HomeMy WebLinkAbout100289 Regular !'- MINUTES OF THE CITY COUNCIL October 2, 1989 The Common council of the City of Prior Lake met in regular session on Monday, October 2, 1989 at 7:30 p.m. in the City Council Chambers. Present were Mayor Andren, Counci1members Fitzgerald, Larson, Scott, White, City Manager Unmacht, City Engineer Anderson, Assistant City Manager Schmudlach, and City Attorney Kessel. Mayor Andren called the meeting to order and asked everyone to rise for the pledge of allegiance. The minutes of the September 18, 1989 Prior Lake City council meeting were reviewed by Council. city Manager Unmacht noted two changes, one change on page 2, last paragraph, last sentence, first word "items" should be changed to item. The second change was on page 5, paragraph 6, line 7, the words "change of" should be deleted from the sentence. MOTION MADE BY FITZGERALD, SECONDED BY WHITE, TO APPROVE THE MINUTES SEPTEMBER 18, 1989 MINUTES AS AMENDED. Upon a vote taken, ayes by Andren, Fitzgerald, Larson, Scott White, the motion passed unanimously. and The next order of business was approval of the Consent Agenda follows: as Consent Agenda a) b) c) Consider Approval of Invoices To Be Paid Consider Approval of Senior Citizen Deferred Applications Consider Approval Agreement Amendment of Shakopee Mdewakanton Invoices Assessment Def. Asse: . for SR.Ci1 S10UX Sioux Agreement from the City Manager Unmacht requested that Item (c) be pulled agenda for further discussion later in the evening. MOTION MADE BY LARSON, SECONDED BY FITZGERALD, TO APPROVE THE Consent CONSENT AGENDA WITH THE EXCEPTION OF ITEM (c). Councilmember Larson discussed the Proposal agreed upon at a meeting between the Sportsmans Club, Beach Lane residents and City representatives. Discussion occurred on Item 2 of the Proposal regarding Sand Point Beach, the DNR access at Sand Point Beach, and whether or not the City would agree to find an alternative site should Sand Point Beach become inaccessible, or the DNR would not permit Sand Point Beach access to be opened during the winter. Item 3 was a change of wording from residents to Beach Lane. Further discussion occurred on the overall proposal. MOTION MADE BY FITZGERALD, SECONDED BY SCOTT, TO AMEND ITEM #2 OF Beach THE PROPOSAL TO READ: THE CITY WILL ASSESS THE REASONABLENESS OF Lane REQUESTING THE DNR TO OPEN SAND POINT BEACH PUBLIC ACCESS FOR INGRESS AND EGRESS OF FISH HOUSES DURING THE WINTER AND, IN THE EVENT THE DNR REFUSES, COUNCIL WILL, AT THAT POINT, CONSIDER ALTERNATIVE ACCESSES FOR WINTER EGRESS AND INGRESS TO THE LAKE TO RELIEVE PRESSURE ON BEACH LANE ACCESS. ITEM #3 WORDING OF "NEIGHBORHOOD" SHOULD BE CHANGED AND ITEM #7 AS STATED SHALL BE ADDED AS AN ADDENDUM. THE ADDENDUM IS AS FOLLOWS: #7 It shall not be deemed to be an admission by the City of Prior Lake of the validity of the Sportsmans Club easement rights or claims to a portion of Beach Lane as a result of the S~ortsmans Club acquiring the Marshall Heir's easement rlghts as contained in the Quit Claim Deed dated April 10, 1989 and recorded April 13, 1989 as document #257785 and the parties agreeing to this matter in this resolution. All parties agree that the city may, at any time, at its sole discretion seek a jUdicial order determining the rights of all parties to "Beach Lane". Upon a vote taken, ayes by Andren, Fitzgerald, Larson, Scott and White, the motion passed unanimously. Further discussion occurred on the parking issue. Mayor requested clarification of stopping or standing as stated ordinance. Council concurred that staff and legal counsel confer on the proper wording of a parking ordinance. The next order of business was discussion of Consent Agenda item (c) Consider Approval of Shakopee Mdewakanton Sioux Agreement Amendment. City Engineer Anderson explained the changes on the Agreement. Andren in the would Shakopee Sioux Agreement MOTION MADE BY WHITE, SECONDED BY SCOTT, TO APPROVE THE AMENDED Amended AGREEMENT BETWEEN THE SHAKOPEE MDEWAKANTON SIOUX AND THE CITY OFAgreement PRIOR LAKE FOR CONSTRUCTION AND MAINTENANCE OF A SANITARY SEWER FACILITY. Upon a vote taken, ayes by Andren, Fitzgerald, Larson, Scott and White, the motion passed unanimously. 4 Minutes of the Prior Lake city Council October 2, 1989 Under Other Business the following topics were discussed: City Manager Unmacht announced the a joint Council workshop in conjunction with the Parks Advisory Committee and Planning Commission would be held on October 5, 1989 at 3:00 p.m. in the Council Chambers. City Manager Unmacht stated that a Metropolitan Council breakfast would be held on October 11 in Shakopee at the Canterbury Inn from 7:30 to 9:00 a.m. staff announced that in light legislation, October 16 would be present the budget, however,it will sometime in November. of the new tax too premature to be on the agenda City Engineer Anderson reported that blood testing for expectant mothers and children under age 6 would begin on October 14 for the purpose of detecting possible traces of lead. Anderson also stated that in the dust wiping process only one window from a residence adjacent to the water tower showed any traces of lead. Councilmember Larson reported that the Lake Review Committee meeting had an excellent attendance and complimented Deb Garross on the fine jOb she had done on assembling hand-out material for the Committee. Larson also announced that Tom Watkins had been elected to chair the LRC.
