The Special Assessment Policy provides for the creation of an
Assessment Review Committee of two Councilmembers and three
staff members (Councilmembers Petersen and Schenck and staff
members Boyles, Teschner and Ilkka). This committee met on
March 10, 1999 to discuss the proposed assessments.
1.) Project #99-11, Candy CovelLakeside Manor: The committee
recommends to assess the Candy Cove/Lakeside Manor properties
on a unit basis due to the homes within the project area being
comparable in size and market value with the only difference being
the homes located on the lake. Based on estimated assessable share
(40%) of the total estimated project cost of $281,268.00 and 91
assessable units, the unit assessment is estimated at $3,091.00.
The feasibility report proposed a rate of $34.55 per front foot.
Using the average lot size of 91 front feet, the average assessment
would be $3,144.05. The committee recommends holding the
assessment hearing for the Candy CovelLakeside Manor project in
September 1999 when the project is substantially complete.
2.) Project #99-12, Centennial Street: The committee recommends
to assess the Centennial Street properties on a unit basis and to
conduct the assessment hearing on July 6, 1999 after bids are
received and prior to award of the Centennial Street contract.
Based on the total estimated project cost of $58,140.00 and the six
units proposed to be assessed, the estimated assessment per unit is
$9,690.00.
The potential for assessment appeals appears to be higher on the
Centennial Street project due to the cost being 100% assessed and
the fact that the majority of the property owners do not support this
project. However, unimproved streets do not conform to city

standards and the paving of gravel surfaces will only increase with
time. Staff is proposing to bid Centennial Street as a bid alternate
and make the alternate's award contingent on the outcome of the
assessment hearing. By holding the assessment hearing prior to
award of the contract, the Council will have actual cost data, a
better sense of property owner's perspectives and if desired could
have an appraisal prepared.
Other Issues
The National Urban Runoff Program (NURP) requires treatment of
stormwater prior to discharge into a natural water body. Typically,
ponds are constructed in new developments where vacant land is
available. Under these requirements, storm water treatment will be
required as a part of the Candy CovelLakeside Manor
improvements (Project #99-11). There are currently two storm
sewer outlets to Prior Lake on the Candy Cove Trail project. Staff
is proposing the installation of water quality structures with the
street reconstruction that would provide storm water treatment in
place of ponding areas which do not presently exist and would
have to be included in this project. The cities of Savage and
Lakeville have installed similar structures in recent projects. The
cost of the structures is estimated at $30,000 each, for a total of
$60,000.
In lieu of the structures, it would be necessary to acquire land in
order to construct ponding areas for these storm sewer outlets.
There is currently vacant land adjacent to each of the storm sewer
outlets at the Lakeside Manor Association and a lot adjacent to
5400 Candy Cove Trail. Assuming lakefront property is selling for
$3,000 per foot of frontage, the 70 foot wide vacant lot could cost
$210,000. Assuming a parcel of equal size would be acquired
from the association, total acquisition could potentially equal
$420,000, not including pond construction costs. In light of the
high cost of land acquisition, staff recommends the use of the
storm water quality structures which will be incorporated into the
plans and specifications for the Candy CovelLakeside Manor
project. Proposed funding of the two structures is the trunk
reserve.
Conclusion
The staff believes it is appropriate for the City Council to approve
project plans and specifications and authorize solicitation of bids.

FINANCIAL IMPACT:
The total cost of this project is estimated to be $703,170.00 and
will be recovered through special assessments and Trunk Reserve
funds in addition to tax levy for bond repayment. The table below
outlines the project costs (*) as presented in the feasibility report
and the 1999 Capital Improvement Program.

ALTERNATIVES:
The alternatives are as follows:
1. Approval of Resolution 99-XX approving plans and
specifications for Street Reconstruction and Lift Station
Renovations for Candy Cove/Lakeside Manor Additions and
Centennial Street and authorizing advertisement for bids.
2. Deny this item for a specific reason and provide staff with
direction.
3. Table this item until some date in the future.

A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS
AND AUTHORIZING THE ADVERTISEMENT FOR BIDS
FOR STREET RECONSTRUCTION AND LIFT STATION RENOVATION FOR
CANDY COVE/LAKESIDE MANOR ADDITIONS AND CENTENNIAL STREET
FOR THE CITY OF PRIOR LAKE, MINNESOTA

WHEREAS,
pursuant to Resolution 98-131, adopted on November 2, 1998, the City Engineer has
prepared plans and specifications for the utility improvement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA that
1. Such plans and specifications, a copy of which is attached hereto and incorporated herein by this
reference, are hereby approved.
2. The City Manager shall prepare and cause to be inserted in the official paper and in the
Construction Bulletin an advertisement for bids for the making of the improvement pursuant to the
attached plans and specifications. The advertisement shall be published not less than 21 days prior
to bid opening, shall specify the work to be done, and shall state that the bids will be received by
the City Manager until 10:00 a.m. on Tuesday, May 25, 1999, at which time the bids will be
publicly opened at City Hall at 16200 Eagle Creek Avenue SE by the City Engineer. No bids will
be considered unless sealed and filed with the City Manager and accompanied by a cash deposit,
cashier's check, bid bond, or certified check payable to the City of Prior Lake in the amount of
five (5) percent of the amount of such bid.
3. The City reserves the right to reject any and all bids for any reason as determined solely by the
City.

the City of Prior Lake, Minnesota at the Prior Lake City Hall, located at 16200 Eagle Creek

Proposals arriving after the designated time will be returned unopened.
The Bids must be submitted on the proposal forms provided in accordance with contract
documents, plans, and specifications as prepared by the City of Prior Lake Engineering
Department, 16200 Eagle Creek Avenue S.E., Prior Lake, MN 55372. Contract documents,

plans, and specifications may be obtained from Prior Lake Engineering Department by calling
(612) 447-9830. Copies may be obtained upon deposit of Seventy five dollars ($75.00) non-
refundable deposit per set.
No bids will be considered unless sealed and filed with the City Manager of Prior Lake and
accompanied by a cash deposit, cashier's check, bid bond, or certified check payable to the City
of Prior Lake, for five (5%) percent of the amount bid to be forfeited as liquidated damages in the
event that the bid be accepted and bidder shall fail to enter promptly into a written contract and
furnish the required bond.
No bids may be withdrawn for a period of sixty (60) days from the date of opening of bids. The
City of Prior Lake reserves the right to reject any or all bids. Further, the City reserves the right
to accept a bid higher than the lowest bid if, in the opinion of the Council, the public interest will
be better served.

We have reconsidered our opposition to the improvements of
Centennial Street. As we understand it, there will not
need to be a storm sewer and therefore the cost should be
somewhat less. With that in mind we are not in opposition
to the improvements.

Dear Mayor Mader and members of Prior Lake City Council:
We, the residents of Centennial Street SE in the City of Prior Lake would like to thank the
City of Prior Lake for con~idering Centennial Street among its city improvement projects.
However none of the residents living on Centennial street are in favor oftbis project In
its present state, Centennial St SE requires very minimal maintenance. The project
would also necessitate removal of many natural mature trees. We also believe the paved
road would not significantly increase the value of our property. The costs of the road is a
burden to us as well.
At this time, we are happy with the road as it is, and feel the upkeep of our road is not a
significant burden to taxpayers of Prior Lake. We would prefer the project not be done at
this time.
